SUBJECT:
Revised list of designated employees and advisory body members
required to file Conflict of Interest Statements (Form 730) .
CAO RECOMMENDATION:
Adopt resolution updating list of designated employees and advisory
body members required to file Conflict of Interest Statements and
rescind Resolution No. 6673 (1989 Series) .
BACKGROUND:
In September, 1989, the Council last considered and adopted an
amended Conflict of Interest Code which incorporates the State
Standard Model and updated designated employees and advisory body
members required to file Conflict of Interest Statements.
Section 87300 et seq. of the Government Code requires the City to
adopt and maintain a Conflict of Interest Code. It must identify
and require certain positions to disclose specified information
regarding investments, interests and income. The Political Reform
Act of 1974 directs that a Conflict of Interest. Code identify all
positions that take or authorize any official action on behalf of
their agencies. This includes an official's participation by way
of advising or making recommendations to a decision-maker, whether
or not the decision-maker follows the official's advice.
Governmental decisions include: decisions on ordinances,
regulations and resolutions; decisions on contract awards,
purchases and leases; decisions on hiring, firing and personnel
actions; decisions on land use, zoning, redevelopment plans,
permits and variances; and decisions on any other matters that may
come before the agency.
The primary purpose of establishing Conflict of Interest Codes is
to prevent financial conflicts of interest on the part of public
officials. Conflict of Interest statements are public records and
are kept on file in the City Clerk's Office.
Most of the changes to the current list have occurred' as a result
of amended titles or new positions approved in the 1990-91 budget.
All of these positions file with the City Clerk. The City Council,
City Administrative Officer, City Attorney and Planning Commission
file similar forms (Form 721) with the Secretary of State as

required by law. Effective January 1, 1990, Section 87200 of the
Government Code was amended to add City Treasurers and other
"public officials who manage public investments" to file Form 721.
Therefore, the Finance Director has been deleted from the City's
Conflict of Interest filing list and will now file Form 721.
ALTERNATIVES:
1. Adopt resolution as recommended, with current list of
designated employees/commissioners and titled positions
required to file Conflict of Interest Statements.
2. Adopt resolution with amendments, if necessary.

FISCAL IMPACT:
None.
RECOMMENDATION:
Adopt resolution updating list of employees and commission members
required to file a Conflict of Interest Statement and rescind
Resolution No. 6673.

TO FILE A CONFLICT OF INTEREST STATEMENT
AND RESCINDING RESOLUTION NO. 6673 (1989 SERIES)
BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Designated city employees and commission
members listed on the attached Exhibit "A" shall be required to
file a Conflict of Interest Statement (Form 730) with the City
Clerk.

using Form 721 and are, therefore, not shown as designated positions by the City.
