SUBJECT:
Final Map Approval for Tract No. 1545, a 6-Unit Airspace Residential
Condominium at 550 Buchan Street (Nelson and Joanne Harris, Subdividers)
RECOMMENDATION:
Adopt resolution approving the final map for Tract No. 1545
DISCUSSION:
This tract consists of 6 residential airspace condominiums on a common lot.
The subdivider has complied with the conditions of the tentative map per
Resolution No. 6406 (1988 Series) as follows:
1 . The subdivider has installed the necessary subdivision improvements
(except as listed below in 4 below) and has paid the required fees in
conjunction with the construction of the condominium units. There is no
subdivision agreement..
2. The CC&R's have been approved and the necessary easements have been
dedicated on the map. All fees and deposit: have been paid as indicated on
the attached Fee and Bond List.
3. The final map has been checked and is in substantial conformance with
the tentative map.
4. Conditions 11 and 12 of Resolution No. 6406 (1988 Series) required the
installation of a new fire hydrant adjacent to the project's driveway and a
water main extension to the satisfaction of the Fire Dept. The Fire Dept.
re-onalyzed their requirements and determined that the existing hydrant at
the westerly corner of Buchan and Nipomo Streets will be able to serve this
development until a new hydrant is installed with a City project (listed in
the proposed CRP). The subdivider paid $3000.00 to the City in lieu of
installation of this fire hydrant at the direction of the Fire Dept. The
money will be used to install a new hydrant at the corner of Buchan and
Beach Streets which better serves the entire neighborhood. (See attached
memo from Erwin Willis. )

ALTERNATIVES:
Option 1 : Adopt resolution approving the final map for Tract 1545.
Option 2: Deny approval of the final map if Council finds that conditions have
not been satisfactorily met.
CONSEQUENCES OF NOT TAKING RECOMMENDED ACTION:
Delay in recording the final map and occupancy of the units until approval and
recordation of the final map.
CONCURRENCES:
The Community Development Director, Fire Chief, Utilities Director and City
Attorney concur with the recommendation. No department has expressed any
opposition.
RECOMMENDATION:
Adopt resolution approving the final map for Tract No. 1545.

i A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING THE FINAL MAP FOR TRACT NO. 1545
WHEREAS, the City Council made certain findings concerning Tract No. 1545 as
contained in Resolution No. 6406 (1988 Series), and,
WHEREAS, the Fire Department has determined that a new fire hydrant is not
needed at the entrance to the project as prescribed in Condition 11 of the
above-mentioned resolution, due to the existonce of an adequate fire hydrant at
the intersection of Buchan and Nipomo Streets, and the Subdivider has paid
$3000.00 to the City for a fire hydrant to be installed at the intersection of
Buchon and Beach Streets under a future City contract which will better serve
the neighborhood, and
WHEREAS, the 8-inch watermain per Condition 12 of said resolution is
therefore not needed to support the previous fire hydrant location, and
WHEREAS, all all other conditions required for Tract No. 1545 have been
met;
NOW THEREFORE BE IT RESOLVED that final approval is hereby granted for
Tract No. 1545.

RESOLUTION NO. 6406 (1988 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
GRANTING APPROVAL OF TENTATIVE TRACT NO. 1545
LOCATED AT 550 BUCHON STREET
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Findings. That this council, after consideration of the tentative map of
Tract 1545 and the Planning Commission's recommendations, staff recommendations and
reports thereon, makes the following findings:
1. The tentative map is consistent with the General Plan.
2. The design and improvements of the proposed subdivision are consistent with the
General Plan.
3. The site is physically suitable for the type of development proposed and the density
allowed in the R-2 zone.
4. The design of the subdivision and the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or
wildlife or their habitat.
5. The design of the subdivision or the type of improvements are not likely to cause
public health problems.
6. The design of the subdivision or the type of improvements will not conflict with
easements, for access through or use of property, within the proposed subdivision.
7. The Community Development Director has determined that the proposed subdivision will
not have a significant effect on the environment and has granted a negative
declaration.
SECTION 2 Conditions That the approval of the tentative map for Tract 1545 be
subject to the following conditions:
1. Each unit shall have individual utilities and all new internal utilities shall be
underground.
2. Final map shall show a 6-foot public utilities easement and a 10-foot tree easement
along the project's public street frontage.
3. Subdivider shall grant an easement over the common lot area, except under structures,
for underground public utilities serving the site, to the approval of the City
Engineer and affected utility companies.
4. Subdivider shall provide necessary easement for existing overhead utility line along

5. All on-site driveways, nonstructural parking improvements, and utilities shall be
installed as subdivision improvements.
6. Subdivider shall install individual water service for each dwelling unit. Meters
shall be clustered at the Buchon Street frontage to the approval of the Public Works
Department.
7. Subdivider shall pay water acreage and park in-lieu fees as calculated by the City
Engineer prior to recordation of final map.
S. Subdivider shall install an 8400t wide curb, gutter and sidewalk per city standards
to the satisfaction of the.City Engineer.
9. Subdivider shall install one new street light on Buchon Street. to the satisfaction of
the City Engineer.
C,' 10. Subdivider shall install one street tree per 35 ft. of property frontage to city
standards to the approval of the Public Works Department.
11. Subdivider shall install a fire hydrant as required to the approval of the City Fire
Department. - ~~
--� 12. Subdivider shall install a new 8-inch_water line.,in Buchon Street from the project
site northerly to Nipomo Street to the satisfaction of the City Engineer.
13. Subdivider shall prepare conditions, covenants and restrictions to be approved by the
City Attorney and Community Development Director prior to final map approval. CC&R's
shall contain the following provisions:
a. Creation of a homeowner's association to enforce the CC&R's and provide for
professional, perpetual maintenance of all common area including private
driveways, private utilities, drainage, guest parking, walls and fences,
lighting, and landscaping in a first class condition.
b. Grant to the city the right to maintain common area if the homeowner's
association fails to perform, and to assess the homeowner's association for
expenses incurred, and the right of the city to inspect the site at mutually
agreed times to assure conditions of CC&R's and final map are being met.
C. No parking except in approved, designed spaces.. Provision shall be made for two
additional guest parking spaces to be installed within the project if a majority
of the homeowners' association feels that future conditions warrant them.
Landscaping between the street yard and the driveway for Unit 6 and in the
landscaped area between Units 4 and 5, or such other area approved by the
Community Development Director, shall be designed to accommodate potential
future conversion.
d. Grant to the city the right to tow away vehicles on a complaint basis which are /f

C. Prohibition of storage or other uses which would conflict with the use of
garages for parking purposes.
f. No outdoor storage of boats, campers, motorhomes, or trailers nor long-term
storage of inoperable vehicles.
g. No outdoor storage by individual units except in designed storage areas.
h. No change in city-required provisions of the CC&R's without prior City Council
approval.
L Homeowner's association shall file with the City Clerk the names and addresses
of all officers of the homeowner's association within 15 days of any change in
officers of the association.
14. All units shall be numbered in accordance with an addressing plan approved by the \
Community Development Department. J
15. Subdivider shall install a unit identification plan with directory at the Buchon
Street entrance to the site to the approval of the Community Development Department
staf f.

Subject 550 Buchon - Tract 1545
Date: July 5, 1989
The condo project at 550 Buchon is nearing completion and the water line and required fire hydrant have
not yet been installed At the request of the owner of this property I reevaluated the need for a fire
hydrant in this area. There is currently a hydrant at the corner of Buchon and Nipomo which is
approximately 400 feet from the rear building of this project. Our current standards require a hydrant
within 300 feet of all residential structures. This requirement could be met by a hydrant at the comer of
Beach and:Buchon. Since there is no hydrant at this comer this location would best serve the area's fire-
protection needs. A hydrant in this location would provide this project and the other houses from mid-
block between Nipomo and Beach to mid-block between Beach and Carmel and the houses on Beach
Street. Since the existing water line is only a 4" line, to install a hydrant at this comer will require
installing a new water line from Nipomo to Beach. This was the proposal that was discussed at the August
24, 1988 meeting with the owners.
is my understanding that the Utility Department will budget for the replacement of the water line from
Nipomo to Beach on Buchon in a future CRP budget. Sincethe original Council requirements on this
project required the installation of a fire hydrant and new water line to the hydrant, we can require the
developer to immediately install a new water line up to the driveway of his project and put a hydrant at
that location. This will cover his project but not the houses in the area of Buchon and Beach.
Eventually, the City will still have to come in and tear up the street, again, to replace the rest of the main
to the corner of Beach and Buchon and install a second hydrant at that location. This does not seem like
a logical or economical way to proceed. Only one hydrant is needed in the area and it would seem more
prudent to only tear up the street one time instead of two. The Fire Department is willing to delay the
fire hydrant requirement until the City can install the new water main-
