SUBJECT: ORDINANCE AMENDING CHAPTER 10.44.020 (CURB
MARIQNGS-MEANINGS-AUTHORITY TO PLACE) OF THE SAN
LUIS OBISPO MUNICIPAL CODE
RECOMMENDATION
Introduce an ordinance amending Chapter 10.44.020(Curb markings-Meaning-Authority to Place)
of the San Luis Obispo Municipal Code amending the time of operation and duration.
DISCUSSION
Pursuant to the City Council's direction regarding parking revenue enhancements on April 5, 2011
and the 2011 Parking Fund review on June 14, 2011, staff is bringing forward recommended
changes to Chapter 10.44.020 (Curb markings-Meanings-Authority to Place) of the San Luis
Obispo Municipal Code to expand the time of operation and duration.
The City enforces yellow and white curb markings during the same time of operation as parking
meters. With approval of charging for parking on Sunday, changes to the curb marking regulations
are needed to reflect this.
Staff also seeks approval of a minor clean up item allowing passenger loading and unloading zone
duration to be extended from three minutes to ten minutes. The City currently has 10-minute
loading zones at the Anderson Hotel, Garden Street Inn, and City Hall however the current
ordinance calls for a maximum of three minutes. Given the size of these facilities,ten minute limits
seems more appropriate.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING SECTION 10.44.020 (CURB MARKINGS-MEANINGS-AUTHORITY TO
PLACE) OF THE SAN LUIS OBISPO MUNICIPAL CODE
WHEREAS,the parking program needs to continue to be self-sufficient for its financial
commitments; and
WHEREAS, the City needs to financially support the operation and debt service of the
next City parking structure; and
WHEREAS, the Council has considered parking revenue enhancements which included
charging for parking on April 5, 2011 and directed staff to return with an enabling ordinance; and
WHEREAS,the Council has considered the staff report and public testimony at a public
meeting.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Section 10.44.020 (Curb Markings-Meanings-Authority to Place) of the
San Luis Obispo Municipal Code is hereby amended as follows:
10.44.020 Curb markings—Meanings—Authority to place.
The city traffic engineer is authorized, subject to the provisions and limitations of this chapter, to
place, and when required herein shall place, the following curb markings to indicate parking or
standing regulations, and the curb markings shall have the meanings as set forth in this section.
A. "Red" means no stopping, standing or parking at any time except as permitted by the
Vehicle Code, and except that a bus may stop in a red zone marked or signed as a bus zone.
B. "Yellow"means no stopping, standing or parking at any time between seven a.m. and six
p.m. every Monday to Saturday, and between one p.m. and six p.m. every Sunday, for any
purpose other than the commercial loading or unloading of materials by a commercially
registered and licensed vehicle or a professionally signed passenger vehicle that displays an
authorized commercial loading zone permit. The commercial loading zone permit requirements
and fee shall be established by resolution.
C. "White" means no stopping, standing or parking for any purpose other than loading or
unloading of passengers, or for the purpose of depositing mail in an adjacent mailbox, which
shall be from three minutes to a maximum of ten minutes, and such restrictions shall apply
between seven a.m. and six p.m. every Monday to Saturday, and between one p.m. and six p.m.
every Sunday, and except as follows:

1. When such zone is in front of a hotel or in front of a mailbox the restrictions shall apply
at all times.
2. When such zone is in front of a theater the restrictions shall apply at all times.
D. When the city traffic engineer as authorized under this chapter has caused curb markings
to be placed, no person shall stop, stand or park a vehicle adjacent to any such legible curb
markings in violation of any of the provisions of this section. (Ord. 1343 § 1, 1998: Ord. 1331 §
