City Clerk Fitzpatrick read a notice to the City Council from City Engineer Romero.stating that the one -way street plan on Marsh and Higuera would be placed in operation at 12:00 noon on May 7, 1961. 10. Councilman:Miller presented to the City Council copies of assembly bill 801 for their information, and urged that the City Council read the bill, as he believed the provisions of the bill would help eliminate.discrimination in housing.. The City Council met in Special Called Session to discuss the street set -back line problem at 2238 S. Broad Street, Maino Construction Company, brought about when Mr. T. C. Maino applied for a building permit for addition to his office building which would be constructed within the proposed plan line set -back. City Engineer Romero presented a report dated May 169 1961, regarding proposed :: street widening on Broad Street, and the proposed sidewalk width on Broad Street. The City Council met with Mr. Ted Maino on the above matter, particularly regarding the construction of his office building addition in the sidewalk area of the proposed street widening. Mr. Maino explained his problem to the Council that due.to the design.of his present building, it would make it impossible to connect the new building and still be useable under one roof. City Engineer Romero urged that the proposed roadway width not be reduced as he believes that it is a minimum street width which will provide acceptable service for traffic, and if the Council were to compromise with the property woner, he recommended that the compromise be made in the sidewalk area. 1 I I 1 CITY COUNCIL MEETING May-15, 1961 - -- 7:30 P. Mayor Davidson introduced Meriday Peterson, queen candidate sponsored by the San Luis Obispo Elks Club as part of the Santa Maria Elks Club Rodeo and urged that the local people support her candidacy as much as possible. Mr. Richard Simon, chairman of the queen contest for the local Elks Club, appeared before the City Council expldining for what purpose the money collected would he-aused, and he claimed that all monies go to youth activities in the area in which the candidate lives. NOES: None ABSENT: None Councilman Graves presented a draft of proposed provisions to be added to the present building codes involving new methods and materials of construc- tion and certification of architect or professional engineer.. The City Clerk was requested to get.copies of Councilman Graves' proposal to the City Council for their study. 9. At this time a Public Appearance was made before the City Council by repre- sentatives of the Southern Pacific Railroad Company and the Atchison, Topeka and Santa Fe Railway Company on behalf of the application of each company before the.I.C.C. for acquisition of the.Western Pacific Railroad. Mr: W. L: Wellman, special agent for AT&SF Railway appeared before the City , Council on behalf of his company's application to acquire the Western Pacific Railway. Emmett Fitzpatrick, public relations representative for the Southern Pacific Company appeared before the City Council on behalf of his company's appli- cation to acquire the Western Pacific Railway. Councilman Miller left the meeting at 8:45 P. M. After 5 afinutes for presentation by each railroad representative and a 5 minute rebuttal, the appearance was closed. Mr. Les Damm appeared before the City Council stating that he did not know all the ramifications in the acquisition of the Western Pacific Railway but that he believed the;_people in this area have no choice but to support the Southern Pacific Company, as they are the only railroad serving San Luis Obispo and, of course, will be the only one, so we should do everything we can to help them out. It was moved by Gerald W. Shipsey, seconded by R. L. Graves, Jr., that the I City Council give no support to either side in this very complex matter. Councilman Miller took his seat at 9:00 P. M. 10. Report of the Council Committee consisting of Councilmen Shipsey and Miller on the request of the Recreation Commission that the City purchase two acres of land adjacent to the school site in the Laguna Homes.Subdivision (Skinner). Councilman Shipsey reported on a meeting held earlier this day with repre- sentatives of the School Board and that the'School Board stated they would purchase the additional.land adjacent to the school.site if the City would agree to maintain and develop a.park on the extra.two acres being purchased by the school board; further, the City would only expend funds on park developments while the school would buy the land. Administrative Officer Miller explained the past practice of the City Coun- cils�and School Boards in making joint-use of school facilities for rec- reational development. Mayor Davidson requested that City Attorney Houser prepare an agreement 1 for joint use and development of school lands for common use of the school district and the recreation department. 11. A) TRAFFIC COMMITTEE REPORT of May 5, 1961. 61-5-IT "For some time, the Engineering Department has been studying a proposed street lighting layout for the.Yoakum Tract. The attached map shows the recommendations of the Traffic Committee after reviewing the proposal by the PG&E Company. .It is recommended that the Council authorize the City Engineer-to order these lights installed." Councilman Graves stated that there are other areas in the City that need sidewalks for-the safety of pedestrians and possibly the formation of a City -wide assessment district could-be considered to place sidewalks on all secondary streets. It was moved by R. L. Graves; Jr., seconded by Donald Q. Miller, that City Attorney Houser prepare A report for the Council on the various methods of placing sidewalks, also including estimated costs of placing curb, gutter and sidewalk for average sized parcels. Motion carried. Mr'. Rizzoli asked the City Council while these studies were going on ' if a 15 mile- per -hour speed limit sign could be placed on cuesta Drive in an attempt to slow down.traffic. Mr. Peter Weber suggested that the City investigate the feasibility of opening Highland Drive to Chorro Street and Ferrini Road and that as an affected property-owner he would be willing to co- operate with the -- City in this-development * He further urged.that the City Council contact Cal Poly to see-if additional•right -of -way could be acquired from Poly for the extension of Highland Drive to Fb'rrini Road, and further, that .all the right -of -way should come from Poly as.they will not be contribu- ting to the development of this street. After some discussion by Administrative Officer Miller and City Engineer Romero, relative to past negotiation's for the extension of Highland .Drive Mr. Miller stated he:would check the record and see if any written reports had been filed on the amount of land Cal Poly .had offered for Highland Drive and then report to the Council.< Received and filed for report on sidewalks by Mr. Romero. C) TRAFFIC COMMITTEE REPORT of May 9, 1961. 61 -5 -6T "After the first two days in operation, the`Traffic Committee has.observed•.•that-the °one -way street�installation-is-working fairly smoothly and that the vast majority of motorists have had little diffi- culty in adjusting'_to the new:pattern. A larger: "Do,Not Enter" sign ,has been installed.at the corner.of'Marsh and Johnson, and the Fire Department has been asked to assist the Police Department to help citizens to become acquainted with the new installation. We- notice :-one.additionaliimprovement- -which- could-be made.. This would involve elimination of the red _ zone -:on:the-.west -side of Santa-.Rosa Street just north of the Marsh Street intersection., This red zone is no longer needed for right -hand turning movements, and its elimination would result in the•.addition of two- parking.spaces at.the curb." Communication from Department of Water Resources regarding.acquisition of a permanent interest in the.Mainini property to operate infiltration basins at the Whale Rock Reservoir, was received and filed. 13. Administrative Officer Miller reported to the City Council on steps that should be- taken -to extend the Whale Rock..Construction period until the project is completed or at -least until December..31, 1961, as the pump stations have still not been let for bid. Also, the commission had not organized itself, and no budget had been adopted. : Water Superintendent Thompson requested that the time be extended before the City takes over the operation of the Whale rock Dam as quite a bit is yet to be done, and he will not have time to.hire and train men to operate the dam between now and July and recommended that the City not take over operation until January 1, 1962. Administrative Officer Miller requested permission.of the Council to write the Department of Finance requesting that the-Department of Water Resources continue to operate the dam until December 31', 1961.. On motion of Gerald W.-Shipsey, seconded by R. L. Graves, Jr., Administrative Officer Miller was authorized to write such a letter to the State Department of Finance. 14. Discussion by the City Council of'additinn of "S" classification to the "M" zone on the northeast side of Broad Street, was referred to the City Plan- ning Commission for report.and recommendation to.the_City Council. 15. The matter of discrimination in housing was referred to a Council Committee consisting-of Councilmen Shipsey and Miller for investigation and report to the Council. Councilman Miller presented the following statement in support of Assembly Bill 801, protecting minority groups from discrimination.in housing: "The Council has been asked by me to consider endorsing Assembly Bill 801, which would add.to the State-Fair Employment Practice Act, a section pro- tecting minority groups.from discrimination.with regards to-housing. This legislation does not have jurisdiction over individual home owners who wish to sell or lease their home. It does cover those people or or- ganizations who make it a business renting or.selling.property from dis- criminating because..of_race, religion or- national origin..- New York has such legislation, and the experience of that state is one of fair and just enforcement. Many civic leaders and church organizations have endorsed this bill - -as did the ministerial association of this City. I ask the Council to endorse AB 801, and notify the Assembly of our stand. I so move." Councilman Shipsey wished to remind the. Council .that.this bill is still being debated in the-Legislature so its status would be difficult to analyze, and further that while he concurs with the bill in principle, he is not in favor of this particular bill because of its penal provisions. After some discussion by the -City Council, it.was moved by Donald Q. Miller, seconded by R. L. Graves, Jr., that the City Council go on record as opposing discrimination in housing because of race or color. 16. Report of'Council Committee consisting of Councilmen Miller.and Shipsey I to study the matter of rolled concrete curbs and their reolacement:with standard concrete curb and gutter. Councilman Shipsey reported for.the Council Committee, stating that'after investigation and study that this matter does not appear to be a particu- larly large problem for the Council's consideration and that the filled in gutters along the.rolled curb and gutter be ignored by the City Council and the matter dropped from the agenda. • 1 1 1 ..The City Council discussed locations.of street lights in the Yoakum area as recommended.by the City Traffic Committee.and suggested that additional street lights be added in order to provide better street light- ing for the residents in the area. In addition to the lights proposed by the!Traffic Committee, one additional street light of 2,500 lumens would be added on Rockview Place south of Sweeney Alley, and one additional street light of 2,500 lumens be added on Broad.Street between Orcutt Road and Rockview Place. - Recommendation approved as amended on motion.of Donald Q. Miller, seconded by R. L. Graves, Jr., Motion carried. 61 -5 -2T "It is recommended that a stop sign be placed on Smith Street at Johnson Avenue stopping Smith Street traffic." RESOLUTION N0. 792 (1961 Series), "A Resolution Establishing a Boulevard Stop.on Smith Street at its Intersection with Johnson Avenue," was• passed and adopted on motion of R. L. This forces eastbound motorists on South Street to drive over the center.lane•.: It is�.therefore recommended that the short - stretch or curbing on South Street be painted red as well as the curb return and other short piece of connecting curb around the corner on Lawton Street." RESOLUTION_NO. 793 (1961:Series), "A,Resolution Establishing a No- Parking Zone on South Street Near Its Intersection with Lawton Street," was passed and adopted on motion of Donald Q. "At the request.of the Rarleskint Nursery, the Traffic Committee has looked at the parking situation in the vicinity of the nursery in the 1400 block of Monterey Street. While the letter from the Rarleskints suggests a loading zone, there is some thought on the part of the Committee that this would constitute preferential treatment for this one business. As an alternative, we would like to suggest that the Council authorize a two -hour parking time limit in this block which extends from Johnson Avenue to California Boulevard with the standard time markings. We would then like an opportunity to observe this zone in action and see-* whether the congestion is reduced. We feel that the two -hour zone should eliminate enough all -day parkers to help the situation substantially." RESOLUTION NO. 794 (1961 Series), "A Resolution Establishing a 2 -Hour Parking Zone on Monterey Street," was passed and adopted on motion of Gerald =W. NOES: None ABSENT: None B) 61 -5 -5c "The following report is in response to the second letter from the Teach..- -' PTA group regarding the pedestrian hazard to school children on the east side of Cuesta between Felton-Way-and-Highland Drive. The Council will recall that the Traffic.Committee had.suggested a red zone at this location.previously,•but the Council turned -this down following a hearfingi.andeprotesv -by V.A.J. Rizzoli who resides at 423 Cuesta Drive. The second letter from the PTA suggested that park- ing be restricted during school hours only or sidewalks.:installed. We feel that the restriction during school hours would not be practical and feel the installation of sidewalks would be the best answer. However, until the City Council has arrived.at some standardr-method ' of obtaining sidewalks within the City, we feel that this would be difficult to accomplish on an individual basis. We therefore respect- fully re-submit-our original recommendation -for a red zone on Cuesta Drive between Felton Way and Highland Drive eliminating all parking or stopping on that side of the street. We are also. mailing copies of this report to the PTA and residents who would be affected, so they will have a chance to be heard by the Council on the subject if they so desire." - City Clerk Fitzpatrick read the following letter sigged by residents of Cuesta Drive between Felton Way and Highland Drive suggesting alter - natives to the Traffic Committee proposal of painting the curbs red: "We protest the proposed red No- parking zone on the east side of Cuesta Drive from Highland Avenue to Felton Way. We. recognize that a very real danger exists for the school children but the proposed red zone would not eliminate that danger. .. From our personal observation, the.danger is caused by.two factors:. 1. Excessive speed of motorists rounding the curve off Highland, and up over the hill created when Cuesta Drive was made a through ._.:street; and 2. By some of the children who do not walk facing the traffic and who cross Cuesta Drive haphazardly below the brow of the hill so that a motorist coming over the hill cannot see them.. We therefore propose the following: 1. A 15 -mile zone from Highland.Avenue to Felton Way. 2. A boulevard -stop sign on Highland-Avenue-at Cuesta Drive. 3. A well posted crosswalk at the crest•of the-hill on Cuesta Drive where children could be seen by motorists. 4. Have parents insist that the children use this crosswalk, and one at Felton .Way, so that the children walk.facing on- coming traffic. As a further comment, the primary cause of this hazard is that most of the traffic from the College Highlands area has been funnelled down Cuesta Drive to Foothill Blvd. If Highland Avenue were completed straight out to Highway 1, traffic would be greatly reduced on Cuesta Drive. This would help protect all the Teach School:children - those who walk on Cuest, those who cross it, and also the :•youngsters who play in the park adjacent to the school. Another help in diverting traffic would be a through street to Highway 1 along the northern edge of College Highlands." Mr. Al Rizzoli appeared before the City,Council stating that he him- self does not believe that painting a red zone on the east side of Cuesta Drive will solve the problem for pedestrians as the primary solution will be the extension of Highland Drive to North Chorro Street , and Ferrini Road in order to alleviate the vehicle traffic on Cuesta Drive. It was moved by R. L. Graves, Jr., seconded by Donald Q. Miller, that the Council investigate.the possibility of installing.sidewalks on Cuesta Drive between Felton Way-and-Highland-Drive to permanently solve the problem of pedestrians walking in the street. Motion carried. City Engineer Romero requested that the Council make some policy decision as to whether property owners should be permitted to fill in the street gutter to ease their driveways so they could drive their cars onto their property. He stated that he believed the Council should decide this matter for his guidance. Councilman Graves moved that the City have all obstructions in the gutter removed with no exceptions. Motion died for lack of a second. ' --- ------ -- -- -- At this time Mayor Davidson brought up the matter of Senate Bill 1268, the non- he believed this bill was in public utility gas corporation act, stating that the public interest and that he had personally written to State Senator Sturgeon urging his support, and Senator Sturgeon replied that he would support the bill when it appeared before the Senate. It was moved by R. L. Graves, Jr., seconded by Donald Q. Miller, that the City Council endorse Senate Bill 1268 which would allow the Public Utility Commission regulatory power over the future construction of pipelines for use by non- public utilities in the transmission of natural gas to consumers as this bill is in the best interest of the public and citizens of the State of California. Motion carried. ---- ---- - - - - - -- 17. Proposal of Mayor Davidson for reorganization of the City Traffic Committee. At this time Mayor Davidson stated that he would like to propose::forcthe;:. :.' Council's consideration a reorganization of the City Traffic Committee. He stated he believed that the citizens should be represented on the Traffic Committee and not just the City Staff members. He proposed that Council- men-.Graves and Miller, and citizen Richard Coleman, with two employees appointed by Administrative Officer Miller, be members of this committee. ' Councilman Graves suggested that instead of just two staff members, should not the City Planning Commission be represented by the Planning Director, the Police Department by the Police. Chief and the Public Works Department by the City Engineer? The City Council then discussed Mayor Davidson's proposal for a new make- up of the City Traffic Committee. Councilman Miller asked how did the City Staff feel regarding the Mayor's proposal? Administrative Officer Miller stated that he had previously discussed this matter with the Mayor and that he believed that the.Mayor's proposal would tend 2:%d to be unwieldy as the members work at different jobs and would have a difficulty getting together to study traffic problems, where the City Staff members on the Committee are available at all times and problems asithisu1d could be rapidly studied and forwarded to the City Council at which time the City Council as a whole would review all reports and recommendations as a final board of review. Mr. Romero in getting Councilman ' make -up bu take a lot problems. stated that he felt the proposed committee would have difficulty together and might prove unwieldy. Shipsey stated he did not object to the new Traffic Committee t he did not know if this was a good thing or not as it would of the Councilmen's time trying to get together to study traffic Councilman Miller stated that while everyone did not have a lot of time to spend on studying traffic problems, he believed the present Traffic Committee is not well made up in that the Police Chief and City Engineer were subordinate to the Administrative Officer, and it would be very difficult to go against the recommendation of the Administrative Officer. Houser; Jr", secretary of ihe�Traffic Advisory Board inviting the City Council to-a luncheon on G/ednesday; May 24, 1961, to" discuss progress of a revised traffic ordinance: City Attorney Houser'explained. the- make -up and'the purpose of the Traffic' Advisory Board and urged that either all the Council or a Committee of the Council attend the May 24th meeting as the committee wished to discuss some future policy decisions relative to traffic ordinances: On motion of Donald Q. Miller, seconded by Miss Margaret M. McNeil, the'- Council unanimously voted to attend the Traffic Advisory Board meeting. 20. Communication from the State Department of Public Health-notifying the City Council that the Department of Public Health has redeclared San Luis Obispo County a rabies area, effective April 14, 1961, was received and filed. 21. Communication from the City Planning Commission recommending approval by the City Council of exceptions to the subdivision ordinance for lots over 150 feet in depth: 1. City Engineer Romero and Planning Directoi Abraham explained the exceptions to the subdivision ordinance as recommended by:the Small Subdivision-Committee, for A. F. Farrow, Ranchotel. Lot depth exception approved on motion of R. L. Graves, Jr., seconded by Gerald W. Shipsey. 2. Planning Director Abraham and City Engineer Romero then explained exceptions involved on the L. H. Paulsen property. Recommendation for lot dept} exception approved on motion of W. Shipsey, seconded by R. L. Graves, Jr. 22. Notice from the State Water Pollution Cdntrol Board of proposed changes in regulations of said board was referred to Harry N. Jenks, sewer consultant for his recommendations. 23. Resolution of the Planning Commission regarding curb, gutter and sidewalk exception for Mr. Robert E. McCarthy (McCarthy Tank & Steel) at 313 South St. City Engineer Romero explained the past hitory of the problem and the City Planning Commission recommendations relative to curb, gutter, and sidewalk. Mr. Houser explained the basis for exceptions as provided in the Municipal Code. Mr. McCarthy appeared before the City Council on behalf of his application for exception to the City's curb, gutter and sidewalk provisions and stated that at some future date if the City would lower the street grade on South Street he would be very happy to place curb, gutter and sidewalk to the new grade line. He also said that if the Council approved his request he would immediately deed the necessary 26 ft. for street widening purposes. Mr. Romero explained the street grade and stated that it was quite unlikely that the street grade would be changed. After discussion by the City Council, it was moved by R. L. Graves, Jr., seconded by Donald Q. Miller, that the City Council accept the City Planning Commision recommendation and authorized Mayor Davidson to accept the deed for street widening and for the City Engineer to improve the street to the new curb line and also pave the opposite side of South Street as recommended by the City Planning Commission. Motion carried. 24. Communication from Disabled American Veterans County Chapter requesting permission to sponsor a donkey softball-game on May 30, 1961, at Santa Rosa Park. Request approved with no objections. 25. Communication from Veterans of Foreign Wars, requesting permission to hold a poppy sale in San Luis Obispo on Thursday, Friday and Saturday, May 25, 26, and 27, 1961, and 26. Communication from the State of California, Division of Small Craft Harbors, bringing to the City Council's attention the revisions made to the Harbors and Navigation Code and urging that the cities and counties in the State revise their boating ordinances to conform with the State Boating Law, was received and filed. 29. Mayor Davidson was authorized to write a letter to the State Chamber of Commerce, Department of Public Works, and the local Chamber of Commerce requesting that all haste be made for the construction of the Madonna Road overpass on motion of Donald Q. Miller, seconded by Gerald W. Shipsey. 30. Communication from Gladys Forden, president of the Library Board, request- ing Council authority to hang certain pictures and paintings owned by the City School Board in the City Library subject to certain conditions relative to relieving the City of the responsibility. The matter was referred to the City Staff to investigate and bring back a recommendation to the City Council. 31. Administrative Officer Miller asked permission of the Council for City ' Clerk Fitzpatrick to go to Los Anglees on May 17, 1961, to sign the Park- ing District No. 1 Bonds and to make delivery of said bonds to John Nuveen & Company. The trip was authorized on motion of Donald. Q. Miller, seconded by R. L. Graves, Jr. ... 32. Communication from the Library Board requesting permission for Mrs. R. W. Reynolds, board member, and Patricia Clark, Librarian, to attend the Governor's Conference For Public Library Trustees in Sacramento on June 12 -13, 1961.
