SUBJECT:
Final Map Approval for Tract No. 1823, a 6-unit residential airspace
condominium development at 591 Highland Drive (Cleeves & Gillespie,
Subdividers) .
RECOMMENDATION:
Adopt resolution approving the final map for Tract No. 1823.
DISCUSSION:
The tentative map for this tract was approved on October 17, 1989 per
Resolution No. 6703 (1989 Series) (Attachment 4) . There are no special
conditions imposed per this resolution, only typical code requirements.
The tract is comprised of 6 individual units on a common lot. The units
are presently under construction. The onsite improvements are being
installed as building permit requirements. There are no new "public"
improvements other than standard curb, gutter and sidewalk, and water
services
Vehicular access to this tract is via two existing driveways off Felton
Way and Ferrini Road. A common driveway and drainage agreement already
exists between the adjacent southerly property owner and this subdivider,
satisfactory to the Community Development Department.
No subdivision agreement nor bonding is needed since there are no public
improvements, and the "private" improvements are conditions of occupancy
of the units.
The final map has been checked and found to be satisfactory and in
substantial conformance with the approved tentative map. All fees have
been deposited as noted on the Fee List (Attachment 5) .
SIGNIFICANT IMPACTS:
None.
CONSEQUENCES OF NOT TAKING THE RECOMMENDED ACTION:
Delay in recording the final map and units could not be occupied nor
sold.

ALTERNATIVES:

any requirements have not been satisfactorily met.
RECOMMENDATION:
Adopt resolution approving the final map for Tract 1823 .

CA RESOLUTION OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO APPROVING THE FINAL MAP
FOR TRACT 1823 LOCATED AT 591 HIGHLAND DRIVE
(Cleeves and Gillespie, Subdividers)
WHEREAS, the City Council made certain findings concerning
Tract No. 1823 as contained in Resolution No. 6703 (1989 Series) ,
and
WHEREAS., there are no special conditions required per said
resolution other than standard code requirements being completed
under current building permits, and.
WHEREAS, the final map is in substantial conformance with the
approved tentative map.
NOW THEREFORE BE IT RESOLVED that the final map is hereby
approved and the Mayor is authorized to execute the subdivision
agreement.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING AN APPEAL OF THE PLANNING COMMISSION'S ACTION
DENYING A RESIDENTIAL CONDOMINIUM SUBDIVISION ON THE CORNER
OF HIGHLAND DRIVE AND FERRINI ROAD. (TRACT 1823)
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Findings. That this council, after
consideration of public testimony, the subdivision request TR 18231,
and the Planning Commission's action, staff recommendations and
reports thereon,. makes the following findings:
1: The design of the tentative map and proposed improvements
will not adversely affect the health, safety and welfare
of persons 1(iving or working in the. vicinity.
2 . The design of the tentative map and proposed improvements
are consistent with the general plana
3. The design of the tentative map and the proposed
improvements are not likely to cause serious health
problems, substan4} 1 environmental damage or substantially
and unavoidably inure fish or- wildlife or their habitat.
4. The design of the subdivision or the type of improvements
will not conflict with easements for access through (or use
of property within) the proposed subdivision.
5. The Community Development Director has determined that the
proposed subdivision will not have a significant effect on
the environment and has granted a negative declaration.
6. There are circumstances of the site, specifically the
shape, the topography, and the existence of unusually-
large rights-of-way, distinct from other land in the same
zone, that make compliance with the condominium regulations
open space requirements impractical.
7. The variance will notconstitute a grant of special
privilege; an entitlement inconsistent with the
limitations upon other properties in the vicinity with the
same zoning..

8. No feasible alternative to authorizing the exception would
satisfy the intent of city policies and regulations.
SECTION 2. The subdivision request TR 1823 is hereby
approved.
