City Hall, Monday, June 3, 1940 - 7:30 P. M.
City Council met in regular session - Mayor F. C. Kimball presiding.
Present: W.H.Brazil, R.P. Howell, Ralph C. Kennedy, F. C. Kimball, Joseph Leary
Absent: None
The minutes of May 20th and 27th were read and approved as read.
The following application for permit to build was granted on motion of
R. F. Howell, seconded by W. H. Brazil:
Christine Hoerntlein - Residence and Garage, part of Lots 9, 10, 11
Block 3, Fixlini Tract, Cost 6000.00
The applications of Elmer A. Forbes for permit to build two residences in
Block 82, Isabel Tract, also to change the position of a house on the same property,.
were referred to the Commissioner of Public Works, with power to act, on motion of VI. H.
Brazil, seconded by Ralph C. Kennedy,
The Merchandising Bond of Helen M. Howard, dba "Knit Well Shop " with the
Fidelity and Casualty Co. of New. York as surety was received and on motion of Ralph C.
Kennedy seconded by W. H. Brazil the surety was accepted, bond approved and license
ordered granted.
The application of Ronald C. Thomas for license for Cigars Sideline at 796
Higuere. Street referred to the Commissioner of Public Health and Safety for investigation
and report to the Council, on .notion duly seconded and carried.
The petition of Ellsworth & '11arnken for permit to move a metal electrically
lighted sign from1114 Garden Street to 1021 Broad Street was referred to the Commissioner
of Public Health and Safety for investigation and report, on motion of R. P. Howell,
seconded by W. H. Brazil.
The report of the City Collector and the Pound Master for the month of May
was received and ordered placed on file.
Re: request of Ben Erickson of the Salvation Army, for continuance of con-
tributions by_the Council for the feeding of transients; the matter was discussed and
it was moved by R. P. Howell, seconded by Ralph C. Kennedy that the City Clerk be direc
to draw a warrant ih the amount of $25.00 for one more month's contribution covering the
month of June , 1940. Motion carried.
The crime report of the Chief of Police for the month of May was received
and ordered placed on file.
A communication from Harold J. Anderson, Post 1766, Veterans of Foreign Wars
of the U.S., by Joseph F. Escobar, Post Commander, relative to a Resolution adopted by
that body opposing the use of all publicly owned buildings by the ;'lar Veterans Division
of Labors Non - Partisan League or any other Unamerican organization was received and orderei

placed on file on motion duly seconded and carried.
Resolution No. 508 (New Series) - A Resolution of the City Council of the
City of San Luis Obispo adopting budget and approving first supplemental Memorandum of
Agreement for expenditure of 1/4 cent gas tax allocated for streets of Major Importance
was adopted on motion of R. P. Howell, seconded by W. H. Brazil by the following vote:
Ayes: 'N.H. Brazil, R. P. Howell, Ralph C. Kennedy, F. C. Kimball, Joseph Leary
Noes: None
Absent: None
This being the time and place fixed by the Council for receiving sealed bids
as per published notice for 3780 feet of 4" cast iron water pipe, 9 units of cast iron
tees and 2 units of cast iron crosses, bids to be received up to 7:30 o'clock P. M.
June 3rd, 1940, the following is a list of the bidders submitting bids:
U. S. Pipe and Foundry Co., Los Angeles, California
American Cast Iron Pipe Co.,
Pacific States Cast Iron Pipe Co.
It appearing that the bid of the U. S. Pipe and Foundry Co. was the lowest and best bid
of all bids received, it was moved by Ralph C. Kennedy, seconded by W. H. Brazil that the
bid.of the U. S. Pipe and Foundry Co. be accepted, provided that bond be furnished with
said bid. Iviotion carried. On motion duly seconded and carried it was ordered that the
unsuccessful bidders' bonds be returned.
On motion of Ralph C. Kennedy, seconded by V1. H. Brazil, claims against the
City for the month of May were ordered paid subject to the approval of the heads of the
respective departments and the Mayor.
Resolution No. 509 (New Series) - A Resolution Referring to the Military
Defense of the Central Coast Section of California was passed and adopted on motion of
R. P. Howell, seconded by W. H. Brazil by the following vote:
Ayes: W.H.Brazil, R. P. Howell, Ralph C. Kennedy, F. C.. Kimball
Noes: Joseph Leary
Absent: None
Resolution No. 510 (New Series) - A Resolution referring to the establish-
ment of Military Training Courses at California rolytechnic School and San Luis Obispo
High School was passed and adopted on motion of R. P. Howell, seconded by W. H.Brazil
by the following vote:
Ayes: 111. H. Brazil, R. P. Howell, Ralph C. Kennedy, F. C. Kimball
Noes: Joseph Leary
Absent: None
The City Engineer reported on tests of material for construction of Reservoir
No. 3. The Council directed the Engineer to secure further test on fine aggregate and
bids ordered held under advisement until such test is received.
On motion of VJ. H. Brazil seconded by R. P. Howell the following applications
for permit to hang signs were granted with the provision that work be done under the su-
pervision of the City Engineer and in accordance with ordinance:
Neon Sales & Service - Neon sign for Forden's Hardware, 1023 Chorro Street
Neon Sales & Service - Neon sign for Thomas Motor Co., 1255 Monterey Street
Ordinance No. 215 ( New Series) - An Ordinance establishing a Public Re-
creation Commission providing for the appointment of a board of recreation commissioners
and fixing the powers, duties and team of office of such commissioners was introduced and
passed to print on motion of Ralph.C. Kennedy, seconded by W. H. Brazil by the followiing
vote:
