Kenny Public Works Director City Engi r Supervising Civil Engineer 3 SUBJECT: Final Map Approval for Tract 1399, an Eight (8) Unit Commercial Air-Space Condominium at 3547 S. Higuera Street (White. & Tull Enterprises, A General Partnership - Subdivider) RECOMMENDATION: Adopt Resolution Approving Final Map for Tract 1399 BACKGROUND: This is a conversion of an existing commercial building on a common lot to provide eight (8) airspace condominium units.. It is a re-subdivision of a lot in Tract 703 (Higuera-Commerce Park). All public improvements are existing. On-site improvements (landscaping, utilities, fencing, etc. ) have been completed as prior building permit conditions. No subdivision agreement is necessary. All necessary fees were received in conjunction with the building permit or the previous subdivision. The Public Works Department has reviewed the final map and conditions per Resolution No. 6020 (1986 Series.) have been met. ALTERNATIVES: Option 1 : Adopt resolution approving final map for Tract 1399. Option 2: Deny approval of the final map if the Council finds all conditions have not been satisfactorily met. CONCURRENCES: The Community Development Director and City Attorney concur with the approval of the final map. No department has expressed opposition. RECOMMENDATION: Adopt resolution approving final map for tract 1399. (1989 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING THE FINAL MAP FOR TRACT 1399 C (WHITE & ,TULL ENTERPRISES - SUBDIVIDER) WHEREAS, the City Council made- certain findings concerning Tract 1.399 as contained in Resolution No. 6020 (1986 Series), and WHERAS, all conditions required per Resolution No. 6020 (1986 Series) have been met, NOW THEREFORE BE IT RESOLVED that final approval is hereby granted for Tract 1399. Fin din%ts. That this council, after consideration of the tentative map of Tract 1399 and the Planning Commission's recommendations, staff recommendations and reports thereon, makes the following findings: 1. The design of the tentative map and proposed improvements are consistent with the general plan. 2. The site is physically suited for the type and density of development allowed in a C-S zone. 3. The design of the tentative map and the proposed improvements are not likely to cause serious health problems, substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. 4. The design of the subdivision or the type of improvement will not conflict with easement for access through (or use of property within) the proposed subdivision. 5. The Community Development Director has determined that the proposed subdivision will not have a significant effect on the environment and has granted a negative declaration. SECTION 2. Conditions That the approval of the tentative map for Tract 1399 be subject to the following conditions: 1. The subdivider shall establish covenants, conditions, and restrictions for the. regulation of land use control of nuisances and architectural control of all buildings and facilities. These CC&R's shall be approved by the Community Development Department and administered by [give name] homeowner's association. 2. The subdivider shall include the following provisions in the CC&R's for the Tract: a. Property owner's association shall be created to enforce the CC&R's and provide 5"6t for professional, perpetual maintenance of common areas including, but not limited to, the driveway, parking lot, landscaping, sewer, utilities and building exteriors. The right shall be granted to the City to maintain common areas if the property owner's association fails to do so, and to assess said association for expenses incurred. C. All parking spaces provided in the project shall be available for use by all the individual owners. (� pS d. There shall be no change in city-regulated provisions of the CC&R's without prior approval of the Community Development Department. ✓ 3. Subdivider shall provide individual water services for each unit. Meters shall be clustered at property frontage, to the approval of the City Engineer. ✓ 4. Subdivider shall extend individual gas and electrical services and metering for each unit, to the approval of affected utilities and the City Engineer. 5. Final maps shall note a blanket easement over the common lot area, except under the structures, for underground public utilities serving the site, to the approval of the City Engineer and affected utility agencies. On motion of Councilman Settle seconded by Councilwoman Rappa and on the following roll call vote: AYES: Councilmembers Settle, Rappa, Dovey and Mayor Dunin NOES: None ABSENT.
