CITY HALL
The City Council met in adjourned session with Mayor Fred H. Luc ksinger
presiding.
Roll Call: Present - Ne.ls Beck, Kenneth W..Jones, Richard G. Sleight,
J. Barry Smith, Fred H. Lucksinger .
Absent - None
The City Clerk presented for the Council's consideration the one bid re-
ceived for construction of improvements for the ALRITA STREET SPECIAL
ASS ESSMENT- IIISTRICT:
1. MADONNA CONSTRUCTION COMPANY

Mr. Romero, City Engineer, explained for the Council and interested
parties the various features of the bid as received from Madonna
Construction Company.
Mr. Harold Blake, Special Assessment Attorney, reviewed for the Council
and interested parties procedures for establishing the special assess-
ment district. He. stated further that if the land required fof street
widening were-donated by the property owners, then the estimated land
acquisition 'cost could be eliminated, which would then place the bid
within the estimated cost of the:district .
Mr. John Muir asked how the assessment spread on the pumping station
was spread over the district.
Mr. Romero, at the request of the Mayor, explained the basis for
design of the pumping station and the spread of the assessment to
the properties concerned.
Mr. Muir again asked the City Council to reconsider the spread of the
assessment of the pumping station - that it be assessed only to the
properties that need the additional pumping station and not to prop -
erties that could be adequately served without the pumping station.
Mr. Blaser asked----the City Council if they would eonsader the installation
of . transite type pipe in the district in lieu of the required cast iron
Pipe. Mr. Blaser stated that other subdivisions in the City were
allowed to use transite type pipe and he believes that this district
should be allowed to do the same.
Mr. Blaser stated that he was not protesting the formation of the
district, just asking for consideration of the different type of
pipe. Further, Mr. Blaser asked the City to pay the difference
between the six inch water main and the eight inch water main
as kk is done in many cases for subdividers.
Mrs. Johnson appeared before the Council stating she agreed with the
request of Mr. Blaser for this district to use transite type pipe and. -
asked for equal treatment with other subdividers.
Mr. Blaser presented a written protest against the computation of Assess-
ment No. 602, as he believed that the basis of 140 front feet was
wrong and that it should be reduced by 6 or 8 feet.
There being no further protests, written or oral, the Mayor reviewed for
the people present the Council action to date on the formation of the
special assessment district.
Councilman Dr. Smith stated that the people on Flora Street did not
need a pumping station but that the pumping plant was only needed for

the people above Flora Street and that the assessmentshould be
spread only to the lots benefited.
Mr. Harold Blake stated that the Council had three alternatives on the
spread of the pumping station costs
1 - If all properties received benefit from the pumping station,
then all properties should be assessed.
2 - If only the areas above a certain elevation received benefit,
this area should be zoned and the charge should be -made only
to those areas benefited.
3 - If.only_a small portion of the lower area receives benefit, then
the assessment could be spread proportionately - the higher
assessment to the higher area and the smaller assessmentto the
lower area.

Mr. Blaser asked the City Council how the area of benefit for the assess-
ment of the pumping station for the higher and lower zones would be
computed when the .present staff could not determine the benefit to
the area.

Mr. Smee asked, if a portion of the properties in the district as pro-
posed were taken off the pump station and the assessment reduced
"'D proportionately, would not a smaller pump be adequate to serve the
areas needing the additional pumping.
Mr. Romero, City Engineer, stated that regardless of the spread of
the assessment the present design of the pump station was only
a minimum design to care -for the district as presently proposed.
Councilman Sleight asked if all the people oh Flora Street would derive
benefits from the pump station as proposed. =
Mr. Romero, City Engineer, stated that all people on Flora Street
' would benefit from the pump station but.how much was difficult
to measure.
Mr. Smee again appeared before the Council and asked, if this pump
station was removed from the district would each property owner
above Flora Street be required to install a small pressure system
to take care of domestic needs.
At this time the City Council undertook the consideration of each pro-
test to the.formation,of the .assessment district.
A - Protest of Mr. Muirrregarding the spread of the : assessment of
the pumping station to all properties. Protest was overruled
by the City Council.
B - Protest of Mr. L. Blaser requesting the substitution of transite
type pipe in lieu ofcast iron pipe for water was overruled by
the City Council, as was the request for-City reimbursement of
the differences between a six inch and eight inch pipe for the
water system.
C -.Mr. L. Blaserts protest on Assessment #602 requesting recompu-
tation.on the front foot assessment on his parcel::
Mr. Romero; City Engineer, explained for the Council's information the
basis for the assessment showing the various alternatives considered by
the City Engineer in spreading the assessment. Mr. Romero stated
that they had taken into consideration the various ways that Mr.
Bl i er could develop-his property, but that Mr. Blaser had come up
wia different plan for developing his property that would reduce
the front foot spread by 7 feet.
Mr. Blaser- again asked the City Council for consideration on the reduction
on the seven feet as he is being forced to give land for street
widening also to the Johnson Avenue Plan line. After some discussion
Mr. Blaser withdrew his protest to the spread of the assessment on
No. 602: :

There being no further protests, on motion of Richard G. Sleight,
seconded,by Kenneth W. Jones, the district was ordered formed
and the protests overruled.
On motion of Kenneth W. Jones, seconded by Nels Beck, the hearing was
closed:
Introduction of Resolution No. 411 (1958 Series). A Resolution Over-
ruling Protests on Resolution No. 373 - 1958 Series of Preliminary
Determination and of Intention was passed and adopted on motion of
Richard G. Sleight, seconded by Kenneth W. Jones on the following 1
roll call vote:

Intro duction,of Resolution No. 412 (1958-S-eries). A %solution De-
termining Convenience and Necessity, Adopting Engineers report
Confirming Assessment and Ordering Work was passed and adopted on
motion of Kenneth W. Jones, seconded by Nels Beck on the f ollow-
ing roll call vote:

Introduction of Resolution No. 413 X195$ Series). A Resolution of
Award of Contract was passed and adopted on motion of Kenneth
W. Jones, seconded by Richard G. Sleight on the. following roll
call vote:

Introduction of Resolution No. 414--(1958 Series). A Resolution
Designating. Collection Officer was passed and adopted on motion
of Richard G. Sleight, seconded by Kenneth W. Jones on the
following roll call vote:

J. Barry Smith, Fred H. Lucksinger
NOES: None
ABSENT: None .
At this time, Mr. Miller, Administrative Officer, presented a letter
from Mr. Peter Patsch offering appraisal services for valuation
work in relation to the formation.of San Luis Obispo Parking
District No. 1.
Mr. Miller, Administrative Officer, recommended to the Council
that Mr. Patsch be retained for the appraisal work at the
fees proposed by Mr. Patsch.
On motion of Kenneth W. Jones, seconded by Richard G. Sleight,
recommendation of Mr. Miller was adopted and Mr. Peter I
Patsch was retained for the appraisal work for land acquisi-
tion for Parking District No. 1.
At this time Mayor Lucksinger.intro duced Mr. Carr who is going to
work with the Chamber of Commerce on behalf of the City for
acquiring air service for San Luis Obispo.
On motion of Nels Beck, seconded by Richard G. Sleight, Mr. Carr
�. was authorized to represent the City on the Chamber of
? Commerce Committee regarding acquiring air service for San
Luis Obispo.
G Mr. Carr appeared before the City Council outlining studies

he has made.to date regarding air service for San Luis Obispo.
Mr. Carr presented to the Council the plans he is preparing for
presentation to the C. A. B. for airline service to the City of
San Luis Obispo.
Mr. Miller, Administrative Officer recommended to the. City Council
that any expenses incurred by Mr. Carr in his studies should be
paid for by the City such as plane rental, transpDrtation, etc.
Introduction of Resolution No. 415 (195$ Series) A Resolution Accept-
ing Deeds For the Augusta Street Et Al Improvement District, was
passed and adopted on motion of Richard G. Sleight, seconded by
Nels Beck on the following roll call vote:
AYES:. Nels Beck, Kenneth W. Jones, Richard G. Sleight,
J. Barry Smith, Fred H. Lucksinger
NOES: None
ABSENT: None
Councilman Jones asked if there was any way that the City Council could
expedite city contracts in streets in the future so as not to leave
streets closed off and ditches open for long periods of time.
Mr. Jones cited the example of the Webb Construction Company doing
a .s ,ewer enlargement job for the City on Chorro Street.
Councilman Jones also asked Mr. Romero to look into the mat ter of the
repaving of . Chorro Street which is being done by the W. M. Lyles
Company due to faulty backfill when originally completed by Lyles
Company.
On motion of Richard G. Sleight, seconded by Kenneth W. Jones, the
meeting was adjourned.
