Dear Mayor Dunin:
The City of Santa Monica urges you to oppose Senate Bill 552 ("SB 552") . This
bill would severely limit the franchise fee that chartered cities can require
oil pipeline companies to pay for their exclusive use of city property. The
City of Santa Monica believes that such companies should pay cities the fair
market value of land occupied.
By way of background, SB 552 would amend the Broughton Act and would cap
franchise fees at "2% of gross pipeline receipts" without regard to the value
of the property occupied by the pipeline and without regard to the significant.
costs and potential liability created by these pipelines. The bill passed the
Senate on June 22 by a vote of 21 to 13. The bill is awaiting vote in the
Assembly.
From our perspective, SB 552 amounts to little more than a public subsidy of
oil pipeline companies. The bill operates as an incentive for major corpora-
tions to appropriate valuable public rights of way at below market value.. No
other private enterprise or public agency is afforded such a benefit and no
need exists for pipeline companies to be given preferential treatment.
The recent tragic pipeline explosions in San Bernardino and in the Soviet
Union indicate just how severely these pipelines can impact our communities
and consume public services. In the face of such reality, cities should not
be hamstrung or prevented through the use of an artificial formula from charg-
ing pipeline companies fair market value.
We strongly urge you to oppose SB 552 in its present form and to communicate
your opposition to your state Assembly representatives..
