SUBJECT: Reconsideration of Use Permit #1390 ("The Crossroads") for
property located at the corner of Orcutt and Broad
CAO RECOMMENDATION:
If Council feels reconsideration with a mixed-use approach (ie:
residential with commercial) is appropriate, then encourage
applicant to file for a PD rezoning.
BACKGROUND:
Discussion
At your Janu?-y 3 meeting, Councilmember Pinard asked if the request for
reconsideration of Use Permit #1390 (see attached letter from Rob Strong) could
be agendized for this meeting; the Council agreed.
The applicant is asking that the project be reconsidered so that the list of
allowed uses may be expanded. The Council may recall that this item was
approved (3-2 vote, Reiss and Settle dissenting) but with a very limited range
of allowed uses. Particularly, the applicant had requested that food service
establishment.-, and retail sales of food and grocery items be allowed, but these
were deleted by the Council. The principal concern seemed to be the higher
levels of traffic these uses may generate compared to other C-S type activities
(the site is in a C-S-S zone).
Further, the applicant is interested in a mixed-use approach, in which some
residentioi units would be included in the project. Usually, residences are
not allowed in the C-S zone. However, it seems that with a PD rezoning, this
kind of mixed-use project may be permitted. Findings will need to be made that
this is consistent with the general plan, but staff expects that such findings
are possible.
The applicant also suggests in his letter that certain aspects of the site plan
will be modified as well, to address specific concerns raised at the Council
hearing.
As we discussed in our original report, staff did not expect that the requested
uses would result in significant traffic problems for the site; thus, staff
would support reconsideration of the range of allowable uses. We also believe
that the mixed-use approach has considerable merit and is worth exploring. If
the Council concurs, then staff recommends that the project proponents apply
for a PD rezoning. This will require Planning Commission and Council review,
which would be appropriate for dealing with the issues related to mixed-use
developments.

Dear Peg :
As we discussed by phone last week . our meetings with individual
City Council members regarding the above project at Broad Street
. and Orcutt Road indicated ba-Z—Lc support for reconsideration, and
apparent interest to encourage planned development rezoning to
enable residential units in addition to the commercial and office
uses proposed. An additional benefit of the PD rezoning would be
the increased control the City would have on the mixture of uses .
The. ' next step would be for the City Council to officially agree
to reconsider the use permit , or alternatively, to encourage the
PD rezoning application by th, property owners . While the PD must
start from the beginning procedurally, taking several months
longer to resolve than reconsideration of the use permit, we are
prepare` to file the PD anrlication, if the Council prefers this
approach and concept.
. We appreciate your willin_ness to initiate the Council discussion
of this matter as a communications item during the January 3,
1989 , City Council meeting . We feel confident that other Council
members will support either the PD or reconsideration, if one of
the members who previously voted to restrict the originally
proposed u--es indicates a desire to reconsider the project .
As you know, we also revised the design of the project to
eliminate the truck loading bay at the front corner of the site,
a feature you specifically found undesirable .

project in the next few months , and feel sure the end product of
this extra effort will be r-warding to both the City and the
property owners
