I tins OBISPO COUNCIL AGENDA REPORT ITEM N MB 1 FROM: Clerk SUBJEC General Municipal Election for November 7, 1989 CAO RECOMMENDATION: A) Adopt resolution calling the election for November 7, 1989, and 8) adopt resolution requesting the Board of Supervisors consolidate the General Municipal Election with the School and Special Districts Election. BACKGROUND: The General Municipal Election provides for the election of the Mayor and two Councilmembers and may include any measures submitted by Council or citizens, i .e. , initiatives, referendums, recalls, Charter amendments, advisory measures, and other propositions. The resolution calling the election includes additional filing requirements pursuant to the City's Campaign Election Ordinance adopted 8/15/70 and revised 6/2/86. In particular, Section 3 of the resolution allows for the filing of a 400 word Statement of Education and Qualifications and setting forth the candidate's stand on local issues (M.C. 2.40.080) . This statement will be included with the sample ballot at no cost to the candidate. Section 4 of the resolution will permit rebuttal arguments in addition to arguments for or against a measure already provided for (E.C. Section 4015) . The resolution consolidating the election allows the city to combine its election with the Uniform District Election and avoids duplication of printing and mailing of sample ballots, computer tabulation, precinct workers and canvassing the results. Requirements called for by the City' s Campaign Regulations will be performed by the City. This will include separate advertising and filing requirements in addition to those mandated by the State. The majority of the advertising and notices required by the State's Election code will also be performed by the City. All filings , i .e. , statement of qualifications, Conflict of Interest, State and City financial reporting, will be handled through the City Clerk's Office. Two Notice of Intents to Circulate a Petition were filed with the City Clerk on March 13, 1989 (attached) entitled "ARC Amendment Initiative" and "Water Supply Initiative. " These were filed in a timely manner having been submitted within 10 days of publication. The Election Code provides that proponents of the petitions may not begin to obtain signatures until 21 days from the date of publication. This date was Monday, June 3. By law, proponents have 180 days to obtain the necessary signatures which is 10 percent of the registered voters or 2,495 signatures. City and State law allows for some flexibility in establishing the last date that the City Clerk may receive the petitions. The initiatives were not received in time to be verified for placement on the November ballot. If the proponents are successful in obtaining 15 percent of the registered voters, and the petitions are received within the six-month time period, a Special Election will be required (probably sometime in March or April , 1990) . If only 10 percent of the signatures are obtained, then these -5 - 1 July 5. 1989 Page Two initiatives will be set at the next Regular Municipal Election to be held in November, 1991 . ALTERNATIVES: 1. Adopt resolutions calling and consolidating the election - Recommended (Section 4 allowing rebuttal arguments optional . ) 2. Failure to adopt the resolution consolidating the election would result in two elections being held on the same date. 3. Continue discussion of any one of the resolutions for additional report or clarification. CONCURRENCES: Acting City Attorney. FISCAL IMPACT: $30,000 is anticipated to conduct the 1989 election for Mayor and two Councilmember seats. Several factors will influence City General Municipal Election expenditures. 1. Any measures, initiatives or referendums placed on the ballot according to the entity placing it, i .e. , City of San Luis Obispo, School Districts, Cuesta College or Special Districts. 2. Number of candidates placed by the City of San Luis Obispo, School Districts, Cuesta College or Special Districts. Five seats are open on the San Luis Coastal Unified School District, two seats on the Cuesta Board and three seats on the City Council . RECOMMENDATION: A) Adopt resolution calling the General Municipal Election to be held Tuesday, November 7, 1989, and B) adopt resolution requesting the San Luis Obispo County Board of Supervisors to consolidate the General Municipal Election on Tuesday, November ^r , 1989, with the Uniform District Election (UDEL - Schools) to be held on said date. (1989 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO REQUESTING THE SAN LUIS OBISPO COUNTY BOARD OF SUPERVISORS TO CONSOLIDATE THE GENERAL MUNICIPAL ELECTION ON TUESDAY, NOVEMBER 7, 1989, WITH THE SCHOOL AND SPECIAL DISTRICTS ELECTION TO BE HELD ON SAID DATE BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Board of Supervisors of the County of San Luis Obispo is hereby requested to order the consolidation of the General Municipal Election with the School and Special Districts Election to be held on Tuesday, November 7, 1989, and said Board of Supervisors is hereby authorized to canvass the returns of the election called and the election shall be held in all respects as if there were only one election and one form of ballot, namely the ballot used at such primary election shall be used. The precincts, polling places and officers of election for the General Municipal Election hereby called shall be the same as those provided for said School and Special Districts election and as set forth in Section 23312 of the Elections Code. The Board of Supervisors is requested to certify the results of the canvass of the returns of the General Municipal Election to the Council of the City of San Luis Obispo, which shall thereupon declare the results thereof. SECTION 2. The Board of Supervisors is hereby requested to issue instructions to the County Clerk and Registrar of Voters to take any and all steps necessary for the holding of said General Municipal Election. The City will pay its pro rata share of extra costs incurred by the County in consolidating the elections pursuant to Section 51350 of the Government Code. The City Clerk is hereby directed to file certified copies of this resolution with the Board of Supervisors, the County Clerk and the Registrar of. Voters of the County of San Luis Obispo. SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution. Pursuant to Section 302 of the City Charter, a General Municipal Election shall be held Tuesday, November 7, 1989, to fill the following elective offices: (1) Mayor - two (2) year term (2) Two (2) Councilmembers - four (4) year terms each and to Vote on any other measure placed on the ballot by the Council. SECTION 2. For purposes of this election, the polls shall be open from 7:00 a.m. to 8:00 p.m. SECTION 3. Pursuant to Election code Section 10012 and Municipal Code Section 2.40.080(A) (6) , each candidate may submit with the nomination papers a Statement of Qualifications of the candidate of no more than 400 words, which statement will be printed and mailed out with the sample ballot at not cost to the candidate. SECTION 4.
