SPECIAL MEETING - APRIL 14, 195$
7:30 P.M. - CITY HALL
The City Council met in special called meeting with Mayor Fred H. Lucksinger presiding.
Roll Call: Present - Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith,
Fred H. Lucksinger
Absent: - None
1. The City Council considered the approval of the final map. of College Highlands #2,
Tract no. 124 as recommended by the City Planning Commission.
On motion of Kenneth W. Jones, seconded by Richard G. Sleight, the final map of Tract
No. 124 was approved subject to the filing of the necessary bonds completing the
subdivision agreement, filing of the inspection fees, and the City Engineer's
approval of construction plans. Further the tract was approved subject to the in-
stallation of chain link fence along. the drainage ditches and creeks as required.
Richard D. Miller, Administrative Officer, asked the Council in connection with the
approval of Tract No. 124 whether the subdivision should be approved subjected to
contribution by the subdivider to enlarging of-sewer mains outside the boundaries
of the subdivision. By common consent of the Council the final map of Tract No.124
was approved without reference to sewer enlargements.at this time. Mr. Morgan
Flagg, subdivider, agreed that it could be open to negotiation if necessary.
David F. Romero, City Engineer, asked the City Council to specifically approve Tract
No. 124 with open drainage as apposed to minor drainage being placed underground
as Mr. Romero wanted the minutes to show that the open drainage was approved over
his strong objection and he wished no future blame for failures if any, in the
drainage ditches in this new tract.
Mayor Lucksinger stated that future subdivisions must consider placing minor drainage
in underground conduit, but that no precedent is being set in the case of the final
map of Tract No. 124 as the plans on this tract were submitted prior to Mr. Romero'
new requirement regarding the placing of minor drainage underground.
2. Consideration by the Council of the request of David F. Romero, City Engineer, regard-
ing the placing of minor drainage underground in new subdivisions. Council Commit-
tee composed of Councilmen Beck and Sleight were appointed to study the matter of
the requirement of placing minor drainage underground.
Council Committee composed of Councilmen Jones. and Smith were appointed to study the
matter of enlarging the sewer mains on Cuesta and Tassajara between Foothill and
Cerro Romauldo and to determine contribution if any.
3. Introduction of Ordinance No. 7$ (1 958 Series .. An Ordinance of Intention to Abandon
a portion of Tenable Street was .introduced and passed to print on motion of Nels
Beck, seconded by J. Barry Smith, on the following roll call vote:

4.. Communication from the Gold Bond Stamp Company notifying the City of San Luis Obispo
of their desire to terminate their lease of City -owned property on Broad Street
effective May 10, 1958.
Councilmen Jones and Smith were appointed as a committee to study the matter of the
leasing of this building and whether the best interests of the City would be to
demolish the building and enlarge parking lot #2 or to retain the building and try
to get a new tenant:
5. The matter of the claim for damages against the City on behalf of Mary Rosa, 1015
Ella Street for alleged personal injuries was referred to the insurance carrier.
Mr. A. M. Rhodes, 524 Felton Way, appeared before the Council protesting the methods used
by the City enforcing drainage on adjoining property through his property which re-
quires him to do extra work in keeping mud, silt, etc. from flooding over his property
and his neighbor's property. Mr. Rhodes would like some relief from the City. David
F. Romero,.City Engineer, stated he understood the problem and that the City was aware
of same.
Mr. Robert Rodin, property owner from the Nelson Tract appeared before the City Council
asking relief from the City from a drainage problem adjoining his property in the Nel-
son Tract. A Drainage ditch installed by the subdivider which is now used as a gar-
bage dump and a mosquito breeding place and a hazard to the lives and safety of small
children. Mr. Rodin and a group of his neighbors with him would like the City to p
place this drainage in an underground concrete pipe. The drainage ditch lies in and
between lots 6, 7, $, of Block E, and lots 1, 2, 71, 72, of block F, all in Tract 176.
Mr. Francis Muller agreed with Mr. Rodin's request for placing drainage underground for
safety sake.
There being no further business, the special called meeting was adjourned on motion of J.
Barry Smith, seconded by Kennett-, W. Jones.
