SUBJECT:
Acceptance of Public Improvements for Tract No. 1509 and Minor Subdivision
SL 87-335 at 2576 Johnson Avenue (8 and 4 custom lot subdivisions,
respectively - Fonte, McVay et al, Subdividers)
CAO RECOMMENDATION:
Adopt Resolution Accepting Public Improvements
DISCUSSION:
1 . Prior Approvals:
a. Tentative Map Approved 7-21-87 per Resolution No. 6279 (1987 Series) .
b. Final Map Approved 12-6-88 per Resolution No. 6546 (1988 Series) .
2.. Description of Improvements:
Public water and sewer mains, completion of Lo Vinedo and Marion Way street
improvements, and public utilities.
3. Bonds on File:
a. Faithful Performance: $ 6,000.00 (Cash)
b. Labor & Materials: $ 3,000.00 (Cash)
c. Warranty $14,000.00 (Certificate of Deposit)
All subdivision improvements have been satisfactorily completed and the
subdivider has asked the City to accept the public improvements and to
release the Faithful Performance and Labor and Materials cash deposits.
The warranty must be held for one (1 ) year after acceptance. No bonds were
required for the minor subdivision since the improvements were completed
prior to final map approval.
FISCAL IMPACTS:
No direct impacts other than normal maintenance of the public facilities.
SIGNIFICANT IMPACTS:
None.
ALTERNATIVES:
Option 1 : Adopt resolution accepting public improvements.
Option 2: Deny acceptance if Council finds any conditions have not been
satisfactorily met.

CONCURRENCES:
The Community Development Director and City Attorney concur with the
recommendation. No department has expressed opposition.
CONSEQUENCE OF NOT TAKING THE RECOMMENDED ACTION:
Subdivider would have to maintain cash deposits for work already completed to
city standards and specifications.
RECOMMENDATION:
Adopt Resolution Accepting Public Improvements For Tract No. 1509 and Minor
Subdivision No. 87-335 and Releasing Faithful Performance and Labor & Materials
Bonds (Cash Deposits) for Tract No. 1509. The warranty (Certificate of
Deposit) shall be held for one year.

& MINOR SUBDIVISION NO. 87-335
AT 2576 JOHNSON AVENUE

WHEREAS, the City Council made certain findings concerning Tract No. 1509
and as contained in Resolution No. 6279 (1987 Series), and
WHEREAS, the Community Development Director made certain findings
concerning Minor Subdivision No. 87-335 and as contained in Director's Action
No. 88=03, and
WHEREAS, all conditions required per said Resolution and Director's Action
have been met, and
WHEREAS, all subdivision improvements have been constructed to City ,
standards,
NOW THEREFORE BE IT RESOLVED that the respective public improvements are
hereby accepted and the cash deposits being held which guaranteed Faithful
Performance and Labor & Materials for Tract No. 1509 are hereby released.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GRANTING APPROVAL OF TENTATIVE TRACT NO. 1509 ;
LOCATED AT 2576 JOHNSON AVENUE
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Findings. That this council, after consideration of the tentative map of
Tract 1509 and the Planning Commission's recommendations, staff recommendations and
reports thereon, makes the following findings:
1. The design of the tentative map and proposed improvements are consistent with the
general plan.
2. The site is physically suited for the type and density of development allowed in the
R-1 zone.
3. The design of the tentative map and the proposed improvements are not likely to cause
serious health problems, substantial environmental damage or substantially and
unavoidably injure fish or wildlife or their habitat.
4. The design of the subdivision or the type of improvements will not conflict with
easements, for access through or use of property within the proposed subdivision.
5. The Community Development Director has determined that the proposed subdivision will
not have a significant effect on the environment and has granted a negative
declaration.
The following findings support the exception stated in Section 2, below, and are required
for conditions 1 (b.) and I (c.) of Section 3.
6. The proposed exception does not constitute a grant of special privilege inconsistent
with limitations upon other properties in the vicinity because the overall intensity
of development is consistent with that of other properties, and because adequate
temporary safe access is furnished by the reduced pavement width.
7. Because of special circumstances, notably the infeasibility of obtaining and
improving property needed for full-width improvements to La Vineda and Marian Way,
the strict literal application of the Subdivision Regulations would deprive the
property owner of privileges enloyed by other properties in the vicinity.
8. That under the circumstances of this particular case, the exception requested carries
out the spirit and intent of the Subdivision Regulations and past actions of the City
Council.
9. The cost to the subdivider of strict literal compliance with the regulations is not
the sole reason for granting the modification.

SECTION 2. Exception That the approval of Tract 1509 be subject to the following
exception:
1. Reduction of La Vineda and Marian Way improvement requirement, from full-width
improvement to.improvement of one-half street width, where dedication of property not
owned by the subdivider would otherwise be required.
NOTE: The above exception to the Subdivision Ordinance is required for conditions 1
(b.) and 1 (c.), below.
SECTION 3. Conditions. That the approval of the tentative map for Tract 1509 be
/subject to the following conditions:
J 1. (t a. y The subdivider shall obtain necessary easements across Lot 19, Block 4 of
L� Goldtree Vineyard Tract (Forest Property) to improve a full 58-foot
right-of-way for LaVineda and a full 52-foot right-of-way for Marian Way,
including installation of street improvements consisting of street paving and
base to city standards, asphalt berm along edge of paving to control drainage
and sanitary sewer, storm drain sanitary..sewer, storm drainage to the
satisfaction of the City Engine QR
b. The subdivider shall obtain all necessary easements to allo dation of
storm drainage across Lot 19, Block 4 ree Vineyard Tract (F
property), to cit n to the satisfaction of the City Engine . . OR.
C. The subdivider shall provide a private easement al to southerly bou ary
of lots 6 and 8 to install storm drainage o mporary basis to the
satisfaction of the City Engineer: ' easement and improvements shall be
abandoned at the discretion-6r the City Engineer when full right-of-way
improvements, in mg storm drainage, for Marian Way and La Vineda are

2. The subdivider shall install "no parking" signs and/X paint the curbs red along all
right-of-way improvements designated by the City Engineer and Fire Marshal. 'V
3. The final "map shall note that at the time of development of lots 3 through 6, two
guest parking spaces on each lot shall be provided in addition to those required by

L,' 4. Existing trees shall be retained on the site to the maximum extent feasible. Any
trees requiring removal to accommodate utility easements shall be replaced with trees
of a suitable size, type, and number as determined by the City Arborist. Final map
shall note that street trees shall be installed at the time of development of each
lot to the satisfaction of the City Arborist.
5. The subdivider shall dedicate to the city and improve a full cul-de-sac turnaround of
44-foot property line radius for Marian Way including curb, gutter, sidewalk,
driveway approaches, street tree easement and public utilities easement. Street
pavement shall be installed to the satisfaction of the City Engineer.
6. The subdivider shall install a street light on Marian Way cul-de-sac to the approval
of the City Engineer. The light shall be owned by the city and maintained by PG&E.
/ 7. All existing structures shall be removed from the site prior to final map
/ recordation.
8. The subdivider shall grade the site to the satisfaction of the City Engineer.
v1 9. The subdivider shall dedicate a. 6-foot public utilities easement and 10-foot tree
planting easement along all street frontages.
10. The final map shall depict a common driveway easement for lots 7 and 8 to the
approval of the Community Development Department. Subdivider shall prepare a common
driveway agreement for said common driveway.
✓11. The subdivider dedicate a one-foot non-vehicular access strip along the entire
Johnson Avenue frontages of lots 7 and 8 exclusive of the common driveway.
