Community Development Director; BY: Pam Ricci, Associate Planner SUBJECT: Appeal of Architectural Review Commission's action regarding the setback of a proposed monument sign for HomeFed Bank located at the corner of Santa Rosa and Marsh Streets. CAO RECOMMENDATION: Continue to a date certain, December 18, 1990. BACKGROUND Situation/Previous Review On October 1, 1990, the Architectural Review Commission (ARC) approved a monument sign for HomeFed Bank with a two-foot setback. That action was appealed on October 9, 1990, by the applicant. HomeFed Bank would like a one-foot sign setback. Data Summary Address: 1135 Santa Rosa Street Applicant/Appellant: HomeFed Bank Representative: Sylvia Cegelis Zoning: C-C General Plan: Retail Commercial Environmental Status: Categorically exempt. DISCUSSION Staff has asked the applicant to submit additional information in order to evaluate their request for a lesser setback. As of the date of this report, that information had not been submitted. The applicant is aware of, and in agreement with, the requested continuance. RECOMMENDATION Continue to a date certain, December 18, 1990. Oblapo, CA 03403.8100 APPEAL TO CITY COUNCIL In accordance with the appeals proeedurc uy authorized by Title 1 , Chapter 1 . 20 of u,e San Luis Obispo Municipal Code, the undersigned hereby appeals from Lhe decision of Architectural Review Commission rende.rad on October 11 1990 which decision consisted of the following ( 1 .a set rurth factual altuation and the grounds for submlttlag Lila appeal . use addltional sheets as needed) : The applicant requested a 4 'x6 ' monument sign (as recommended by Staff, Pam Ricci ) with a 1 ' set- back. The motion was made, seconded and carried to approve a 4 'x4 ' monument sign with a 2 ' setback. Because the reduced size and increased setback were made in the motion, public hearing was closed and the applicant did not have an opportunity to speak and address the effect the changes in size: & setback would have on the visibility of the sign. • Of particular concern is the setback, which will result in the sign ( at any size ) being of no practical use to vehicular traffic- due to the pecuilar ingress/egress driveway at the site, and nearby bushes which block clear visibility of the driveway. The bushes, which are not on the applicant 's site, effectively block both the driveway and any sign that is more than 110" setback from the sidewalk. The applicant requests the City Council hear the appeal of the Oct . 1st 1990 decision of the Architectural Review Commission. Dear Ms. Condon, I am writing to request the appeal by HomeFed Bank of the Design Review Commission case 90-93, scheduled to be heard by the City Council on November 20, 1990, be placed on a later Council agenda. The request is being made due to a conflict in the applicants ' sched- ule on that date: the applicant will be unable to attend a November 20th hearing. After discussing this conflict with Planner Pam Ricci, she suggested we attempt to re-schedule for the City Council docket of December 4 , 1990. That date would be agreeable with the applicant . We would appreciate consideration of this request for placement on the December 4 , 1990 City Council docket. Please inform me of confirmation of this request. The meeting is scheduled for Tuesday, December 4, 1990, beginning at 7:00 p.m. in the Council Chambers of City Hall, 990 Palm Street. Other public hearings may be held before or after this item. Please know that if you challenge this action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing.
