SETTLE SUBJECT: REFERENDUM REGARDING COURT STREET CAO RECOMMENDATION: DIRECT CITY CLERK TO CONTINUE PROCESSING THE COURT STREET REFERENDUM AND DETERMINE ITS SUFFICIENCY BACKGROUND: On Friday, 10/5/89, the City Clerk rejected the Court Street referendum petition and discontinued verifying signatures based upon advice by the City Attorney's Office that the petition fails to comply with the basic requirements of the California Elections Code Section 4052. I request that the City Council direct the City Clerk to continue verification of signatures and certify as to sufficiency or insufficiency of the signatures. Previous examples of initiatives filed with the city i.e. Parking Initiative and Mobilehome Rent Regulations that were j determined not to meet all applicable State law were nonetheless placed on the ballot for voter approval. The Council felt in both of these instances that due to the large number of signatures and public input that it was of a significant enough value to allow the voters a choice on such an important decision. If, after examination of the signatures a Certificate of Sufficiency can be made, I further request Council consider it again as soon thereafter as possible. The Council's options at that time are: 1. Council repeal of the Court Street. ordinance in its entirety; or 2. Council submittal of the ordinance to the voters at the next regular municipal election (November 7, 1989) . bja
