In accordance with the provisions of the Act of Congress approved March 3, 1579, ROBERT P.
PORTER, Esq., of Chicago, Ill., has been appointed the Special Agent 'of' the Census Office to have
charge of the collection of the statistics of Wealth, Debt, and Taxation of the United States.
The Special Agent thus appointed has all the authority of a census-enumerator under the act, and is
empowered to conduct in his own name the correspondence relating to this branch of the census.

Abstract and Title Bureau, Sun Luis Obispo, No 85.
The above abetract fails to show title for land not colored
yellow therein.
On October 19 1865 William. Stenner declared it liomestcad, record-
ed A.5& on land including, that part colored yellow.
This land was then prestunably community property.
There is in the description an erroneous reference, but it does
does not vitiate the certainty of the description. If so , it is
cured by the Homestead of Feb.26 1870, recorded A.105.
Gln (larch 31 1876, {gym Stenner, for $1 and love Etc, gra,hted sold
and conveyed said land. to- his wife Guadalupe, hitt she did not join
n executing; the deed...
The statute (1862) - in force in 1865 and 1870 provided that no
conveyance should be valid or effectual for any puxl)ose without
the siLmature 'and acknowledgment of the wife, and that a Homestead
could be abandoned (only) by an instrument joined in by both; and
the same substantially was . the law in 1873.
In construi.nj t1his statute, a deed by a husband to his wife of a
homestead was declared void in Graves v Raker 68 Cal .1.23.
So a deed executed by - the husband Mone, thou£;1, thn Homestead
was afterward abandoned. Gleason v Spray ail Cal .217.
But where. the Homestead was separate property of the husband, a
deed by him to his wife was declared to pass his title, without
doing awe;vy, wi t:n the Homestead. Burkett v Burkett,, 78 Cal 715.
The homestead character t1ien existbd at the death of Guadalupe
Stenner in October 1M2.
The Flon, estead ac,; of L100 provided for inheritance b;,'r children,
Yet where a husband died -after 181;2, it was held t1tat as the act
of 1:hat., year provided for absolute survivorship by the wife, no-
thing, vested in the children. Rich v Tubba 41 Cal 84.
Whether tinder act of 1862' the survivor took by descent, was not
decided Derrold. v Reen `k)' Cal 4-Ak-8.
But in Tyrrell v Baldwin 78 Cal 47'14-, it was declared (by doubt-
ful reuscni nr. ) that the late in force at time of death controll s
rizhts of sttrvi.vors; and this doctrine was repeated in Gntwell v
Seybolt 82 Cal 8
The law in October 1882 declared that a Homestead selected from
comninity property whBhld go to the survivor; but if from separate
property of the deceased, t„yen to her devisees.
And if Stenners deed to his wife made the land her separate prop-
erty under. Burkett v Burkett supra, then I think that the land-
stead must, be 'corisidexpd as selected from her separate propert-yr,
and therefore it passed to her devisees.
The deed was made for a valuable consideration, and hence ,pres-
umed to become community; but, in Viedel v Heiman, 59 Cal .1516, it
is intimated that this construction does nor obtain between hus-
band and wife. And clearly it might be shown to have been a gift.
Who #:he devisees of Guadalupe Stenner are is not clear.
It appears by the Clerk' s Register and Minutes, '.hat in re Es-
tate of Guadalupe Stenner-, a petition for -the probate of her wil..l
was filed on Sept 2.6 1884, and on Oct 14 1884 Salvador Stenner ap-
pointed adrm'r with the 1-411 annexed. Such will must necessarily
have been admitted to probate . The adm'r qualified, and inhitzknd
nskgsa ks publication of notice to creditors was ordered; that he
died, blit his accounts have not been settled, nor is there anything
to show whether any claims of creditors were presented to him.
On Nov 24 1885, Ernest Graves was appointed acbOr with thle will
annexed, and qualified, His accounts have never been settled, and
t'3,era is nothing, to shoe that he is not still acting.

The Court however makes no finding as to this, but, proceeds to
probate the grill and appoint an adm'x , as if no prier proceedings
had been had, raid from auf,;ht that appears the will now probet-ed
be an entitely different one from that probated on Oct 14 1884..

ever they may be) may be subj ectad to serious litigation. That
such devisees take subject to the adminiatrat,ion of her estate, and
hat her est,aT,e has not yet been adrni.nistered; nor has it been de-
terrainod ;rho such devisees are.
Unelar .hose ciretanstances, I cannot advise any purchase, no mat-
ter who may join in the deed. ,

THIS CONTROT; made this 2d day of July, 1900, between the
City of San Luis Obispo (a nuniainal corporation)., party of the
first part, and J. S. Damron, party of the second part9—
WITNESSI;TH: That for the consideration hereinafter named,
said J. S. Damon agrees to do the following named portion of the
sewer work of said City in accordance withpeoifications therefor
approved by the Board of Trustees of said City on March 26.9 19009
and filed in the office of the City Clerk of said City on March
1. 2$, 1900, to wit: The sewers, mane-holes, fludh tanks, ete.9 as
called for in Division 2, .of said specifications, and to furnish
all the tools and labor neoessa7, and also to furnish all necessary
material, except such as are mentioned in said speoifioations to
be furnished by said City.
For which said City agrees to pay said J. S. Damon the st=
of $19;Dq.,22.,•,..,less a discount of one cent per lineal foot of line
of sewer laid, and also agrees to pay him for lumber, work on

creek crossing and for rock cute as specified in sections 8, 198
and 24 of said specifications. Said priee to be paid as provided
for in section 26 of said specifications.
The aforesaid plans,and specifications qnd all the provisions
therein contained➢(whether or not the same are aspecificati®ns» in
the strict meaning of that team) are- made a part bf this contract.
