32: Councilman J. Barry Smith asked that the City Building Department
inspect the building at the southeast corner of Broad and Islay
Streets to see if it met the minimum standards for human habitation
and report to the City Council.
On motion of Donald Q. Miller, seconded by J. Barry Smith, the meeting

The City Council met in Regular Session with Mayor Fred M. Waters presiding.

Minutes for the Regular Meeting of October 3, 1960, and.Special Meeting of
October 3, 1960, were approved as presented, on motion of Donald Q. Miller,
seconded by Kenneth W. Jones..
Claims against the City for the month of October, 1960,. were approved on
motion of Kenneth W. Jones, seconded by Gerald W. Shipsey, subject to the
approval of the Administrative Officer.
1. Communication from Administrative Officer Miller announcing the
,appointment of Donald L. Kaye as fireman, and recommending he start
October 24, 1960 at $390 per month.
Recommendation approved and authority granted to hire 8 days earlier
than authorized, or October 24, 1960, on motion of Kenneth W. Jones,
seconded by Donald Q. Miller.
2. Administrative Officer Miller announced the appointment of Kandres 0.
Dunahee, stenographer, Planning & Building Department, effective
October 11, 1960 at $280 per month.
Appointment approved on motion of Kenneth W. Jones, seconded by Donald
Q. Miller.
3. Administrative Officer Miller announced the promotion of Captain William
H. Woodward to Fire Marshal effective November 1, 1960, at 4th step of
$575 per month with recommendation that he be considered for 5th step
in year.

4. On motion of Kenneth W. Jones,.::seconded by Gerald W: Shipsey, the following
salary step increases were approved:
THOMAS P. GINGG - Prin. Engineering Aide - from step 3 $435 to step 4
$460 per month, effective November 1, 1960.
JESSE G. GONZALES - Laborer - Park Department - from step 1 $295 to step 2
$312 per month, effective November 1, 1960.
5. Administrative Officer Miller requested authority to advertise for purchase '
of four police cars, trading in three.
Request approved on motion of Donald Q. Miller, seconded by Kenneth W.
Jones.
6. For Council consideration, acceptance of deed and approval of agreement for
improvements on Johnson Avenue from Milton S. & Fay V. Reis.
Mayor Waters was authorized to sign the agreement and record the deed on
motion of Gerald W. Shipsey, seconded by Kenneth W. Jones.
7. At this time, Mayor Waters declared a PUBLIC HEARING open on final passage
of Ordinance No. 172.
There being no discussion, Mayor Waters closed the hearing.
ORDINANCE NO. 172 (1960 Series), "An Ordinance of Intention to Abandon a
Portion of Munoz Street," Finally passed on motion of Kenneth W. Jones,
seconded by Donald Q. Miller, on the following roll call vote:
AYES: Kenneth W. Jones, Donald Q. Miller, Gerald W. Shipsey, Fred M.
Waters.
NOES: None
ABSENT: J. Barry Smith
8. Communication from Regional Water Pollution Control Board submitting ,
comments and recommendations for sewage treatment facilities for the
City of San Luis Obispo.
City Attorney Houser reviewed some of the points covered in the recommendation
of the Water Pollution Control Board as brought out at the meeting on
September 23, 1960.
The City Council instructed Mr. Romero and Mr. Houser to proceed with the
application as requested but to keep the City Council informed as to all
actions of the City.
9. At this time the City Council considered approval of the final map of
Tract No. 203, Ann Arbor Estates No. 1.
City Engineer Romero presented a map of the tract and explained in detail
the subdivision and the conditions for its construction:
1. The subdivider will dedicate 8 feet of widening on Johnson Avenue, will
install curb, gutter and sidewalk along the tract frontage and will
bring the unpaved portion of Johnson Avenue to subgrade level.
2. The City will construct base and paving on Johnson Avenue from the
gutter line to the edge of existing pavement. ,
3. The subdivider shall fully improve Southwood Drive except that a
plant mix berm and no sidewalk are required on the north side.
4. The subdivider will extend an 8" water line on Johnson Avenue from
the tract boundary to an adequate join approximately 800 -feet
northerly and shall be entitled to such reimbursement as are specified
under 7410.6 of the San Luis Obispo Municipal Code.

5. The subdivider will install a 12" waterline on Southwood Drive
(beginning.200 feet east of Johnson Avenue) and the City will pay
for excess capacity between an 8" and a 12" line. The subdivider
shall be entitled to such reimbursements as are specified under
section 7410.6 of the San Luis Obispo Municipal Code.
6. The subdivider shall reimburse Lindero Investment Co., Inc. the
sum of $2227.37 (based on a unit price of .$2.6809 per foot for
830.83 feet) for a proportionate share of the cost of the water
line .already installed in Johnson Avenue as is specified under
7410.6 of the San Luis Obispo Municipal Code.
7. The subdivider shall reimburse the City the sum of $7,214.61
(11.539_ acres at $273.52116 per acre, and 1426.47 feet at $2.8451
per lin. foot) as this subdivision's share of the cost of Johnson,
et al sewer district now serving this parcel.
8. A lot depth exception is granted on Lot 5, Block B.
Mr. Knuthson, subdivider, appeared before the City Council and made the
following requests relative to his subdivision:
Item 2 of the conditions: He requested that the City coordinate the
street improvements with that of the subdivision so that when the cui7
gutter and sidewalk are placed on Johnson Avenue.the street widening
will be done at the same time so as to complete the job properly.
Mr. Romero, City Engineer, explained that he planned to let a contract
for the work on Johnson Avenue during May or June which would probably
tie in reasonably well with the subdivision work.
Item 3 of the conditions: Mr. Knuthson objected to the conditions in
Agreement item 3 and in..lieu offered to improve.the southerly 30 feet
adjacent to the subdivision to City standards and improve the northerly
30 feet of Southwood Drive to the extent of rough grading, as they did
not wish to make-improvements solely for.the benefit of those
properties northerly of Southwood Drive..
Planning Director Abraham explained to-the City Council the reasons
that the Planning Commission requested full street improvement on
Southwood Drive.
The City Council then discussed the requirement.for full street
improvement on Southwood Drive.
Mr. Knuthson stated that he, as subdivider, had no objection to
agreement items 4, 5, and 6, except that in Item 6, he requested a
break down on unit price per foot of water line on'Johnson Avenue.
Item 7 of the conditions: Mr. Knuthson objected to this condition
and asked permission to negotiate this cost as it does not appear
to be fair to their operation and he would like to negotiate with
the City Engineer, City Attorney, and City Administrative Officer
a fairer price on the sewer line.
City Engineer Romero explained that the assessment for sewer to this
subdivision was levied on a similar basis as properties were assessed
in the Johnson Sewer District, in which the City advanced a portion
of the money for .the mains for the properties outside the"City at the
time the Assessment District was formed.
City At Houser explained.the assessment procedure and reimbursement
procedure according to section 7500 et..seq. of the'Municipal Code.
He further explained, the sewer service charges for this subdivision
were arrived at by using the same unit cost and acreage cost as
developed for the Johnson Sewer District, as the same costs have
been used in all similar situations in the vidinity.
The City Council discussed the provisions of the.subdivision agreement
and the objections thereto by the subdivider and discussed possible
alternatives to the subdivider. Mayor Waters stated that the City
Council must keep in mind the prospective buyers of these homes in
*_tie subdivision, as it would be the new property owners who would
benefit from the improvements and not the subdivider.

Councilman Jones asked Mr. Romero if the conditions in the agreement were
any different than required of other subdividers in the City and
particularly in this area. •
Mr. Romero stated that these conditions were the same for everyone
who had similar circumstances, and gave examples of the conditions
placed on the Southwood subdivision, in McAllen Heights, and in the
Bowen subdivision.
There being no further discussion, the following resolution was introduced:
RESOLUTION NO. 705 (1960 Series), "A Resolution Accepting the Final Map
of Tract #203, Ann Arbor Estates ", was passed and adopted on motion of
Gerald W: Shipsey, seconded by Donald Q. Miller, on the following roll
call vote:
AYES: Kenneth W. Jones, Gerald W. Shipsey, Donald Q. Miller, Fred M.
Waters.
NOES: None

10. TRAFFIC COMMITTEE REPORT
60 -10 -3C "The Traffic Committee has studied the request of Enrico Bongio
for establishment of a school zone on Sierra Way and feels that this is
a justified request. It is therefore recommended that such a zone be
established with markings on the street both north and south of the curve
on Sierra Way ".
RESOLUTION NO. 704 (1960 Series), "A Resolution Establishing a School Zone
on Sierra Way ", was-passed and adopted on motion of Gerald W.' Shipsey,
seconded by Donald Q. Miller, on the following roll call vote:
AYES: Kenneth W. Jones, Donald Q. Miller, Gerald W. Shipsey,'Fred M.
Waters.
NOES: None
ABSENT: J. Barry Smith
60 -10 -4T "School authorities have requested a red zone on Pismo Street
near Osos in front of the Grace Tabernacle which could be used to'
facilitate turning movements onto Osos and would also be useful for school
buses loading and unloading students. It is therefore recommended that
forty (40) feet of red zone be added to the present zone at the corner of
Pismo and Osos Streets on the north side of Pismo running in an easterly
direction from the Osos intersection."
Police Chief Schofield explained to the City Council the reasons the
Committee was recommending a red zone at this section.
The City Council discussed the advisability of painting the curb red along
this church property as it was a permanent prohibition of parking, and would
not a portable sign be a better way to reserve parking for school buses at
this corner, which would allow public parking after school hours and on
Sundays and holidays. '
Councilman Shipsey moved that a resolution be adopted placing a red zone on
Pismo Street near Osos. Motion died for lack of a second.
It was moved by Kenneth W. Jones, seconded by Donald Q. Miller; that this
matter be referred back to the Traffic Committee for additional study for
an alternative solution. Motion carried on the following roll call vote:
AYES: Kenneth W. Jones, Donald Q. Miller, Fred M. Maters. ,
NOES: Gerald W. Shipsey.-
ABSENT: J. Barry Smith.

visibility exists on the southeast corner of'Grand and Garfield, and if the
Council has no objection, the City Engineer will take steps to have the
obstruction removed."
There was no objection by the City Council.

60 -10 -6T " The Traffic Committee received a request from the Poly
Engineer's House at 156 Higuera Street for a loading zone to facilitate
deliveries of milk, bread, and other food products to the kitchen at
that location. We feel that this is no different from many other
establishments in the City and that it will not work a hardship for
delivery trucks to double park when unloading. We therefore recommend
against the loading zone."
Recommendation approved on motion of Donald Q. Miller,,seconded by
Gerald W. Shipsey.
11. A) Communication and petition from residents of Rachel Street calling
' City Council attention to a nuisance existing and asking for relief
by the City Council, was received and filed.
B) Communication from Police Chief Schofield reporting on the above was
received and filed.
12. Communication from Audrey B. Moore submitting a plumbing bill to the
City of San Luis Obispo for a stoppage of a sewer drain at the corner of
Mill Street and Grand Avenue was referred to the insurance carrier and
City Engineer Romero was to make an investigation and report back to
the City Council on ways to alleviate this problem.

15. Discussion by the City Council of liquidated damages on Grand Avenue.

'City Engineer Romero explained to the City Council the provisions in
the contracts having to do with liquidated damages when a contractor
does not.complete a contract on time and would like to have the opinion
of the City Council whether he should enforce either with the present
contract in effect or with new contracts being called in the future.
After discussion by the City Council and by their common consent, it
was agreed that all future contracts be enforced relative to this
provision and also that the penalties be increased to try to make the
contractors finish on time.
16. Communication from Walston & Company submitting a recent bulletin from
the Investment Bankers Association of America, was received and filed.
' 17. Application of Pacific Airlines for an increase in intra -state passenger
fares before the Public Utilities Commission, was ordered received and
filed.
18. Communication from Pacific Telephone and Telegraph Company notifying the
City of San Luis Obispo that they are planning to construct a 2 story
with basement building adjacent to the City Hall Parking Lot, was
received and filed.
City Engineer Romero was instructed to keep the Council infomm ed of
further developments.
City Engineer Romero presented a map of the Laguna Lake area showing the
topography in the area being dredged and to-be dredged and showing where
the dredging should be done this year if the City so desires at the time
that Mr. Skinner cuts the present dike and allows the water from the
upper area to flow into the newly dredged area. Mr. Romero stated that
this.fall would be the best time for the City to bring in earth moving
equipment m deepen the lake on the City owned side. Mr. Romero asked
Council permission to continue the engineering studies to arrive at a
figure for dredging the City property for City Council consideration.
Mr. Romero further stated that the Engineering and Grading Contractors
Association may offer the use of equipment for a community project and
he thinks that this might be a place where they could put their
equipment to proper use.
The City Council told Mr. Romero to proceed with his studies on cost,
etc. and report at the next meeting.

19. Communication from City Treasurer J. Earle Boyce, requesting permission
to.be absent from the State of California for a period.of..20 days beginning
October 19, 1960.
Request approved on motion of Gerald W. Shipsey, seconded by Kenneth W. Jones.
20. Request for annexation of the Silver City Trailer Park on an inhabited basis
was referred to the City Attorney for investigation and reportto the City
Council.
21. Request of the Public Committee to Save our Schools for permission to hold
a "Kids Parade" on Saturday, November 5, 1960, was approved-with coordination
by the Police Chief on motion of Kenneth•W.•Jones, seconded�by Gerald W.
Shipsey.
22. Communication from the Public Committee to Save Our Schools requesting that
the City Council officially endorse the bond motion on the November 8, 1960
ballot.
RESOLUTION NO. 706 (1960 Series), "A Resolution Endorsing the Passange of -the
School Bond Issues ", was passed.and adopted on motion of Gerald W. Shipsey,
seconded by Donald Q. Miller, on the following roll call vote:

23. Communication from Public Committee to Save Our Schools requesting permission
to place an information booth on Higuera Street to disseminate.information on
the bond issue on the-November election.
Approved on motion of Gerald W. Shipsey, seconded by Donald Q. Miller, with
the details as to location, to be worked out with the Police Chief.
24. Resignation of Seth
G. Kinney as Building
Inspector effective October 21, 1960

25. City Attorney Houser
reported that Richard
Harris, attorney for Mr. Stiefel
stated that a notice
was being sent to the
City to the effect that Mr.
Stiefel desired to terminate
the lease for
the .City sewer farm and :would
cease occupation on
or before December 1,1960.

26. City Engineer Romero presented to the City Council construction plans fora
drainage project on Caudill Street to attempt to.alle viate flooding on Caudill
Street. Mr. Romero pointed out that these improvements would take-place
within the existing.street.right -of -way and would aid Mr. Smith who resides
on the north side of the street. He also pointed out that this would be of
no help to Mr. Snodgrass and Mr. Santos who are also flooded during winter
rains. Mr. Romero reported that Mr.. Santos is unwilling to make any
expenditure to aid the drainage problem,.while Mr. Snodgrass has indicated
he would attempt to solve his own problem as well as possible.
Councilman Miller asked that the City also look into some change in the
drainage on Mitchell Drive on the same drainage channel as the one on
Caudill Street to try to alleviate flooding of.properties on the west side
of Mitchell Drive.
Mr. Romero stated that plans could be prepared and the job let to bid this
fall if the Council so desired.
The Council.instructed Mr. Romero to proceed with-the job.. '
27. City Engineer Romero asked for authority to advertise for bids---for French
Road paving along the Skinner subdivision. .
