The contractor was noted to stop work at approximately 8 p.m., July 5. The City will be obligated for certain contractor related expenses because of the work stoppage. DISCUSSION: General: A daytime project on Higuera Street would involve construction operations which are not significantly noiser than a regular construction job. Pavement breakers, jackhammers, and chainsaws will not be needed, therefore, it is staffs feeling that the work will closely approximate a normal construction job so far as noise is concerned. The concrete pavement will be removed to a centerline joint with a large excavator, which will break up concrete without the need of a jackhammer. The excavation for the structure will be made with this same piece of equipment. This will involve loading a number of trucks but will not be significantly more noisy than a standard pipeline installation job. Forming of the concrete structure, pouring, finishing, and backfilling are relatively standard jobs so far as noise is concerned. Staff feels that the local business concerns regarding excess noise are ill-founded. The construction work will not be concentrated at one spot but will travel up the street from the connection near the Firestone store to Santa Rosa Street, thus one business will not be exposed to this noise for any significant period of time. Niehtwork: The contractor has made a detailed study of cost of conducting night work and on July 10 submitted a figure of $154,378.40 for this work (Exhibit 2). In our conversations he has pointed out a number of difficulties related to night work, primarily the necessity of paying double time for steel workers, and the extra cost to operate a concrete plant and deliver concrete materials. In addition, his insurance costs are increased because of the more hazardous nature of night time work. There are significant increased costs in providing lighting, and decreased efficiency in virtually all operations at night. Of particular difficulty is the problem of providing adequate lighting for the steel workers attempting to tie the reinforcing steel in an 18 inch wide trench, 10-15 feet below the street surface. The tying of reinforcing steel will go very slowly. In his letter, the contractor points out that delays that have already taken place (in addition to delays inherent in night work) may push the project into inclement weather, resulting in additional delays. The contractor has requested that all liquidated damages be waived. We would agree with the 14 extra days if work must be conducted at night, but not with waiver of 111 liquidated damages. acy o f san Luis owM CIL AGENDA REPORT Stortndrain Page Two Night work will have an adverse effect on the neighborhood, especially residents of the Anderson Hotel who would deal with lighting, construction, and heavy truck operation all night. Of secondary concern is the effect that truck traffic would have on the motels near 101, which is the contractor's haul route, if trucks can haul only at night (Exhibit 3). The contractor is not at all anxious to change the project to one consisting only of night work. He is also not certain at this stage that he can include every contingency in his proposal for this change order. Consequently, his figure for the work must be high enough to protect himself from all the eventualities. Because of the intangibles, staff is unable to successfully argue for a lower figure and therefore must accept the contractor's price. Staff has checked with the City Attorney's office which has indicated that the City Council may approve a change order of this magnitude if it so elects. We have also obtained verbal approval from the Community Development Department (which had previously indicated that work hours should be limited from 6 am. to 11 p.m.) to now approve complete nighttime operation as necessary. The Community Development Department continues to express concern regarding the effect that nighttime operations will have on residents in this area of the community. With nighttime operations the contractor can leave one lane of traffic open during the day on Higuera Street, however, it is not possible to provide for onstreet parking (Exhibit 4). In addition, the contractor would have to place nighttime lighting standards on the sidewalk in order to keep the standards out of the work area. With a daytime contract, one lane of traffic will be available on Higuera Street every night, with sidewalks open at all times. Advantages of Night Work 1. Will reduce daytime noise from construction operations. 2. Will permit one 12 foot travel lane for through traffic along Higuera Street during the day. 3. Address the request of neighboring businesses. Disadvantages of Night Work 1. Will increase cost of the project by $154,378.40. 2. Working will extend completion of this portion of the work and entire job by 14 working days due to the inefficiencies inherent in night work. I 3. Will increase nighttime noise on routes leading to and from the job site. Of particular concern are the motels near 101 and Santa Rosa. 4. Will increase nighttime noise and light problems in the immediate neighborhood creating a possible nuisance for residents. Will tM permit one 12 foot -traffic lane for through traffic along Higuera during nighttime hours. 6. Nighttime work will delay emergency response should gas, power, water, sewer, electricity, phone, or cable television lines be broken. 7. Nighttime operation will require that the sidewalks be closed at night to permit placement of project lighting. 8. Nighttime operation increases all hazards for the job. 9. Night work may extend construction work into the rainy season resulting in additional delays and cost. 10. A nighttime contract will require additional negotiation with the contractor who is requesting that g_ll liquidated 'damages be waived. This amounts to $3,000/day on Phase 1, $3,000/day on Phase 2 and $1,000/day on the entire contract. B. Advertising Program Staff has taken the following steps regarding advertising for this project. 1. A Telegram Tribune ad was placed July 1 (Exhibit 5). 2. A newsrelease was presented to all media during the week of July 3 (Exhibit 6). 3. We have ordered and received delivery of two 3 ft. X 4 ft. signs to be placed at each end of the work area (Exhibit 7). Signs are ready to be installed when the work starts. These signs will indicate that businesses are open during construction. 4. City and BIA are working with Tom Jones Advertising for a series of radio, television, and newspaper ads. Ideas have been submitted in writing for BIA and staff review. Costs are reasonably estimated at $4,000 - $6,000. C. Alternative Parking Sites 1. Staff has worked out a verbal agreement with John Rossetti, owner of property at 1065 Higuera Street (Exhibit 8), to use an 11 space parking lot until he commences construction on the building August 7. There will be a net gain of 9 spaces during the day, since access to the property through a County parking lot will result in loss of two spaces in that lot. Access is by means of an alley off Santa Rosa Street. Mr. Rossetti has indicated that he will not charge the City for this parking but that he will insist that it be available for his purposes when his contractor moves in August 7. Since access to the lot is difficult and will be available for only 3 weeks, staff does not feel it should advertise this location. 2. Staff is planning to make available to the two businesses primarily affected (Rice Travel Service and Cattaneo Beanery) validation stickers to permit free parking for their customers in the City parking structure on Palm Street. .00 city of san Luis oBispo Eli% COUNCIL AGENOA REPORT Stormdrain Page Four D. Use of County Parking Lot on Northwesterly Side of Higuera Street 1. The County parking lot is located northwesterly of the construction trench which will occupy approximately half the street width (23 feet). This parking lot will not be accessible when the Higuera Street portion of the job is under active construction, either as a staging area for the contractor or for public parking because there is noreasonable way to obtain access to the site. Staff had previously worked out an arrangement with the County employees for them to access the site by driving through the County building from Monterey Street. This building was formerly a garage and can easily accommodate this traffic movement. The City staff had also indicated a willingness to provide an alternate access to the County parking lot through the County Bank parking lot from Santa Rosa Street. This involves removal of some landscaping, at least one tree, and concurrences on the part of the County Bank for the City to do this. E. Travel Lanes 1. Whether the job is conducted at night or day, there will be only one travel lane available along Higuera Street between Santa Rosa and Osos during non-working hours and in no case will on-street parking be available (Exhibit 4). Sidewalks will be open at all times if the job is conducted during the day, but will be closed at night to allow placement of construction lighting if the job is to be conducted at night. The staff had included in the construction plans traffic routing and signing to provide for traffic movements around the project during the various phases of the work (see Exhibits 9a & 9b). Signs for the Higuera Street phase of the work are in place awaiting start of the job. CONCLUSION: With the exception of the Council determination regarding night versus day work, all programs called for by the Council at the July 5 meeting are in place or in process to mitigate adverse affects of the project. After studying the project in some detail it is staff's conclusion that even if the contractor were to offer to do the nighttime work at no increase in cost, the job delays, safety problems, and detriment to this and other neighborhoods would be excessive. Staff strongly recommends that the Council follow the original staff recommendation calling for a day time project with permission for the contractor to extend into evening hours if he so elects. Staff also recommends that the contractor be allowed to start work at first light (around 5:00 am.) as part of a regular operation. Romero Page 2 July 10, 1989 These figures do not reflect any costs that Madonna Cons- truction Company has already incurred due to the delay of the start of this project such as: shoring rental, removing and covering signs, unloading equipment that had been loaded and ready to go to the project site, and my fees in preparing this proposal which we will submit when the project is under way and we know our exact costs . Because of the safety factor involved in this project, we feel that working under night time conditions will result in a less safe condition than would be encountered during normal day light hours. In addition, because of the delay that has already been placed upon this project we anticipate that weather problems may also be a factor and have already jeopardized the timely completion of this contract. Both projects will have an adverse effect on traffic. Southern California Gas Company will replace a gas main in Ctxm-m Street, between Marsh and Mill Streets. Zhe work will require appmoodmately three weeks. One parking or traffic lane on Chorro Street will be closed for construction operations. In addition, parking along the opposite side of the street will be restricted along the work area. We expect significant traffic congestion when the Gas Ocuparry works near intersections. If you have any questions, please call the Dick Riley at 800/523-2838. Madonna Construction Coupany will commence work on a City contract to install a major stormd+a;n on Higuera Street between Osos and Santa Rosa Streets, and across Santa Rosa Street between Higuera and Monterey Streets. In addition, new sewer and water lines will be installed on Higuera Street and all catch basins will be upgraded. Day time traffic will be blodoed on Higuera Street west of Santa Rosa coowncirg July 6 until approximately the errs of August, and on Santa Rosa Street from appdmately September 1 until mid-October. Sidewalks will remain open to provide access to all businesses. Oe project is of such a large magnitude that it is not possible to conduct the work without the street closures. Please try to program your vehicular trips in such a manner as to avoid the traffic congestion near these projects. Since integrity of staff in dealing with the Council is critical, I feel .I must respond to those comments. Direction to the staff was given at the April 4 meeting when the plans and specifications were approved. Those minutes are attached. In response to this direction, staff made changes in plans and specifications to reflect the following: 1. Potable water was no longer permitted. The contractor had to use non-potable water. 2 . Staff analyzed the practicality of attempting to conduct the work leaving Higuera Street open during the job. It was our conclusion that it could not be conducted for any reasonable cost and by any reasonable working arrangement. We inserted an item in the specifications to reopen Higuera Street at the end of each working day. This separate bid item was bid at $5, 000. 3 . We took several measures to accelerate the construction. We obtained the longest extension of hours that we could from the Community Development Department, that is 6 a.m. to it p.m. , included these hours in the specifications and urged the contractor to work two shifts. We inserted a very stringent liquidated damages and bonus provision in the specifications. The contractor will be fined $1,000 per day for finishing the entire job late, $3,000 per day for failing to comply with the street closure schedule, and will receive a bonus of $3, 000 per �1 day for finishing the street closure work ahead of schedule. It was our feeling that the $6,000 per day differential, and the longer work hours, would accelerate construction as directed by the Council. Higuera Project Page Two All of these changes were explained to the Council at the June 6 meeting when the contract was awarded. Please note that the Council, at the April 4 meeting, did not direct staff to include the alternative of having all work conducted at night. On June 6 when the contract was awarded, the Council gave additional instructions to staff regarding the contract (minutes attached) . In response to this, staff speeded the processing of the contract documents and set up an early prejob conference, with directions to the contractor to move in as soon as possible. Although the issuance of the contract documents was speeded, the contract work is now delayed for approximately 10 days. staff immediately commenced working with BIA to come up with signage near the project to inform the public that the businesses were open. Unfortunately Dodie Williams was on vacation during part of this time, and we could not obtain her final approval until early July when we ordered signs on a rush basis. We are continuing to work with Dodie on an advertising program which will include TV, radio, and newspaper. The Council directed staff to obtain an estimate from the contractor for conducting the project at night and keeping the streets open during the day. On June 7, the day after the Council meeting, staff requested such a figure from the contractor. He responded on June 29. Staff immediately prepared a memorandum to John Dunn (attached). indicating the magnitude of the cost and indicating intent to continue with the contractas awarded. This is an extremely difficult job. Staff has done its best to try to take into account the wishes of the Council and the businesses, however, ability of the staff to completely mitigate all of the problems is severely limited. We have no authority to require that the Community Development Department give an approval for all night work. We have no authority to bypass BIA when their administrator was not available to approve the final design of the sign. We had no authority to require the contractor to come back with a timely report on the cost of conducting the project at night. Nor have we been able to convince some of the business owners that their fears regarding excessive noise from the project are unfounded. We doing the best we can under the circumstance. After discussion, it was moved by Councilwoman Rappa, seconded by Councilman Settle to approve the plans and specifications and authorize staff to advertise for bids with requirement for using potable water during the construction period and provide alternates in the bid for leaving the streets open and to provide for an. accelerated construction program. Councilwoman Ravna was concerned that the project, as she remembered it, was to have had most of its work done in the evening, thereby leaving the streets open during the daytime hours. Councilman Reiss agreed. Mayor Dunin asked for public comment. Dodie Williams, SIA Administrator, on behalf of several businesses in the area, stated .concern about what impact the closing of the street would have on their downtown businesses and their ability to survive during the period of construction. She encouraged the city to either allow the streets to remain open or to provide additional signage so that persons desirous of doing business with these merchants could have better access, whether it be pedestrian access or street access to businesses. After discussion, it was moved by Dunin/Ravua (4-1, Councilman Reiss voting no) to adopt Resolution No. 6621 to award the contract to Madonna Construction Company in the amount of $437,252.00, with direction to staff to shorten the execution of the contract and protect the local affected businesses by increasing directional signage with the help of the eiA. I have just this morning received a tentative estimate from Madonna Construction Company that increased costs to utilize this approach would be $208,000. This represents more than 50 percent of the $392,700 stormdrain contract cost and would, to me, represent an unnecessary expenditure of City funds. In addition, because work is much more difficult to conduct at night, construction time on Higuera Street and on Santa Rosa Street would each be extended approximately 2 weeks. I believe the current City approach of providing signing, advertising, and fulltime pedestrian access to all the businesses is a reasonable and correct approach. I am planning, therefore, not changing the basic nature of the contract but to proceed as per original plans and specifications. hignite/dfr#17
