The Council acting as a canvassing board, now proceeded to canvass and count
the Absentee Ballots for The General Municipal Election and Consolidated Charter Amendment
Election of April, 7, 1941.
Following is a tabulation of the result of the Official Canvass of 79 -

Mr. Fred L. Gist, a candidate for the office of Councilman, at the recent
election, called the attention 3f the Council to an apparent error appearing in the
canvass of the votes previously made by the Council. The Council then proceeded to check
the tally lists from the various precincts, and, upon doing so, the following errors
appeared:
In Precinct No. 1 ( City) the tally list and certification from the Election
Officers showed a total vote of 185 for Councilman Joseph Leery, whereas the check marks
indicated a total vote of 135 only.

72 In Precinct No. 4 (City) the tally list and certification from the Election Officer
showed a total vote of 117 for Fred L. Gist, whereas the check marks indicated a total of
116 only.
In Precinct No. 4 ( City) the tally list and certification from the Election Office
showed a total vote of 81 for Edmond dilliams, oshereas the check marks indicate a total vot
of 61 only.
Upon motion of Ralph C. Kennedy, seconded by `N. H. Brazil and duly carried, the Cit
Clerk was directed to correct such errors in the.final tabulation and canvass of votes cast
at the election.

It was movedby W. H. Brazil, seconded by Ralph C. Kennedy and carried, that
F: C. Kimball, having received the highest number of votes cast f.or Mayor at the General
w;unicipal and Charter Amendment Election held on the 7th day of April, 1941, be and he
is declared elected Mayor for the full team of tv,o years, as prescribed by law; that R.P.
.Howell.and Joseph Leary,;being the two persons receiving the highest number of votes cast
for Councilmen, were, and each of them was declared elected Councilmen for the full term
of four years, as prescribed by law; that A. V. Muller and A.A. Thiebaud being the two
persons receiving the highest number of votes cast for School Directors, were and each of
them was declared elected school directors, for the full term of four years, as prescribed
by law. City Clerk directed to issue Certificates of Election to the successful candidate:
Resolution No. 569 (New Series) - A Resolution declaring and finding that five
proposals amending, the charter of the City* of San Luis Obispo submitted to the qualified
voters of said City on April 7, 1941, received the vote of a majority of all the voters
voting on such propositions, and that one proposition amending said charter failed to
receive the vote of a majority.of all the.voters voting on such propositions, was intro-
duced and adopted, on motion of R. P. Howell, seconded.by W. H. Brazil by the following
vote :

The application of Boriack Bros. to break curb and ramp sidewalk for a distance
of 14 ft. on the south side of Murray Ave. between Chorro and Santa Rosa Streets, Mt.
Pleasanton Square, was referred to the Commissioner of Public 4orks, with power to act, on
motion of W. H. Brazil, seconded by R. P. Howell.
The application of A. F. Schleim to connect with sewer on Grove St. between
Peach and Mill Streets was referred to the Commissioner of Public Works, with power to act,
on motion of Joseph Leary, seconded by W. H. Brazil.
The application of Joe Perry for registration as a Class "D" Contractor, to-
gether with the Great American Indemnity Co. bond in the amount of 41000.00, and regis-
tration fee of $25.00 received, and on motion of Ralph C. Kennedy;. seconded by R. F.Howell,
the surety was accepted, bond approved and registration granted.
Petition from H. J. Dubin for permit to hang wooden sign over his property line
was granted on motion of W. H. Brazil, seconded by R. P. Howell, with the provision that w
be done under the supervision of the City Engineer and in accordance with ordinance.
The reports of the Police Department and the Police Judge for the month of
March, 1941 were received and ordered placed on file.
Communication received from the National Resources Planning Board, by B. M.
Woods, Regional Chairman; inviting the uIayor to attend a meeting of the California Central
Valley- Central Coast Drainage Basin Committee to be held on Thursday, April 17, 19419
and on motion of Ralph C. Kennedy, seconded by W. H. Brazil, the Mayor was requested to
attend the meeting. Motion carried.
Application receivedfrom George Lewis for position as Building Inspector for the
City of San Luis Obispo, and on motion duly seconded and carried it was ordered filed.
Communication received from the San Luis Obispo Livestock Assn. by S. J. Lowe,
under date of April 11, 1941 inquiring about property belonging to the City of San Luis
Obisc:o wishing to purchase a portion of this land as a site for a slaughter house. Matter
discussed and on motion of W. H. Brazil, seconded by Ralph C. Kennedy the-matter was.held
over until the neat meeting of the Council.
The matter of the petition of Maddalena U. S. Service et al requesting parking
regulations on Higuera St. between Osos and Santa Rosa Streets was read and on motion of.
14. H. Brazil, seconded by:R. t'. Howell the City tittorney was instructed to draw up an
Ordinance regulating Parking ( 1 hour time limit ) on Higuera Street between Osos and Santa
Rosa Streets. Motion carried.
Communication received from the Maryland Casualty Co. desiring the cancellation•
of the bond in the amount of $7500.00 carried on behalf of Callie M. John, be signed by
the Mayor, and on motion of Ralph C. Kennedy, seconded by-W. H. Brazil, the Mayor was in-
structed to sign. Motion carried.
Communication received from the Goldtree Investment Co. dated April 14, 1941
requesting the City of San Luis Obispo to extend the city water line along Johnson Ave. to
the City Limits line, and in consideration would offer as a gift to the City of San Luis
Obispo, attract of land consisting of four acres, located on the west side of Johnson Ave.,
.the exact site to be selected by the City Council. The u'layor appointed CoaLissioners
1ph•'G.Kennedy,R. P. Howell, and Joseph Leary as a Committee, Commissioner Howell to act as
Chairman and confer with Mr. Goldtree and report to the Council.

This being the time and place fixed by the Council for receiving sealed bids
as per published notice dated March 3, 1941, for aBus Franchise, bids to be received up
to 7:30 o'clock P. PA. April 14, 1941, the bid of John G. Jones , ( check in the amount of
$200.00 accompanying said bid) was the only bid received and on motion of !V. H.Brazil,
seconded by R. P. Howell, the franchise was awarded to John G. Jonesp Moticn carried.
Ordinance No. 224 (New Series) - An Ordinance granting to John q. Jones
a Franchise to establish, and, for a period commencing with the effective date of this
ordinance and continuing for a period of twenty years thereafter, to conduct, maintain
and operate, on regular schedule:::, intra- municipal motor bus lines for the transportation
of passengers and their hand baggage, for hire, wholly within the City of San Luis Obispo,
over,upon and along the streets, highways, alleys, boulevards, avenues, roads and other
public places hereinafter prescribed; fixing the compensation to be paid to the city of
San Luis Obispo and specifying the terms and conditions of said franchise, was introduced
and passed to print on motion of R. P. Howell, seconded by W. H. Brazil by the following vo
