Page 22 of Attachment 2 states the following regarding changes made to the noise ordinance in 2010: The modifications included reducing the number of allowable warnings to one every six months and to hold residential property owners responsible for repeat noise violations. The statement is incorrect. The actual number of allowable warnings was modified to one in every nine (9) months. The Municipal Code reads as follows: 9.12.110 D. Continued Violations. Once a violation of any provision of this chapter has been verified by a noise control or police officer, the owner(s) of the property where the violation occurred may be subject to administrative action or citation for allowing a subsequent violation of this chapter to occur on the property within nine months after the date of a previous violation, provided the property owner has received notification from the city of the previous violation and at least fourteen days have passed since the date the notification was mailed to the property owner(s).
