City Hall, Monday, February 5, 1940 - 7:30 i. M.
City Council met in regular session - Mayor F. C. Kimball presiding.
Present: W.H.Brazil, R. P. Howell, Ralph C. Kennedy, F. C. Kimball, Joseph Leary
Absent: None
The Minutes of January 15th and 22nd were read and approved as read.
The following applications for permit to build were granted on motion of R. P.
Howell, seconded by Ralph C. Kennedy:

The application of E. D. Ward for permit to raze certain structures and fence
at the-rear of the Old Masonic Hall Building in Block 100 was referred to the Commissi
of Public Vlorks, with power to act and report back to the Council.
Application of Edith R. Estes for license for Restaurant at 861 Palm Street was
referred to the Commissioner of Public Health and Safety for investigation and report to
the Council.
Petition of Loretta A. I:iulholland for transfer of license for Restaurant at 1020
Morro Street to Paul Perrot was referred to the Commissioner of "Public Health and Safety
for investigation and report to the Council on motion duly seconded and carried.
The application of Neon SRles and Service, by E. M. Andrez, for permit to hang
a vertical neon sign for.Sears Roebuck & Co. at 879 Hi €uera Street v;as referred, on moti
of R. t. Holr;ell, seconded by W. H. Brazil, to the Commissioner of Public Health and Safet
for investigation and report.
Application of San Joaquin Power Division, Pacific Gas and Electric Co. No. 263
for permit to replace an existing pole on Mill Street at Johnson Ave. was referred to
Commissioner of lublic 1.7or}cs, with power to act, on motion of fi. E. Brazil, seconded by
Joseph Leary.

No. 964 for permit to replace an.;existing pole on - Pacific'Street at Osos Street and, also

Reports of the City Collector, Police Judge and 'hound Master for the month of
January 1940 ! ^;ere received and ordered placed on file, on motion duly seconded and
carried.
On motion of Ralph C. Kennedy, seconded by R. P. Howell, it was ordered that the
Policy with the State Compensation Insurance Fund covering city employees be rene:,aed
as of February 7, 1940. City Clerk was authorized to draw warrant in the amount of
$.250.00 for the deposit premium on renewal.
The petition of Mrs. R. N. Umbertis requesting the Council to extend water main,
and sewer main for a distance of approximately 100 feet in a southerly direction from
Buchon Street on Fairview Street was referred to the Commissioner of Public .;forks for
investigation and report to the Council, on motion of Ralph C. Kennedy, seconded by
Joseph'Learv.

Communication from the California Mission Trails Association Ltd. received
and ordered placed on file.
Communication received from N. S. Lewin relative to coverage condition under
Policy AL - 214227 covering Public Liability and Property Damage on Automobile Fleet:
ISZatter discussed, and it was moved by R. P. Howell, seconded by W. H. Brazil that the
matter be referred to the Comr-tissioner of Finance and Revenue for checking as to the
coverage of new equipment purchased or of old equipment deleted.

Communication received from J. G. Jones et al relative to parking of automobile
on Marsh Street between Broad and Nipomo Streets. Matter referred to the Commissioner of
Public Health and Safety for investigation and report back to the Council.
Claims against the City for the month of January were ordered paid on motion
of Ralph C. Kennedy, seconded by V1. H. Brazil, subject to the approval of the heads of
the respective departments and the Mayor.
This being the time and place fixed by the Council as per published notice
dated January 22, 1940 for receiving Bids for the disposal'of garbage and rubbish in
the City of San Luis Obispo, the following is a list of all Bids received, which were
publicly opened and read:
San Luis Garbage Co. by 0. Navoni et al
Total bid of $1500.00 per year - certified check of $1000.00 accompanied bid.
E. D. Ward
Total bid of $1800.00 per year - certified check of .'$1000.00 accompanied bid.
Matterdiscussed and on motion of R. P. Howell, seconded by Ralph C. Kennedy it was ordered
that the above bids be taken under advisement until the next meeting of the Council,
Tuesday, February 13, 1940.
C. A. Younglove appeared and made a verbal complaint regarding a certain alleg
nuisance at the top of the building occupied by Bay's Store at the corner of Broad and 14Iar
Streets. Matter discussed and referred to the Commissioner of Public Works and the City
Engineer for investigation and report to the Council.
The application of A. Lemos for license for Restaurdnt at 887 Palm Street was
granted on motion of W. H. Brazil, seconded by R. P. Howell.
Re: Notification of J. E. Barrett, Tax Collector, San Luis Obispo County, State
of California, relative to Notice of Sale of Property deeded to the State for delinquent
taxes, involving five::•pieces of property located in the City of San Luis Obispo: Matter
discussed and continued to the next meeting of the Council.
The City Attorney presented an:: Agreement and Resolution providing for the
execution of an Agreement between the City of San Luis Obispo and the Southern Pacific
Company, a corporation, relating to the furnishing of water to said corporation: Matter
discussed and left over for.one week. Resolution to be left on file with the City Clerk.
The City Attorney called the attention of the City Council to the fact that _
certain county taxes should be cancelled against property acquired by the City of San Luis
Obispo since March 1, 1939, which property is the following:
Lot 15, Block 16, Anholm Addition
Lots 18 & 19, Block 186 Ingleside Homestead Tract
Lot 15, Block 19, Buena Vista Addition
It was moved by Ralph C. Kennedy, seconded by Joseph Leary that the City Clerk be authoriz
to file a petition with the Board of Supervisors of the County of San Luis Obispo for the
cancellation of all county taxes on such property. iV'lotion carried.
Chief of.kclice, Don W. narks, filed the Monthly Crime Report for the month
of January, 1940.
On motion of Ralph C. Kennedy, seconded by R. P. Howell the meeting adjourned
to Tuesday, February 13, 1940 at 7:30 o'clock P. M.
