Dear Mayor and Council Members:
Reference the `SLO Happenings' brochure (front page attached).
I don't know if the City is aware of the provisions of section 21204 of the California Vehicle Code but I have
attached a copy. Clearly the passenger is in violation as is the operator allowing the passenger to ride where she
is.
To print and distribute a brochure to all residents paid for with city funds (my tax dollars) portraying this
violation to other riders is tantamount to showing a vehicle being operated by someone driving and texting or
drinking beer from an open container on the street.
This photo must have been shot during daylight, on Higuera street and clearly sends a bad an illegal message to
bicycle riders.
Most of the bicycle riders showing up on the first Thursday night after farmer's market, are already in violation
of many sections of the vehicle code from operating without lights or reflectors to illegal riding by passengers.
Please have someone in law enforcement proof something of this nature to save embarrassment.

21204. (a) A person operating a bicycle
upon a highway shall not
ride other than upon or astride a permanent
and regular seat attached
thereto, unless the bicycle was designed by
the manufacturer to be
ridden without a seat.
(b) An operator shall not allow a person
riding as a passenger,
and a person shall not ride as a passenger,
on a bicycle upon a
highway other than upon or astride a
separate seat attached thereto.
If the passenger is four years of age or
younger, or weighs 40 pounds
or less, the seat shall have adequate
provision for retaining.the
passenger in place and for protecting the
passenger from the moving
parts of the bicycle.
