BOX 1027 SAN LUIS OBISPO, CA. 93406 -1027 Tuesday, January 3, 2012 Dear Mayor and Council Members: Reference the `SLO Happenings' brochure (front page attached). I don't know if the City is aware of the provisions of section 21204 of the California Vehicle Code but I have attached a copy. Clearly the passenger is in violation as is the operator allowing the passenger to ride where she is. To print and distribute a brochure to all residents paid for with city funds (my tax dollars) portraying this violation to other riders is tantamount to showing a vehicle being operated by someone driving and texting or drinking beer from an open container on the street. This photo must have been shot during daylight, on Higuera street and clearly sends a bad an illegal message to bicycle riders. Most of the bicycle riders showing up on the first Thursday night after farmer's market, are already in violation of many sections of the vehicle code from operating without lights or reflectors to illegal riding by passengers. Please have someone in law enforcement proof something of this nature to save embarrassment. Respectfully submitted, %may- r--- Gary owler Copies furnished: Police Department City Attorney City Administrative Officer 21204. (a) A person operating a bicycle upon a highway shall not ride other than upon or astride a permanent and regular seat attached thereto, unless the bicycle was designed by the manufacturer to be ridden without a seat. (b) An operator shall not allow a person riding as a passenger, and a person shall not ride as a passenger, on a bicycle upon a highway other than upon or astride a separate seat attached thereto. If the passenger is four years of age or younger, or weighs 40 pounds or less, the seat shall have adequate provision for retaining.the passenger in place and for protecting the passenger from the moving parts of the bicycle. T .i .. x -_ .- r_ 4/5 Andre Watts - Bunny Trail atFarmers' Market 4 Easter Egg Hunt at the Historic Jack .House & Gardens 4/7 The MET Live in HD: Massenet's Marion 4/12 -4/14 Cal Poly Open House 4/13 -5/6 Dinner with Friends 4/13 -5/12 Department of Art and Design Annual Juried Mother's Day Flower Giveaway at Farmers' Market Student Exhibition 4/14 Bettye LaVette 4/14 Cal Poly Open House Concert 4/14 Children's Day in the Plaza 4/15 Cal Poly All -State Festival Concert -Jazz Band, Youth Symphony Season Finale Symphony & Wind Orchestra 4/15 Ken Waldman &The Secret Visitors 4/21 Arbor Day 4/21 California & Montreal Guitar Trios 4/21 San Luis Obispo Blues Society Show featuring Central Coast Children's Choir Curtis Salgado 4/22 Earth Day Celebration 4/22 The MET Live in HD: Verdi's La Traviata 4/22 San Luis Obispo Marathon + Half 4/28 10th Annual Walk a Mile in her Shoes and Family Cal Poly Architecture Chumash Show Fun Fair 4/28 Bollywood Delicious 4/28 Monster Skate Park Series 4/28 -4/29 Seven Sisters Quilt Show 4/29 4th Annual WALK for Autism and Awareness Fair MAY - 5/3 Kidical Mass Family Bike Parade 5/5 SLO Symphony: Season Finale 5/5 -5/6 San Luis Obispo Home Show 5/6 Catalyst Quartet 5/6 Flavor of SLO 5/10 Mother's Day Flower Giveaway at Farmers' Market 5/12 Spring Plant Event 5/13 Mother's Day Concert at the Historic Jack 613 House & Gardens 5/13 SLO Tweed Ride 5/13 Youth Symphony Season Finale 5/17 Law Enforcement Night at Farmers' Market 5/18 Early Music Ensemble Concert — Treasures of Tudor England 5/18 Senior Graphic Design Showcase 5/19 Central Coast Children's Choir 5/19 Jazz Night Concert —Cal Poly University Jazz Band 5/20 C6te de Tolosa Velo Challenge III 5/20 Forbes Pipe Organ Recital: Paul Woodring 5/24 Public Works Night at Farmers' Market 5/25 -5/27 Cal Poly Architecture Chumash Show 5/25 -6/17 House of Blue Leaves 5/26 Cal Poly Symphony & Choirs' Spring Concert —Rule Britannia 5/29,5/31 Cal Poly RSVP XVII: Garabatos 5/31 Downtown Brown's Birthday at Farmers' Market 5/31 Inside Out JUNE - 6/1 Cal Poly Arab Music Ensemble Spring Concert 6/1 Dive -In Movie— Finding Nemo 6/2 A Musical Journey: The Vocal Arts Ensemble Prepares for Tour 6/2 Inside Out 6/2 Wind Bands' Spring Concert—Winds of Change: Music of the 21st Century 6/3 Hawkeye Herman Concert at SLO Botanical Garden 613 Martin Short 6/21 -6/24 SLO Vintners Roll out the Barrels Weekend 16 SLO HAPPENINGS Downtown SarLiri L,Cspc. 8-Ve('v Ti, w,, daY - ..
