CAO RECOMMENDATION: Consider a request by Councilmember Rappa regarding the concept of drafting an . ordinance establishing a recycled product procurement policy for the City. BACKGROUND Attached, for City Council review, is a draft ordinance that would establish a recycled L product procurement policy for the City. The purpose of the ordinance is to require the development of internal policies and procedures that ensures city use of recycled products and materials to the maximum extent possible. The ordinance has been submitted by Council Member Rappa for discussion by the entire Council. Under the attached ordinance, a city would be required, within a twelve month period, to inventory existing product and service specifications and determine if any existing specifications preclude the use of recycled products or materials. In cases where existing specifications did preclude or discourage the use of recycled materials or products, a i city would be required to develop new.specifications. Exceptions to this policy would be limited to circumstances where available recycled products could not achieve necessary performance standards. The ordinance also requires the use of recycled paper in all copy machines and encourages-cities to allow price differentials of 10% or more for recycled products. I Should the Council provide direction to pursue the development of an ordinance of this nature, staff would return at a future meeting with a comprehensive staff report addressing potential impacts to the City. i i I / '0 V ✓►�`" iut 041 {4! ORDINANCE ESTABLISHING A RECYCLED PRODUCT PROCUREMENT POLICY Col d Canto IV (I o N WHEREAS, the volume of material disposed of at the (riiy StInly)-ft (s) has been increasing annually, and ,f W'^'Chea""- -iS� C� a4 C4 , kw,« OIDLAhoo C s Ltt, �n sel.iO� wxa-u 4 iZP044 WHEREAS, sanitary landfill space is at a premium and it is becorWng increasingly difficult to site new LA C-4 J, landfills, and C WHEREAS, much of the material that enters the waste stream can be recycled, reused or incorporated in the manufacture of new products, and WHEREAS, ( y) participation in and promotion of recycling programs can significantly reduce. the volume of material entering the waste stream thereby extending (city/county) landfill life expectancy and reducing expenses, and WHEREAS, for recycling programs to be effective, markets must be developed for products that incorporate postconsumer materials in their manufacture, are reusable, or are designed to be recycled, and WHEREAS, California State Law requires that local agencies buy recycled products if fitness, quality and price are equal to nonrecycled products and allows local agencies to adopt purchasing preferences for recycled products. NOW THEREFORE BE IT RESOLVED by the (Council/8 s) of the (City4eovrttyr— Of4�kGwr Q!!* as follows: That is hereby amended by adding Section to read as follows: 1. Within twelve months subsequent to the effective date of this section, all Jcityfeetf►tpj departments, agencies, offices, boards and commissions must conduct a review of existing product and service specifications to determine whether existing specifications either require the use of products manufactured from virgin materials or exclude the use of recycled products, reusable products, or products designed to be recycled. 2. In the event that such specifications do exclude the use of recycled products or require the use of virgin materials, then such exclusions or requirements must be eliminated unless tg4aertin fnn department or entity can demonstrate to the satisfaction of the Icity mariarthat these recycled products would not achieve a necessary performance standard. 3. Within the same 12 month period k atl4c't rAsettftty)departments and agencies must recommend changes to thelcity inistrative-offieer/et� to ensure that performance standards for particular products can be met and that specifications are not overly stringent, and to recommend changes to ensure that specifications will Incorporate a requirement for the use of recycled materials, reusable products, and products designed to be recycled to the maximum extent practicable, subject to an alternative showing that either the performance of the product will be jeopardized or that the product will negatively impact health, safety or operational efficiency. 4. Outside contractors bidding to provide products or services to the Xcityfeeurrtyt including printing services, must demonstrate that they will comply with the specifications described in paragraph 3 to the greatest extent feasible. 5. JCitOZOORty+staff will work to encourage the copier industry to develop high-speed copiers that will accept recycled paper. In addition, recycled paper shall be purchased and used in all copy machines that will accept it. 6. When recycled products are used, reasonable efforts shall be undertaken to label the products to indicate that they contain recycled materials. jCigVd& P departments and agencies shall use for their mast-head stationery and envelopes recycled paper that Includes postconsumer recycled content and Indicate on the paper and envelopes that they contain recycled material. Other recycled products used by the jCityAuMyY shall also indicate that they contain recycled material to the,extent practicable. 7. A (10% or greater) price preference may be given to recycled products, reusable products offered as alternatives to disposable products, and products designed to be recycled where they are offered as alternatives to non-recyclable products. The preference percentage shall be based on the lowest bid or price quoted by the supplier or suppliers offering non-recycled products. 8. Thejcity/06*) will cooperate to the greatest extent feasible with neighboring city and county governments in an effort to develop a comprehensive, consistent and effective procurement effort intended to stimulate the market for recycled products, reusable products, and products designed to be recycled. 9. All related*ityt¢pdepartments andencies shall work cooperatively to further the purposes of the ordinance.
