Dear Mayor Marx,
Since reviewing the letter from the Department of Transportation — Legal Division to you dated March 20,
2015, it is my hope that you and your fellow City Council members revisit the past Land Use Circulation
Element (LUCE) - 2035 plan and the overrule of the San Luis Obispo Airport Land Use Commission (ALUC).
The author of the letter that you received, Raiyn Bain, is a well- respected attorney. The legal counsel is
referenced as the "Legal Division" in the October 2011 California Airport Land Use Planning Handbook. As
the closing line in the aforementioned letter states, "Caltrans requests that the City Council reconsider the
improper overrule of the ALUC and the rescinding of its airport land use compatibility plan." I do too.
The San Luis Obispo City Council and you have the opportunity tonight to schedule this as future agenda item.
Please do so immediately.
The facts in the letter highlight many points that members of the ALUC, community members and I have stated
for the last several months. The SLO LUCE -2035 plan is flawed and facilitates infill residential and commercial
construction where it is not safe or legal. The SLO -LUCE 2035 was funded by a grant that required
development be maximized — however I do not think that it ensured that the proposed development would be
safe or legal.
Although I suspected a letter of this type was going to be written from Caltrans, I did not know if it was going
to be as exacting as it is. It is an example of environmental justice for many of us who have questioned the
LUCE process and the ALUC override.
Please do not lead this City and its residents into a costly lawsuit.
It is my hope that everyone on the Council and in the ranks of City government is able to shed any animosity
and ego, and work collaboratively with the public and each other to right these wrongs now.
By revisiting the LUCE -2035 document, it will give the community a chance to find viable solutions for the
Environmental Impact Report (EIR) that was incomplete. There should not be, in a quality plan, seven Class 1
impacts, "significant and unavoidable" for future residential and commercial growth. A quality plan would not
have development that would cause air quality to deteriorate, noise to increase, traffic and circulation to worsen
and land use conflicts to be exacerbated. Current residents will not benefit - only developers will.
As the representative from the Division of Aeronautics of Caltrans illustrates, the airport overrule was ill -
conceived and illegal. The noise impacts and airport safety zones are critical to heed for current residents, future
residents and to protect the integrity of the airport in the future for passengers and pilots alike.
This development driven plan for the next 20 years should be reworked to avoid a legal action and future loss of
grants and other protections under the law.
May this letter from Deputy Attorney Raiyn Bain serve as an impetus for more analysis and a chance to explore
further strategies for smart, safe and legal growth.
