City Hall, Monday January 17, 1955- 7:30 P -M,
The City Council met in regular session; Mayor Fred H. Lucksinger presiding.
Present: Nels Beck, Paul W.Davis, 'rJarren G.Edwards,- Kenneth V4. Jones, Fred H. Lucksinger
Absent: None
The minutes of the meeting of January 3, 1955 were approved as corrected.
Claims against the City for the month of January, 1955 were ordered paid subject
to the approval of the heads of the respective departments and the Mayor.
On motion of Kenneth W. Jones, seconded by Nels Beck, the Official Bond of BJarren
G. Edwards was approved.
Ordinance No. 409 (New Series)-wt=
An Ordinance regulating Public ivieetings on
streets and sidewalks of the City of San Luis Obispo, providing for the issuing of
permits and revocations for the same, and providing penalties for the violation of its
provisions was finally passed on motion of Kenneth W. Jones, seconded by Nels Beck upon
the following roll call vote:

The Citv Clerk reported on bids received and opened on CEDIENT LINING for approxi-
mately 4000' of 14" Steel Pipe -- one bid received from,

On recommendation of Price Thompson, Water Supt. and on motion of Kenneth W. Jones, .
seconded by Warren G.Edwards, the Bid was awarded to Pipe L;.ning, Inc. in the amount of

The City Clerk reported on the following bids received and opened for CHLORINE

By corrmon consent of the Council, the bids were held over until the next meeting and
Mr. Kenneth 'W.Jones and I1Ir. Price Thompson were requested to study the bids and report
their recommendations to the Council, for the awarding of the bid.
At this time the City Council held a PUBLIC HEARING on the Proposed "Off- Street
Parking Requirements in the Proposed Zoning Ordinance for certain areas.
14r. `timothy I. O'Reilly appeared before the Council on behalf of a group of
citizens re;;uesting that the Council NOT adopt the amendment to the Zoning Ordinance
requiring the provisions of the "Off- Street Parking" zone. Mr. O'Reilly further stated.
that the proposed "H" zone was discriminatory to the owners of property in the proposed
C -2 -H zone. , ?r. O'Reilly then read a petition , setting; forth objections to the
proposed "Off- Street Parking" zobe. Mr. O'Reilly requested that in fairness to all
property owners this off - street requirement be dropped.
i'�r. Ernest Volmer appeared before the Council protesting the off - street" parking
requirements on the basis of the division of the C -2 zone where the down -town area
is excluded from parking requirements, but that C -2 area surrounding the down -town
business district is required to provide parking. Mr. Vollmer stated that the same
provisions regarding parking should apply in all the C -2 zones.

I +Ir. Lester Graves, 1100 Marsh Street, read a letter signed by nine property owners on
the east side of Marsh Street between Santa Rosa and Toro Streets. The letter requested
that the 11H11 zone requirement NOT be required for this block due to the shallow depth of
the lots backing into the San Luis Creek.
Mrs. John Boriack asked why does not private enterprise be given some inducement to
open and operate parking lots inthe down -town area as a "money making operation "?
She stated that if substantial tax relief was given propertyowners, possibly some of
them would invest in parking lots.
Mr. H.T.Franklin asked Mr. Wise, Planning Consultant, if it was not true that all
cities proposing "H11 zone in their zoning ordinance, only use it in new ar >as that were
developing commercial properties? Mr. V..ise stated that in general this was true.
i;ir.:1ise also stated that he did not agree with the areas designated as 11H11 zone in the
proposed ordinance. Mr. Wise went on to relate that the normal procedure is to place

the 11H11 zone requirements in the zoning ordinance but not make it operative until new
areas are developed. The second step is then to form a SPECIAL PARKING ASSESSMENT
DISTRICT for development of adequate parking in building; up areas. Said district to
be paid from revenues of the parking meters.
Mr. Cheda asked clarification on the requirements for parkin;,, on the fringe areas
and between the C -2 zone and C -2 -H zone. He also asked if it were not true that city
owned parking lots are q source of revenue to the City, while an owner of a private
parking lot has no source of revenue other than possibly attracting business to the
vicinity of the lot which is private, and the owner was required to pay taxes, license
fees etc.
Mr. Frank Funk reported on the trip he took in company with Mr. Richard Miller and

i-ir. Herbert Franklin to study "off-street parking" requirements in several cities in the
Bay area and on the peninsula. He went into some detail as to the methods used in the
various cities visited for parking. Mr. Funk also stated that due to narrow lots
and shallow lots in C -2 area of this city, that a division between two areas regarding
the 11H11 zone will be very difficult to plan but he recommended that a Special Assessment
District of the entire C -2 zone be made and that the revenue from the parking meters
pay off the special assessment.
Mr. Hewson of the Andrews Hotel wanted to know where they stood in this proposed
zoning as their property is outside the C -2 area and irproposed C -2 -H zone.. Mr. 6Jise
answered his question, stating that existing facilities would not be required to conform
to any change in zoning.
Mr. Ernie Hemen asked clarification as to the north boundary of the proposed C -2 -H
'
zone, and he asked if he would be required to hold one lot for parking for each lot that
he constructed a commercial building on.
Mr. Miles Fitzgerald stated that he believed the provisions of the proposed 11H" zone
is confiscatory on the portion of the land used for parking. Mr. Fitzgerald suggested

that allproperty zoned C -2 should be required to have the same parking requirements.
He further stated that all narking lots should be publicly owned and paid for by all
property owners in the city and should be .financed by all property owners in the city
and suggested that additional taxes should be levied on the business district and also
a small addition of taxes to residential properties to pay for the acquisition and
maintenance of these lots.

Mr. O'Reilly then presented a .petition requesting no action on the "H" zone.
Mr. George Couper, Chairman of the City PlanningCommission stated that t-he
recommendation that the proposed 'TH" zone be added to the new zoning ordinance was con-
sidered only by the Planning Commission at the request of the City Council.
Mayor Lucksinger stated that allrequests and questions of the public regarding the
'TH" zone would be considered by the Council before a decision was made.
i11r. Bob Leitcher stated that he purchased property in the C -2 zone in the last
years,- said property purchased under provisions of the existing zoning ordinance
which was C -2. He stated it would be an imposition if he had to comply with any new or
stricter requirements which would alter the use of his property. He also asked, why does
t the city use the parking meter money to buy parking lots?
i'.'ir. Frank Funk stated that the City of Redwood set up a Special Assessment District
for parking lots,using Revenue bonds to pay off this Special Assessment-- said revenue
bonds to be paid off by the parking meter revenue in the lots and 2/3 of the street side
parking meters.
On motion of Kenneth W.Jones, seconded by Warren Edwards, it was moved that the
"H" zone requirements be taken under advisement and study by the Council. Motion carried.
At this time the City Council asked if there were any questions other than the
parking requirements on the zoning ordinance. Mr. Cheda asked what was the procedure for
"Use Permits" and why were they required for certain types of business. Mr. 1iise stated
that the reason for "Use Permits" was to control certain types of business within; specific
zones which set up certain hazards to health and safety. By use of the "Use. Permit" the
Planning Commission: would actually allow non - conforming uses but control any obnoxious
construction.
Mr. Gailbraith of Foster and Kleiser Co. asked for relief of the "Use Permit" for
signboard advertising inthe C -2 and R -3 zones.
It was moved by Kenneth W. Jones, seconded by Nels Beck, that the-Zoning Ordinance
s recommended to the City Council by the Planning Commission, excluding the requirements
f the "H" zone be passed to print on the following roll call vote:

At this time Iviaria Rosa appeared before the Council stating that she purchased a
outside the City of San Luis Obispo on south Broad Street and moved the house from
city to this lot, but upon applying for water service she was notified that she could
t hook in the city water system due to POLICY set up by the Council for several years,
t allowing new services, extensions of services or enlargement of present services
tside of the City of San Luis Obispo.
On motion of Kenneth V,'.Jones, seconded by Nels Beck, Bulletin of Instruction No. 15
Hi:NGE ORDER no.-8 on the San Luis Obispo Library Building was approved. Motion carried.
Resolution No. 1403 (New Series) - A Resolution increasing the 1954 -55 Budget
( Animal Shelter) was passed and adopted on motion of Kenneth W.Jones, seconded by Nels

The claim. of Carolyn Moore against the City of San Luis Obispo for injuries
was referred to the Insurance Carrier, Farmers, Insurance Group for disposition, on motion
of Kenneth W.Jones, seconded by Nels Beck.
Communicationfrom Morro Road Apts. by Frank Sousa, I,Igr. , Re: request for
street lights on Boysen Ave. was held over.
On motion of Kenneth W.Jones,, seconded by Paul W. Davis, Homer Hamlin, City
Engineer, was asked to contact the Pacific Gas and Electric Co. and advise them to make
a study of the unlighted areas in the City of San Luis Obispo, particularly, the tracts
and subdivisions where no lighting was provided and to give a report to the Council of
their recommendations.
The request of the S.L.O City Firemen's Assn. to hold a dance on Feb. 52 1955
at the Veterans Memorial Bldg. was granted on motion (of Nels Beck, seconded by Kenneth
W. Jones.
Communication from the Mission Mothers Club Re: survey of conditions relative
to the loading and discharging of children at A'issior:School was referred to the Traffic
Committee forinvestigation and report to the Council on motion of Paul V,'.Davis,
seconded by Peels Beck.
The request of Dr. Albert Gazin for permission to erect a Medical Building
at 729 Pismo St.was granted on motion of Kenneth W.Jones, seconded by Varren G. Edwards.
Communication from Anita Hathway relative to opening a Thrift Shop at 1224
N,Iorro Street, the request was granted,- the business license fee waived but they must
pay sales tax on all items sold.
The communication from the Farmers Ins. Group relative to accident at the
corner of Santa Rosa and Marsh Streets was referred to the Traffic Committee for study
at the proper time or when the Highway relinquishes Marsh Street to the City of San Luis
Obispo for traffic control on motion of Kenneth W.Jones, seconded by Nels Beck.
The request of the Young Farmers and Young Homemakers for permission to use
exempt parking meter stickers during conference, Fbbruary 3,4, and 5th was granted, subject
to the approval of the Chief of Police on motion of Kenneth W.Jones, seconded by Nels Beck.
The'communication regarding Policy on delinquent water accounts was held over
for study and was referred to Paul W. Davis and Warren G.Edwards for study and report
recommendations to the Council.
Copy of the Minutes of the Planning Commission were ordered received and filed.
The transfer of the Tick Tock Cafe at 1057 Monterey St. from Frank D. Dunne
to James L. Wolfe and Jerrel E.King was granted on motion of Paul W.Davis, seconded by
Kenneth W.Jones.
The transfer of licensa of Bob's Union Service Station from Robert R. Fester
to Albert W. Caldwell at 339 Marsh St. was granted on motion of Paul '�v.Davis, seconded
by Kenneth W.Jones.

Re: Report of the Traffic Committee meeting regarding installation c:f Stop Signs on

The City Attorney reported that after investigation of precedent law, he re-
commended that all the bids received for the Library furniture be accepted by the City and
that the City take the bids most advantageous to the City.
On motion of Kenneth W.Jones, seconded by Warren G. Edwards, it was moved that the
re comm endat ions of the Purchasing Agent, Kenneth W.Jones and the Executive Secretary to
the Council, Richard Miller regarding the bids for the Library furniture be accepted, and
that bids be awarded as recommended.
Re: The Proposal for an aerial survey for south area of San Luis Obispo was held over.
Re: Communication from Pars. Delwyn Roberts regarding Chorro St. was again held over.
