SUBJECT
Time extension for Tract 1261 - a single-family residential subdivision creating or
adjusting seven lots on Rosita Street between Foothill Boulevard and Cerro Romauldo
Avenue.
CAO RECOMMENDATION
Adopt the attached resolution to approve a one-year time extension, as requested, subject
to original findings, exceptions, and conditions.
BACKGROUND
Situation
In April 1985, the City Council approved the tentative map for this tract, which creates
lots around several existing houses (see map) and which needed several design exceptions
(see Resolution No. 565). Under state and city subdivision rules, a final map must be
filed within two years of tentative map approval, or the subdivider must obtain approval
of a time extension. The council approved one-year extensions in 1987 and 1988. The
subdivider has requested another extension. This is the last extension which can be
granted.

Evaluation
The property owners have nearly completed installation of public,improvements but they
will not be complete before the expiration date.
There have been no changes in the project, the setting, or relevant policies or
ordinances since the original approval. Therefore, staff sees no reason to deny this
time extension. The subdivider has submitted a final map for checking and, as noted
above, the owners have begun to install subdivision improvements.
Alternatives
The council may approve or deny the time extension. The council may add, delete, or
modify conditions.

CONSEQUENCES OF NOT TAKING ACTION:
The map would expire and applicant would have to reapply for subdivision.
(Alternatively, the applicant could file final map and bond for incomplete improvements.
There is no apparent practical benefit to the city from that approach.)

RESOLUTION NO. (1989 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
GRATING APPROVAL OF A TWELVE-MONTH TIME EXTENSION FOR
TRACT 1261 LOCATED AT 133 ROSITA STREET
WHEREAS, the subdivider requests a twelve-month time extension to meet conditions
necessary to receive final approval, including installation of required improvements; and
WHEREAS, reasonable progress has been made toward completing subdivision improvements
and filing of the final map; and
WHEREAS, the circumstances and findings of original tract approval are unchanged;
NOW, THEREFORE, the City Council resolves as follows:
Section I. That Tract 1261 is granted a twelve-month time extension to April 2,
1990, subject to original tract map findings and conditions as specified in City Council
Resolution No. 5651 (1985 Series) attached hereto.

RESOLUTION NO. 5651 (1985 Series)
A RESOLUTION OF TIE OJUNCIL OF THE QTY OF SAN LUIS
OBISPO GRANTING APPROVAL OF TENTATIVE TRACT NO. 1261
LOCATED AT 133 PND 155 ROSITA STREET
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. Findings_ That this council, after consideration of the.
tentative map of Tract 1261 and the Planning Ccmnission's recommendations,
staff recomendations and reports thereon, makes the following findings:
L. In accordance with state and city environmental review guidelines, an
initial environmental study (ER 1-85) has been prepared and a negative
declaration was approved by the Director February 13,. 1985.
2. The tentative. map is consistent with the general plan.
3. The site is physically suitable for the proposed type and density of
development allowed by the I-1 zone.
4. The design of the subdivision and the proposed improvements are. not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat.
5. The design of the subdivision and the type of improvements are not
likely to cause public health problems.
6. The design of the subdivision and the type of improvements will not
conflict with easements for access through or use of property within
the proposed subdivision.
7. Certain exceptions are granted subject to these findings:.
A. That the property to be divided is of such size arra shape that
it is impractical or undesirable to conform to the strict
application of city regulations; and
B. That cost to the subdivider of strict or literal carpliance
with the regulations is not the sole reason for granting the
modification; and
C. That the modification will not be detrimental to the public
health, safety, and welfare,, or be injurious to other
properties in the vicinity; and
D. That granting the modification is in accord with the intent and
purposes of these regulations, and is consistent with the
general plan.

Section 2. Exceptions. That the approval of the tentative map for
Tract 1261 shall be subject to the following exceptions:
1. The areas of lots 1 and 2 are 5,000 square feet each, instead of a
minimum 6,000 square feet.
2. The area of lot 3 is 6,000 square feet instead of the minimum 6,900
square feet.
3. The depth-to-width ratios of lots 4 and 5 are 3.2:1 instead of the
maximum 3:1.
4. The longest dimensions of lots 4 and 5 are oriented perpendicular to
south, rather than within 30 degrees of south.
5. The width of sidewalk (four feet instead of six feet) and roadway (32
instead of 40 feet) of Rosita Street are less than standard..
SECTION 3. Conditions. That the approval of the tentative map for
Tract 1261 be subject to the following conditions:
1. Applicant shall reimve storage building, sheds, and garages as noted
on the tentative map.
2. Applicant shall remove or relocate outside of required setbacks the
shed on lot I.
3. Applicant shall remove the garage on lot 3.
4. Applicant shall provide off-street parking as required by the Zoning
Regulations for lots 1, 2, 3, and 6.
5. Subdivider shall pay water frontage and acreage fees as determined by
the City Engineer, with credit for existing services.
6. Subdivider shall install individual water and sewer lateralsfor each
lot. Existing water laterals and meters shall be relocated as needed
to meet current standards.
7. Subdivider shall provide a private drainage easement along the east
property line of lots 4, 5, and 7 to Foothill Boulevard.
8. Subdivider shall provide for undergrounding of new utility services to
the subdivision (except those on Cerro Romauldo and Foothill _
Boulevard) to the approval of the utility companies and the City /
Engineer.

9. Subdivider shall install or reconstruct frontage improvec�nts along
Cerro Rcmauldo, Rosita Street, and Foothill Boulevard (including
handicap ramps in both curb-returns at Foothill Boulevard) and
one-half street improvements on Cerro Rcmauldo and paving on Rosita
Street to meet the new gutter grade, all to the approval of the City
Engineer.
10. Final map shall include the following notes:
A. "The parts of lots 6 and 7 within fifty feet of Foothill
Boulevard are subject to traffic noise which exceeds city ,
standards for outdoor residential use."
B. "Houses constructed on lots 6 and. 7 shall be sound-proofed
consistent with the general .plan Noise Element to provide
interior sound levels not to exceed 45 dB(A) ."
C. "On lots 6 and 7, for any new houses or for remodelling of the
existing house involving more than 508 of its replacement
value, measures to reduce outdoor noise to acceptable levels
for active use areas shall be provided to the approval of the
C Community Development Department."

and on the following roll call vote:

Dear Ken:
The above map expires on April 2 , 1989. To date, Mr. and
Mrs. Brown have completed most of the improvements and they
are soliciting bids to complete the remainder at this time.
Unfortunately they won't be completed prior to April 2,
1989.
In order to allow them sufficient time to complete the
remainder of the improvements, we request an extension of
one (1) year.
