Walter, Director of Public Works Prepared By: Dan Van Beveren, Senior Civil Engineer SUBJECT: NAMING OF THE RAILROAD SAFETY TRAIL PHASE 4A IN RECOGNITION OF THE SAN LUIS OBISPO ROTARY CLUB AND OTHER DONORS RECOMMENDATION As recommended by the Parks and Recreation Commission, approve naming the section of the Railroad Safety Trail from the Cal Poly/City limit to Foothill Blvd, the "Rotary Conner-Cletsoway Link of the Railroad Safety Trail." DISCUSSION The Railroad Safety Trail Phase 4A project is the Class I bikeway between the northern City limits and Foothill Blvd, and is now open for public use. On May 6, 2008, the City Council approved a donor agreement (Attachment #1) with the Rotary Club of San Luis Obispo. The agreement outlined the process of Rotary Club fundraising efforts for the construction of the bike trail, and states the obligations of both the donor and the City. The spirit and intent of the agreement are that the Rotary Club would raise funds, and City would name this segment of the trail in honor of the Rotary Club. Upon completion of its fundraising efforts, the Rotary Club presented the City Council with a donation of$87,000 to be used toward the construction of the project. The recommended action will formalize the naming of the trail segment in recognition of the Rotary Club's contribution. The Rotary Club has requested that the name of the trail be the "Rotary Conner-Cletsoway Link of the Railroad Safety Trail." The names "Conner" and "Cletsoway" are in recognition of Wes Conner, a longtime member of the Rotary Club, and Dr. Richard Cletsoway, whose widow donated $25,000 to the Rotary Club's fundraising effort. These two friends both passed away in 2007. The Rotary Club has provided a letter which details the relationships that both of these individuals had to the City's efforts of constructing bike paths, as well as additional background information about Wes Conner and Dr. Richard Cletsoway(Attachment#2). Consistency with Naming Policy To remain consistent with the City Policy for the Naming of Parks and Recreation Facilities (Attachment#3), the Parks and Recreation Commission (PRC) considered this requested naming on Wednesday, September 7, 2011. The policy stipulates that naming nominations are reviewed by the Parks and Recreation Commission and forwarded to the City Council for approval. The action taken by the PRC was to approve the naming of the trail as stated in this report. C6-1 Railroad Safety Trail Phase 4A-Rotary Club Dedication Page 2 Next Steps and Recognition Upon Council's approval of this naming, staff will coordinate the installation of bronze plaque at the bike trail site along with a ribbon cutting ceremony in recognition of the Rotary Club's contribution. This ceremony is tentatively scheduled for Wednesday, October 19`h. The media and public will be invited to attend. FISCAL IMPACT There is no direct cost associated with the actual renaming of the bike path; however, there will be approximately $2500 in costs associated with the installation of a bronze plaque and ribbon cutting and dedication ceremony for recognition of the Rotary Club's contribution. Our club is gratified that the funds we raised, together with the community's "Missing Link" campaign, have helped complete this section of the trail. When the City agreed to allow us to donate funds for this part of the trail, we also requested the opportunity to name it. Along with the Rotary Wheel, we request the text below to be inscribed on a plaque affixed to a rough hewn stone monument to be placed at the comer of Foothill and California Streets in San Luis Obispo: Dedicated by the Rotary club of San Luis Obispo in honor of Rotarian Wes Conner and Dr. Richard Cletsoway In 2007, Rotary President Roxanne Carr decided to make her Rotary project of the year a contribution to the "Missing Link," section 4a of the City's Railroad Safety Bicycle and Pedestrian Trail. This section, running parallel to California Avenue from Foothill to the Cal Poly property line, connects the Cal Poly and City bicycle systems. The Rotary Club donated $50,000 to the project and also conducted a community campaign which donated an additional $35,000. The Club decided to name the section of the trail after Wes Conner, a recently deceased, long-time Rotarian and Dr. Richard Cletsoway, also deceased,whose estate was a major donor to the community campaign. Wes Conner and Richard Cletsoway were neighbors living near Cal Poly, friends and avid bicyclists who took many long distance biking trips together. They both were strong advocates for the City's Railroad Safety Bicycle and Pedestrian Trail and wanted to see it linked to the Cal Poly bicycle trail system as soon as possible. C6-3 OATTACHMENT #1 Wes graduated from Cal Poly in Ornamental Horticulture in the early 1950's, worked for Yosemite National Park and then returned to Cal Poly in 1963 to teach in the Department. He retired in 1988 and was a dedicated Rotarian. He founded the Bicycle Adventure Club and led a number of international and national bicycle tours. He served on the City Parks and Recreation Commission, Bicycle Advisory Committee, and the Jack House Committee. Beloved by many, Wes died in 2007, survived by his wife, Dotty. Dr. Richard Cletsoway was education at the University of Dallas in Texas, did his residency at General Hospital in Kansas City, Missouri, and specialized in urology. His office was located on Grand Avenue, and he bicycled there and to the hospitals every day. He went on numerous bicycle tours, many with Wes Conner. Near the end of his life in 2007, he asked his wife, Emily, to make a donation in his memory to the construction of the Railroad Safety Bicycle and Pedestrian Trail. That generous donation of$25,000 contributed significantly to the completion of this section of the trail. Our sincere appreciation to the City Council and staff for your untiring and steady work with us on the completion of the Railroad Safety Bicycle and Pedestrian Trail. We look forward to the dedication ceremony in October. WITNESSETH: WHEREAS, the Donor desires to donate$50,000(hereinafter referred to as "Donation"); toward the,construction and installation of safety fencing for the"Missing Link"section of the Railroad Safety Bicycle and Pedestrian Trail parallel to the railway between Foothill Blvd. and Cal Poly's Campus Way("Section'); and WHEREAS,the Donor also is seeking more funds from within Rotary and,in April,May and June,2008,is leading a grass roots fund raising effort—with the volunteer assistance of the Environmental Center of San Luis Obispo ("ECOSLO')and with the support of a broad range of businesses, agencies and nonprofit groups—to solicit donations towards completion of said Section;(hereinafter referred to as "Donation"); WHEREAS, acceptance of the Donation is consistent with City Policy as set forth in Resolution No. 8965 (1999 Series); NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained,the parties hereto agree as follows: 1.TERM. RECOGNITION: The Donor shall be recognized in the following manner. a)The donor shall be permitted,with City approval to install a plaque on project premises,honoring persons or organizations at the discretion of the donor,in accordance with City specifications. b)Dedication of section of bicycle path:At such time as the section is completed, City shall hold a ceremony at which Donor and members of the organization shall receive appropriate recognition. c) The City shall schedule the Rotary's request for naming rights of said section of the Railroad Safety Trail on the City Council meeting agenda if donor and community groups mobilized by donor raise more than 50%of the cost to complete this section of the trail currently estimated at$307,000; 5.TAX STATUS OF CITY: City hereby confirms that City is an organization described in Section 501(c)(3) and 170(b)(1)(A)(v)of the Internal Revenue Code,to which contributions are deductible for Federal income tax purposes to the extent provided in Section 170 and all other applicable sections of the Code.Donor acknowledges and understands that it should consult with its tax consultant as to the deductibility of the Donation for Federal income tax purposes. 6. COMPLETE AGREEMENT: This written Agreement,including all writings specifically incorporated herein by reference,shall constitute the complete agreement between the parties hereto. No oral agreement,understanding,or representation not reduced to writing and specifically incorporated herein shall be of any force or effect,nor shall any such oral agreement, understanding, or representation be binding upon the parties hereto. i 7.AMENDMENTS. i i Any amendment,modification or variation from the terms of this Agreement shall be in writing and shall be effective only upon approval by the City Administrative Officer of the City. 8. NOW, THEREFORE, be it resolved that the City Council of the City of San Luis Obispo does adopt this policy concerning the naming of park and recreation facilities, with the following provisions: 1. Naming of facilities may be made for individuals or groups who have made significant contributions or service to the City of San Luis Obispo and its citizens. 2. Naming may commemorate significant financial contributions to a specific project. 3. Naming is also appropriate for significant natural or historic resources associated with a particular location. 4. Naming need not be posthumous. 5. Those wishing to make nominations shall submit a letter to the Parks and Recreation Commission detailing why the naming should be considered. 6. While the policy primarily deals with new park sites, the renaming of existing facilities or unnamed portions of facilities is not precluded When such a request is received, the current site name will be researched to see that the request is not contrary to a previous naming. . Such naming changes are seen as being appropriate for parks with generic names. 8. Any expenses associated with a facility naming are not necessarily the responsibility of the City.
