The San Luis Obispo Property and Business Owners' Associations (SLOPBOA) Position Statement
Regarding the Proposed City of San Luis Obispo's Residential Rental Inspection Ordinance

Since a majority of this city council have already approved some form of a "Residential Rental Inspection
Ordinance ",:'the San Luis Obispo Property and Business Owners' .Association now recommends the
following specific actions to be strongly considered and adopted:
1.) That any adopted new Residential Rental Inspection Ordinance replace the rather ineffective,
formerly- adopted Neighborhood Wellness Inspection program due to the lack of previous city funding and
authority to fulfill its original mission.
2.) That the overriding consideration be given to property owners and tenants' legal rights to privacy.
City staff's entry with respect to any unapproved interior unit inspections shall not be permitted without the
express written permission of the property owner and/or property manager of any residential rental property
within the City of San Luis Obispo.
3.) That city staff notify the appropriate property owner and/or property manager of a subject property no
less than 72 hours of their intent to inspect the interior of any approved residential rental property and must
receive the prior written consent of the property owner and/or property manager prior to any scheduled on-
site residential property inspection visit to that property.
4.) That a specific complaint, rather than the suspicion of any potential problem, actually be fled prior to
any city staff member's possible on -site inspection of any residential rental property within the City of San
Luis Obispo.
5.) That any on -site city staff inspections of any residential rental properties be fully documented and
made available to the property owner and/or property manager within 72 hours of any rental inspection.
6.) That any residential rental property owner and/or property manager be given a reasonable period of
tine of not less than one (1) week to correct any deemed "Emergency conditions" and not less than two (2)
weeks to correct any deemed "Non- emergency conditions" that may have existed at the time of the city
staff's initial on -site inspection for a specific type of filed complaint with the appropriate city department
prior to any pre- scheduled property re- inspection of the premises.
7.) That "uniform residential inspection policies" shall be established prior to the enactment of any final
Rental Inspection Ordinance to eliminate the perception of any "targeted" or "pre- selected" city -wide
property inspections or enforcement actions against any specific property owners and/or property managers.
8.) That the entire city council including a subcommittee of the city council review the effectiveness of
any adopted Residential Rental Inspection program on a yearly basis in order to determine how the program
is being administered in conformance with the originally adopted program goals, objectives, and stated
policies that comprise the original ordinance. Additionally, a citizens' oversight committee shall be
appointed to oversee the rental inspection process which should include a landlord, a licensed building
contractor, a certified property /casualty insurance agent, and appointed tenant representatives.
