Chairman Joe Glass convened the meeting at 2:05 p.m. on Thursday,
February 2, 1989, in the San Luis Obispo City Council Chambers, San
Luis Obispo, CA,
The attached sheet shows those in attendance.
Chairman Glass asked if the minutes of the June 16, 1988 meeting
were acceptable as submitted. Wayne Peterson moved that they be
approved. Dyer Campbell seconded the motion and they were
unanimously approved.
Chairman Glass then brought up the matter of the elections of
Chairman and Vice Chairman and appointment of Secretary for 1989.
Secretary Milne reviewed the bylaws and explained that the present
C1 officers of Chairman and Vice Chairman had been in office only one
year and under the bylaws they could serve another year.
Accordingly , Ray Parsons moved that the Chairman and Vice Chairman
be reelected. Dyer Campbell seconded the motion. There being no
further nominations , then Joe Glass will serve as Chairman for 1989
and Wayne Peterson will serve as Vice Chairman for 1989.
Wayne Peterson then moved that Secretary Milne be appointed as
Secretary and Glen Priddy as alternate Secretary. Ray Parsons
seconded the motion and Secretary Milne was appointed as Secretary
with Glen Priddy as alternate Secretary for 1989.
Chairman Glass then went onto the matter of the upstream detention
reservoir study for the San Luis Obispo Creek. Wayne Peterson said
that City staff had received a draft about a month ago from Jim
Schaaf, the consultant; but the preliminary draft left much to be
desired and that City staff had commented and returned it to Jim

� '=•-SchaaP". '�'`It should have been available about one week ago for review
by.-,.the ..Zone 9 Advisory Committee, but it had not been received from
Jim Schaaf. Wayne indicated that he would submit copies to the Zone
9 Committee when received from Jim Schaaf.
Secretary Milne then commented that the State Water Resources
Control Board was considering streams throughout the State with
seasons of no unappropriated water being available. He said that
one of the streams listed is San Luis Obispo Creek and that if the
designation is not changed it will be deemed to have no
unappropriated water available any time of the year. He was
concerned that this could adversely affect the proposed offstream
detention reservoir if such is to be proposed for dual function of
flood control and water conservation. He said that the hearings
will be held March 14th and 15th in Sacramento and that he intended
to testify at the hearings. He said that he had tried to call Wayne
Peterson about the matter earlier and hadn' t been able to reach him
so had advised Bill Hetland, the City ' s Utilities Director, of the
concern. Wayne Peterson responded that the initial study by Jim
Schaaf contains a geology report that the sites are prone to leakage
and therefore it is not likely that a suitable site would be
developed for water storage. Any water storage capability, would be
very limited.
Chairman Glass then asked Wayne to update the Committee on the City
of San Luis Obispo Pink Book. Wayne accordingly said that the
matter of the Pink Book was on hold pending receipt of the Jim
Schaaf report. He said .projects are being submitted by various
interests around the City, but City staff is reviewing them with the
view of protecting setbacks for development and, where appropriate,
with dedication of channel rights-of-way .
Roy Parsons expressed his concern that it is wrong to require
O dedication of rights-of-way by property owners unless the. City
intends to do something about flood control improvements . Roy also

Cexpressed concern that no significant projects identified in the
Pink Book are being implemented ; only minor projects. Roy Parsons
indicated that he was pleased with the Pink Book recommendations ,
but he still questions dedications without the government entity
doing recommended improvements. He is concerned that land might be
dedicated but it won' t be used for flood control purposes , but will
be used for other purposes and he thinks this is wrong.
Wayne Peterson responded that the City staff is trying to maintain
the opportunity for future flood control improvements with these
dedications.
Wayne Peterson then indicated that Bob Jones had asked for some time
to review an application that the Land Conservancy is proposing for
another grant. Accordingly, Bob Jones said that the Land
Conservancy is in the process of making another application to the.
State Department of Water Resources for a third year grant. He said
Othat it would be submitted by the end of February. He said that a
number of items were to be covered in the application. First was
bank stabilization on Prefumo Creek and especially in and around the
golf course area. The second item was the matter of
flood-proofing. He said that an investigation of a nonstructural
control measures would be appropriate. They would intend to pull
together all relevant information on flood-proofing. There are
still some 200 properties vulnerable to flooding within the City of
San Luis Obispo. They want to be looking into the flood insurance
benefits . This needed to have the ALERT Program in operation. The
third item would be one of working with the City and Zone 9 and the
County about a public policy in the Pink Book concerning setbacks
and the concept of the detention reservoir. The fourth item would
be the matter concerning transferral of development rights. They
want to work with the landowners in the County for transferring
development rights where lands , could be reserved for riparian zone
O and scenic easements and floodway. He said the Land Conservancy is
active in a TDR Program in the Lodge Hill area of Cambria . He also

noted that the County 's Growth Rate Committee was interested in the
C; concept of the transfer of development rights. He said the
agricultural community is also interested in TDR. The fifth item in
the application would be one for development along the creek just
above the City' s sewer settling ponds. The plan is to develop a
wetlands and use City wastewater for maintenance of the wetlands .
Roy Parsons asked for clarification. He said is what they have in
mind the development of a marsh? Bob Jones said that was correct .
Bob Jones indicated that they were proposing a levee adjacent to
Highway 101 and the wetlands then being created between there and
the creek. He said that the City 's wastewater treatment concrete
lined ponds will be gone; they are serving little purpose now. He
said the last item in their application would be one of working with
the California Conservation Corps for a training program and
resource management of the San Luis Obispo Creek. He said one of
the objectives of the CCC is to train and educate the people before
they leave the CCC program.
�.% Joe Glass asked about the objective of the wetlands? Bob Jones said
that they plan to create a 20-acre wetland as a valuable community
asset; one that students could observe for example.
Dyer Campbell asked if the proposed site wouldn' t interfere with the
need to expand the sewer project? John Ashbaugh of the. Land
Conservancy responded that the plan called for reserving land for
expansion of the sewer project. John Ashbaugh also noted that being
next to the freeway shouldn' t be a problem as the noise doesn' t seem
to bother the wildlife.
Wayne Peterson expressed concern that the longterm use of City lands
is a concern. For example, if the sewer project has to be expanded ,
will they have adequate room? Ron Dunin expressed concern that the
wetlands, if developed , would have to be protected regardless of
whether they are natural or manmade.. Ron also expressed concern
Oabout the Land Conservancy is doing programs without the City ' s

requesting such programs. He is concerned that what they might be
doing would be adverse to a flood protection program. Bob Jones
C . responded that the wetlands shouldn' to
g in unless they prove to be
a community asset. Bob Jones further indicated that they had been
working with Bill Hetland, the City 's Utilities Director. Ron Dunin
expressed concern that the City is being forced to spend $20,000,000
to clean up the water for discharge into the San Luis Obispo Creek
and didn' t want the Land Conservancy proposal to cause another
$20, 000, 000 to be expended.
John Ashbaugh noted that it likely would only be funded if it did
not have a bearing on the wastewater treatment plant. He said if
the wetlands go forward they have to stand alone. Ron Dunin
expressed a desire that the Land Conservancy pursue cleaning up
Laguna Lake.
John Ashbaugh said they have had mixed feedback on wetlands. He is
concerned of the effect on the wastewater treatment process .

Roy Parsons expressed his opinion that there could be more good come
from this issue. The Land Conservancy Projects seem to be good ones
but also seem to cause delay and more costs for flood control
projects.
Joe Glass asked if Bob Jones was requesting feedback. Bob Jones
indicated that the application is due by the end of February , that
when it is prepared they would send a copy to the Zone 9 Advisory
Committee. In their application they would indicate that they don ' t
have Zone 9 Advisory Committee ' s recommendation but are submitting a
COPY for Zone 9' s information.
Ron Dunin again expressed concern about the delays caused to flood
control programs by the Land Conservancy. He said he thought the
initial goal for the Land Conservancy was acquiring lands for open
space and he is now concerned about their involvement in the City ' s
business .

Chairman Joe Glass then focused in on the. desire for the Land
Conservancy to have Zone 9 either endorse or oppose their
application.
Roy Parsons expressed that the Land Conservancy wants comments. Roy
Parsons also felt that it was very appropriate for action by the
Zone 9 Advisory Committee and not to have the Land Conservancy
express concerns of the individual Zone 9 members .
It was decided that this item should be on the next agenda for the
Zone 9 Advisory Committee. Bob Jones then affirmed that the Land
Conservancy won' t quote individual members but will indicate that
the application is being furnished to the Zone 9 Advisory Committee
for their information and comment.
Chairman Glass then asked Dennis Cox to report on the small
improvement program status. Accordingly, Dennis noted that the
Prado Road Bridge abutment work, which calls for gabion protection,
Owas going to the City Council on February 22, 1989 for approval. He
said that the City' s staff is cleaning up the tubes for
accommodating Stenner Creek under the _Highway 101 freeway. He said
the City has been cited for not getting the fish ladder cleaned as
quickly as they should have done. He said that the City staff is
working on easement rights for Old Garden Creek at Center Street
area. It is the intent that when they acquired them, the City would
then clean up the banks and repour the concrete invert for Old
Garden Creek in area as it is now broken up.
Denis Cox said, the City is going ahead with the Giant Reed
Eradication Program. They are respraying some of the giant reeds.
The estimated cost is $750. The first spraying job was better than
they had anticipated. He said that they plan a follow-up spray
program now and then again at the end of summer.
O Wayne Peterson indicated that the. City is now advertising the Toro
Street Bridge replacement.

Roy Parsons expressed his opinion that he likes the City ' s program
on the Old Garden Creek Project where easement rights would be
obtained but the City would go in and do flood control work .
Under the matter of meetings, Ron Dunin suggested quarterly meetings
and he would like to see the Land Conservancy items as a regular
item on the agenda. Ron Dunin expressed his support of the concept
of the Land Conservancy application.
Ron Dunin then made a motion to establish the concept of quarterly
meetings with the Chairman calling for special meetings as
appropriate. Wayne Peterson seconded the motion and it was
unanimously carried.
Wayne Peterson then moved that the next meeting be held at 9 :00 a.m.
on Wednesday, May 17th. Ron Dunin seconded the motion and it was
unanimously carried.
oThe matter of a special meeting for Jim Schaaf ' s report was
discussed and it was concluded that when Wayne received the report
from Jim Schaaf then he would transmit it to the Secretary who would
provide copies for the Zone 9 Advisory Committee members and then a
special meeting could be scheduled with Jim Schaaf making a
presentation and answering questions.
Under the public comment period, Ron Dunin expressed his concern on
how important it was to the Land Conservancy for the Zone 9 Advisory
Committee to support the grant application of the Land Conservancy .
Bob Jones noted that the previous two grants had been supported by
City Council resolution. Ron Dunin then moved that the concept of
the application be approved. There was no second to the motion with
members expressing concern that they would like to see the
application before they made a motion to support it .

Bob Jones indicated that the first grant was for $19, 000 out of a
OState-wide program of $60,000. The second grant was for $25,000 out
of a State-wide program of $200,000. He said that Proposition 70
provided $5,000, 000 and it is the intent of the Department of. Water
Resources to allocate $1 ,000, 000 per year. He said that the Land
Conservancy is thinking that this third application for a grant will
be in the order of a $50,000 to $75,000 grant.
Ron Dunin then asked Bob Jones what kinds of contacts he had had
with Bill Hetland, the City ' s Utilities Director? Bob Jones said
they had had meetings, they had correspondence and they also had a
field trip. He said everybody agreed that the wetlands project that
is being proposed should not complicate the City ' s wastewater
treatment problems.
Wayne Peterson moved that that meeting be adjourned. Roy Parsons
seconded the motion and it was adjourned at 3:26 p.m.
