HomeMy WebLinkAbout03/16/1925�C9 mayor Sinsheimer advised the Council that the City could, in cooperation with Dr.Sutherland of the Cbunty Health Unit, provide for voluntary inoculation etc, with anti toxin treatment as a- preventative of diphtheria. The City to contribute ten cents ( 10 1 ) for each complete treatment. Discussion . -It was moved by C.M.Carpenter and seconded by GeoeWaKilbern that the.City.of San Luis Obispo enter into such agreement with the County Health Unit.. The motion carried. City Council met in regular session - Mayor L.F.Sinsheimer presiding. Present : W.B�Martin, C.M.Carpenter, Geo.W.Kilbern, Chas Forbes, L.F.Sinsheimer. Absent : None, The minutes of March 2nd and 9th were read and approved as corrected on motion of Chas Forbes seconded by Geo. W. Kilbern. The following applications for permit to build were granted on motion oof Geo. W. C.A.Bunds - 50 ft 5 ft park sidewalk on the west side Chorro Street between Upham and High Street. Edward T. Clarke - 45 ft 5.ft park sidewalk, curbing and gutter on the east side Garden Street between Leff and Church Street. Hans Heisel - 100 ft of 5ft park sidewalk and curbing on the south side of Pacific Street between Johnson and Essex Street. W.W.Mathews was granted permit to connect with the City Sewer on Higuera Street between marsh and Pacific Streets , on motion of Geo,W.Kilbern seconded by W.B.Mart The applications of P.Pedrizetti for licenses for Restaurant, Cigars Sideline and Soft Drinks at 895 Higuera Street were referred to the Commissioner of Public Health and Safety for investigation and report on motion of Geo.W.Kilbern seconded by Chas Forbes. Petition of Maude C. Evans for transfer of license for Lodging House ( Hotel Court ) to Mattie S. Fry was referred to the Commissioner of Public Health and Safety for investigation and report on motion of Geo. We Kilbern seconded by Chas Forbes. The report of the City Clerk for the month of February was received and ordered filed.on motion of- C.m.Carpenter seconded by W.B.Martin. 1 i 1 1 1 1 0. 1 i 1 Mayor L.F.Sinsheimer announced that this being the date set and the time fixed for hearing appeals or objections in regard to assessments on the Marsh Street ( Joint ) Paving project , that the Council was now ready to hear any such appeals -or objections. Protest was read from J.J.Hutchins et al, in which it was contended that property on the north side of Higuera Street between Essex and Johnson Street was discriminated against and in favor of property fronting on the south side of Higuera Street between Essex and... Johnson Street . That -in apportioning._- the costs and expenses to be paid by the said protestants , the said cost and expense:-is apportioned on the basis of the former center line of Higuera Street instead of on the basis of the center line of the Improvement, and that the respective assessments are therefore disproportionate Discussion. It was moved by W.B,Martin and seconded by Geo,W.Kilbern that the assessment be based on the true center lihe of the Improvement - that the protest of J.J.Hutchins et al., be sustained and that the assessment be amended to conform therewith. . -The motion- carried. T.A.Greenle:af appeared and requested , in a communication and also ve an itemized statementof the preliminary costs of the LTarsh St Paving project,. City Engineer L.W.&oore submitted an itemized statement covering such expenses and the same was ordered filed on motion of C.M.Carpenter seconded by Chas Forbes. City Engineer L.W.iloore stated to the Council that an error had been made in assessing certain property on Toro Street and also that a portion of.the intersection at Santa Rosa and Higuera Streets had been omitted and requested that he be permitted to correct the assessments and to change the assessment diagram. On motion of Chas F seconded by Geo,W.Kilbern it was ordered that the Assessment diagram be changed as outlined by the City Engineer . Motion carried. The City Attorney presented and read a Resolution relative to the approv of the Assessment for the Improvement of portions of Marsh, Higuera, Nipomo, Ida, Toro and rro Streets in the City Discussion followed but no action was taken on first reading The applications for the regular quarterly licenses were presented and re referred to the Commissioner of Public Health and Safety for investigation and'report on motion of W.S. Martin seconded by Chas Forbes. Application of Jack Nicholas for license for Palmistry was ordered denied en motion of W.B.Idartin seconded by Chas Forbes. The application of Foster & Kleiser Co for permit to place an advertising board on Lot one Block one Imperial Addition was granted on motion of W.B.Martin - conded by Chas Forbes. Ordinance No. 110 ( New Series ) , An Ordinance calling an election , onsolidated with the general municipal election and submitting to the qualified electors the City of San Luis Obispo the proposition of- incurring a debt and Bonding said City introduced and passed to print on motion of W.B.Martin seconded by Geo.W.Kilbern by following vote: s : W.B.Martin, C.M.Carpenter, Geo,W.Kilbern, Chas Forbes, L.F.Sinsheimer. oes : None. bsent : None, The matter of the Election Proclamation - giving notice that a general cipal election and consolidated bond election shall be held in the City of San Luis Obi n Monday, the 6th day of April, 1925 , for the purpose of electing certain officers as set orth in said proclamation , was'passed. and adopted on motion of C.M,Carpenter seconded by .B.Martin by the following vote: yes: W.B.Martin, C.M.Carpenter, Geo.W.Kilbern, Chas Forbes, L.F.Sinsheimer oes None. b.sent : None. f The matter of the Assessment and diagram for the .paving of Marsh Street and other Streets was again taken up. Discussion. Y'J.B.Martin presided and Mayor L.F.Sinsheimer made the following motion That the assessment as presented be adjusted to the end that, that property on Marsh Street between Santa Rosa Street and Nipomo Street bear a greater proportion of the front footage cost than that portion of the property between Santa Rosa Street and Ida Street, and between Nipomo Street and the junction with Higuera Street , and that other inequalities on all streets affected be adjusted in accordance with benefits derived from the work. The motion was lost for the lack of a second. Resolution No. 177 ( New Series ), Approving the Assessment for the Imp of Portions of Marsh, Higuera, Nipomo, Ida , Toro and Morro Streets in the City of San Luis Obispo was adopted on motion of C.M.Carpenter seconded by Geo.W.Kilbern by the foll vote: Ayes : W.B. Martin, C.M.Carpenter, Geo,W.Kilbern, Chas Forbes , L.F.Sinsheimer. Noes : None. Absent : None.. On motion of Chas Forbes seconded by C.M.Carpenter the meeting adjourned at 1:05 o'clock A.M., Tuesday , March 17th to Wednesday, March 18th at 7 :30 o'cloc$ P.M. City Clerk N 0 T E: On Higuera Street between Johnson and Essex Streets the existing curb on the southerly side is 12 ft from the property line , while on the northerly side it is 10 ft from the property line. This being the case, the distance from the existing curb line on the southerly side of the street to the true center line of the street is 2 ft, less than that.to the existing curb line on the northerly side. In making up the assessment for the paving work just completed, the quantities were figured on each side of the true center line of the street, which would have compelled the i:.. property.ewnvrs on northerly side to pay for a strip of pavement 2 ft greater in width the property owners on the southerly side. The Council sustained a protest of several property owners.which requested that the assessment be changed to equally divide the cost of the paving, and ordered the change made. This change effected the assessment numbers from 407 to 429 inclusive. . The Council also agthor-ized the Supt. -of Streets to correc the assessment diagram and assessment, where an error was discovered of the frontage on Toro Street of assessment numbers 450 and 487. This change effected assessment numbers 490 to 494 inclusive and -477 to 487 inclusive. -- C 1 1 1 1 11
