By: Terry Sanville, Principal Planner SUBJECT: Amendments to the Architectural Review Commission Ordinance (Municipal Cod Section 2.48) to achieve consistency with the Advisory Body Handbook. CAO RECOMMENDATION: The City Council should review the attached ordinance, consider the ARC's recommendations, and take appropriate action. BACKGROUND In October 1988, the City Council amended the Advisory Body Handbook. The council asked each commission and committee to review its bylaws or pertinent ordinances and submit amendments needed to achieve consistency with the new handbook. Section 2.48 of the Municipal Code includes the ARC's bylaws (see attached). Changes to the code needed to bring about consistency with the Advisory Body Handbook include: 1. Terms of Office (MC Sec. 2.48.060): would change from two to four years. Membership would be limited to two consecutive terms (a total of 8 years). 2. Officers Selection (MC Sec. 2.48.080): terms of officers would begin April 1 instead of July 1. The number of terms a commissioner can serve as chairperson or vice chairperson would be limited to two consecutive one-year terms. ARC RECOMMENDATION On January 30, 1989, the ARC considered the code changes and recommended that the terms of office remain at two years. (Vote 5-0.) The commission felt that two-year terms are warranted because of the number and length of regular, special and joint meetings that commissioners attend each year (28 in 1988) and the demands of commission and subcommittee work. The commission indicated that four-year terms might lead to "burnout" and might discourage qualified persons from serving on the ARC. RECOMMENDED ACTION The City Council should review attached Ordinance # , consider the ARC's recommendations and take appropriate action. TS:ts Attachments y C- / O ORDINANCE NO. (1989 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING CHAPTER 2.48 OF THE MUNICIPAL CODE, ARCHITECTURAL REVIEW COMMISSION, TO ACHIEVE CONSISTENCY WITH THE ADVISORY BODY HANDBOOK WHEREAS, in October 1988 the City Council amended the Advisory Body Handbook and requested that all city commissions and committees submit amendments to pertinent ordinances or bylaws needed to achieve consistency with the new handbook; and WHEREAS, on January 30, 1989, the Architectural Review Commission proposed amendments to MC,�eAZ2.48, and forwarded recommendations to the City Council. NOW THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Amendments to Chapter 2.48, Section 2.48.060 (Terms) and Section 2.48.080 O (Officers -- Selection), as shown on attached Exhibit "A" incorporated herein by reference, are hereby approved. A. Commissioners shall be appointed for terms of-twe-LQU years which shall commence immediately upon appointment by the council. B. Commissioners shall serve at the pleasure of the council and may be reappointed; provided that no appointee shall serve more than-&av46-two consecutive full terms (eight years). Appointment to a partial term of office following an unscheduled vacancy shall not preclude the appointee from serving-&m*ttwo consecutive full terms following completion of the partial term; provided that the partial term is less than one year. 2.48.080 Officers -- Selection.
