SUBJECT Appeal of ARC decision to deny exceptions to Sign Regulations for car
dealership located on Los Osos Valley Road south of Auto Park Way.
RECOMMENDATION
Adopt resolution
denying the appeal, and concur with the action of the ARC to deny the exceptions.
BACKGROUND
Discussion
The applicant proposes a sign which exceeds standards for the zone for both height and
area. The commission denied the request for exceptions on June 5, 1989, and the
applicant has appealed. The sign proposal is identical to one which the ARC denied in
1988; minutes from both denials are attached. The initial application was filed, in part
because the existing freestanding sign on the site has been amortized under the 1977 Sign
Regulations and must be removed.
Significant Impact
Signs are categorically exempt from environmental review requirements. No fiscal or
other impacts are expected as a result of council action on this project.
Consequences pf Not Taking St Recommended Action
If the council upholds the appeal, the sign may be erected as shown on the submitted
plans.

EVALUATION
Staff suggests the council focus on the following issues raised at the ARC hearing:
1. Sign Heiaht
The proposed sign would be 20 feet in height with a 3 foot setback. Normal height limits
allowed in the zone call for five-foot-high monument signs in the five-foot setback area,
or fifteen-foot freestanding signs outside the setback.
In 1985, the commission denied a similar height exception for the Nissan dealership at
the corner of Los Osos Valley Road and Auto Park Way. In 1982, the commission approved
two freestanding signs for Hysen Johnson Ford (23' height, 55sf area; 20' height, 161sf
area), which adjoins the Honda dealership on the north. Signs for the Bear Valley
Center, south of the Honda dealership, conform to standards.
The commission has reviewed a number of signs along Los Osos Valley Road in the last two
years. Height exceptions have been allowed in some cases when freeway visibility was a
concern (Howard Johnson, Allstar Inn, Chevron: 20' height, 82 sq. ft. area) or when the
property is located on a cul-de-sac (Hysen Johnson expansion lot, 18' height, 80 sq.
ft.). Neither of these bases for exceptions would appear to apply in this case.
2. Sign Area
The area of the sign is 106 square feet (counting two adjacent sides and including
nonstructural framework, per Sign Regulations definition of "Sign Face" and "Area of
Sign", attached). Seventy-two (72) square feet is the maximum normally allowed in the
C-S zone.
3. Total Area of Signs on Site
A maximum of 200 square feet is allowed unless exceptions are approved. Including
existing permanent wall signs on the building (and assuming that the existing signs
painted on the windows are exempt temporary signs), the sign area proposed is 250 square
f eet.
Staff would note that one of the existing wall signs - the one on the fascia - was
installed without a permit. This sign would require an exception, since only one wall
sign is normally allowed.
4. Other Concerns
The appellant's statement notes concerns with visibility of signage alternatives which
would meet the standards for the zone - parked cars might block a lower sign. The
appellant also expressed concerns with street tree foliage blocking signs at the ARC
hearing. In his judgement, effective signage is not possible without height and setback
exceptions, with the current site layout.

ALTERNATIVES
The council may uphold the appeal, if required findings for sign exceptions can be
supported (refer to attached draft resolution). If the council upholds the appeal, the
sign may be approved as submitted or subject to modifications.
If the council denies the appeal, the sign could be installed only if it is lowered to
15' in height, reduced to 72 sq. ft. in area, and installed with a setback of at least
5'..
The council may also continue the appeal.
RECOMMENDATION
The council should concur with the finding of the Architectural Review Commission that
the exceptions requested for the freestanding sign are not justified. The attached
resolution denying the appeal should be adopted.

CONIIVMION'S ACTION, AND APPROVING EXCEPTIONS TO SIGN

WHEREAS, on June 5, 1989, the Architectural Review Commission denied a request to
approve exceptions to the Sign Regulations for a proposed freestanding sign at 12250 Los
Osos Valley Road; and
WHEREAS, on June 13, 1989, the appellant appealed the Architectural Review
commission's action to the City Council; and
WHEREAS, on July 5, 1989, the City Council conducted a duly noticed public hearing to

NOW, THEREFORE, the council of the City of San Luis Obispo upholds the appeal, and
approves exceptions noted below, subject to the following finding:
Section 1. Finding,
Exceptional circumstances apply to this site which justify the requested exception,
notably the large size of the site and the obstruction of visibility by foliage of
existing mature trees.
Section 2. Exceptions.
A. Sign height of 20 feet where 15 feet is normally allowed.
B. Three-foot setback from street frontage where five-foot setback is normally
required.
C. 106 square-foot sign area where 72 square-foot maximum area is normally allowed.
D. 250 square feet of total sign area for the site where 200 square-foot maximum is
normally allowed.

APPEAL TO CITY COUNCIL
In accordance with the appeals procedure as authorized by Title I , Chapter
1.20 of the San Luis Obispo Municipal Code, the undersigned hereby appeals
from the decision ofArchitectural Review Commission rendered
on May 15, 1989 , which decision consisted of the fallowing ( i .e.
set forth factual situation and the grounds for submitting, this appeal.
Use additional sheets as needed) :
Sunset Honda voluntarily submitted plans one year ngo for a 20'
high sign to replace the 25' high sign they presently have.
The sign is within the required square footage of this zone , the
only exception was 5' overall height. The reason for this
request is because the layout of their lot does not provide
them with adequate set back for a sign that is a horizontal
configuration. This is why the sign is this way now. To
reduce the sign to 15' high would put the sign on the ground
and because of parking along Los Osos Valley Road , rears will
block the sign. The signs at the other dealers in the area
do not have this problem and still have more than l5 ' in
height . The AMC Jeep sign is 18 ' high, the Rancho Grande
sign is 20' high, and the San Luis Nissan sign is 1.5 ' and
with the raised parking lot puts the sign 17 112 ' high from J
the street .

I do not believe the ARC totally understands the rn7oblem
with this site if this sign is made to be 15 ' high from
grade. His sign will do him very little good. The City r't'
has encouraged the dealerships to move to this area of ;
town. With the traffic problems in this area and
congestion this dealer should be allowed to advertise
their business the same as the others. If he is nut allowed
to advertise properly he will be caused financial hardship.

Greg Smith, Associate Planner, presented the staff report recommending denial of the
requested exception.
Guy Moerman, CN Signs Bt Graphics,•responded to the staff report and felt a precedent
regarding sign calculations had already been made with the signage for the Central
Coast Plaza where the sign counted as only one side. He noted he could provide a
5-foot setback if needed, and noted the sign would be screened by existing street
trees. He noted the sign was proposed at that height because of vandalism concerns.
Commr. Jones felt the 20-foot height would be acceptable but suggested theapplicant
try to bring the height down if possible.
Commr. Starr did not see a reason for the third face and wanted the height of the
sign dropped by at least 2 or 3 feet.
Commr. Morris had a problem with the third face and felt the applicant must deal
with the street trees on a_ permanent basis. He suggested the applicant consider
using h monument sign.
Commr. Gates thought a two-faced sign at 15-feet would be appropriate. That, along
with prominent wall signs, would .ntake, the exception unnecessary.
Commr. Bradford felt the area of the sign was not a problem, but it's height was.

Commr. Chatham concurred with Commr. Morris and Bradford and suggested a pedestal
approach to the sign with a 15-foot height.
Commr. Cooper thought the sign would be acceptable at 15 feet but felt a monument
sign would be better for visibility.
Commr. Jones moved to continue consideration of the request.

Greg Smith, Associate Planner, presented the staff repor recommending a continuance
with direction.
Tom Templeton, representative, responded to the aff report and noted it would be
difficult to corribin,e signage on the site and que ioned the need for consistency as
proposed by staff. He presented a color samp and indicated he could remove the
phone number from the signage.
Commr. Bradford felt the main problem ith the proposal was with an effective
location but thought a non-illuminated ign would be acceptable. She felt none of
the existing signs on the site were ap ropriate.
Commr. Starr supported the exce ion due to the number of buildings on the site.
Commr. Chatham supported t exception.
Commr. Jones also support d the exception but felt the lettering was too cramped.
Commr. Morris concur r d with Commr. Jones.
Commr. Gates wan d the phone number eliminated from the sign copy.
Commr. Cooper oted that the sign's appearance was old-fashioned but he had no
problems wit it.

Commr. Jones was concerned that the sign regulations may not'be in tune with
existing conditions. He Celt some height exception may be justified since the site
could not be seen by northbound traffic. He suggested.trimming off-site trees to
allow the signs to be visible from the freeway. He could support the proposed
colors and the pole signage.
Commr. Starr agreed with Commr. Jones. He.telt this request may set a precedent if
it's approved and he would like to work wyih staff on standards for freeway-oriented
businesses. ;
Commr. Gates felt the signage was o large and suggested combining some of the
signs in the vicinity. She felt the go and colors were acceptable.
Commr. Cooper felt the prop I should be reduced in scale but supported the
proposed colors. He was co cerncd this request would set an unhealthy precedent.
Commr. Jones moved t continue consideration of the request to allow further
investigation of the i e and its surrounding area and with direction to return with
a lower and smalle sign.

Judith Latimer, Associate Planner, presented the staff report recommending a denial
of the height exception.
John Allred, CN Signs and Graphics, responded to the staff report and presented a
picture board of the proposed signage. He explained the request and noted that a 15
ft. sign would not be readable at 40 to 50 mph. He noted that the sign would have
new 16-inch letters on the existing pole.
Archie Woodward, Sunset Honda, wanted more sign orientation to Los Osos Valley
Road. He noted that the new sign would have white letters on a blue background. He
indicated that a lower height would put the sign on the ground and felt the
existing regulations were unfair to businesses.
Commr. Gates liked the sign but would prefer blue letters on a white background.
She would be willing to support a 17 1/2 ft. sign but did not think the greater bulk
proposed was necessary.
Commr. Starr felt the sign was attractive and the dimensions acceptable. He was
concerned about the Nissan dealership which may have been granted an exception.

Commr. Jones felt a wedge shape sign may be better than the proposed rectangular
shaped sign. He did not think a 20-foot sign was a problem in this area.
Commr. Morris felt there was justification for the height exception and that the
proposed signage was an improvement over what was existing now. He felt the sign
would not look as good if it were lowered. He had a problem with the third face..
Commr. Bradford could not make the findings for an exception.
Commr. Cooper did not want to establish a precedent and concurred with Commr.
Bradford.
Commr. Morris asked if any of the signs in the vicinity had been granted
exceptions. Ken Bruce responded that only the Rancho Grande dealership had, and
that there were findings for those exceptions.
Commr. Starr moved to approve the request subject to the condition that the sign not
be larger than the existing Nissan sign.
Commr. Starr withdrew the motion.
Commr. Starr moved to continue the request with direction to return with a sign that
is more in conformance with Sign Regulations.
