Motion carried., 2. Mr. Houser, City Attorney, reported to the City Council on the steps necessary to amend the City Charter to change the existing election day for City Officials from the second Tuesday in April to the third Tuesday in April in order to coincide with the general election for School Districts and the Junior College in the County. Mr. Houser explained the alternatives in wording to amend the Charter dealing with Council salaries in order to comply with the legislation granted to General Law Cities and reconmtended that the election problem be handled by an amendment specifying the third Tuesday in April for the City Council election, provided there are no pending changes in the School District and Junior College election dates, and that the salary amendment include any changes subsequently made by the State Legislature for similar site cities to avoid periodic charter amendments.' On motion of Councilman Miller, seconded by Councilman Spring, the recommendation of the City Attorney be accepted and the City Attorney to proceed with the necessary documents. Motion carried. 3. Mr. Houser, City Attorney, reported to the City Council that he had written to several major oil companies in order to set basic conditions for possible lease of sewer farm property to a major oil company and that to date he had not heard from these companies but felt sure that as soon as the holiday period was completed, he would be hearing from them and would report at that time. 4. Mr: Houser, City Attorney, reported to the City Council on the matter of the placement of sewer lines through the Serafin property to the City's sewer main. Mr. Houser stated that he had been discussing this matter with Mr. Serafin's attorney, Mr. H. Murphy, and that he was hopeful that a decision could be made on this matter shortly. Mr. Romero, City Engineer, presented a sketch n£ the problem of the sewer line for the Council's information. On motion of 0mincilman Miller, seconded by Councilman Blake, the City Attorney, Mr. Houser, was authorized to proceed with the negotiations to acquire the sewer easement. Motion carried. Councilman Gallagher voting no. 5. Communication from 0. J. Gullickson, Deputy Director'of Civil Defense; requesting that plans be prepared and funds be set aside in the 1966 -67 budget to make needed improvements to the Disaster Center in the City Hall basement. Mr. R. D. Miller, Administrative Officer, stated that another alternative would be to construct a complete, protected control center with the aid of federal funds. It might be helpful for the Council to meet with members of the Advisory Committee before making a decision. On motion of Councilman Miller, seconded by Councilman Gallagher, the request was continued and the City Council was to meet with the Civil Defense Advisory Board regarding improvements to'the Disaster Center. 6. E. P. Thompson, Water Superintendent, reported to the City Council on the request of E. W. Rodrigues to remove a City water line from the rear of his property. ' Mr. Tyson stated that this pipe has been located on the property and adjoining properties for many years and the City has a vested right to maintain the pipe in its present location as long as it is needed to continue adequate service to the properties involved. Further, he stated he could not justify the expenditure of putting a new water line in Palm Street to serve four dwellings at an estimated cost of $61,000 and therefore recommended that the pipe be left in its present position. Mr. Houser, City Attorney, upon question of the Council, explained the City's - liabilit; if any property is damaged because of this pipe. On motion of Councilman Miller, seconded by Councilman Spring, that the pipe stay in its present location but that replacements be made on that portion needing replacement at this time. I City Council Minutes January 3, 1966 Page 4 8. He wished the City Council to consider some commercial development of the industrial area in the southeast section of the City. The Mayor stated that he realized that this was a lotig list of programs and projects but he felt the first of the year was a good time to bring these matters to the front so that some work could be done to complete these matters. ' 9. At this time the City Council held a public hearing on the recommendation of the Traffic Committee to install parking restrictions on Santa Rosa Street between Peach and Palm Streets between 7:00 and 9:00 A.M. and 4:00 and 6:00 P.M. Monday through Friday. The City Clerk reported that each property owner on record and each occupant in the two block area were 'sent notices listing the recommendation of the Traffic Committee and announcing the time and date of the public hearing. D. P. Romero, City Engineer, explained that traffic congestion is caused primarily by the signal at Mill an8 Santa Rosa and suggested several alternatives to reduce the congestion. Mayor Whelchel declared the public hearing open. Mr. Arnold Woodward, operator of the Santa Rosa Market, at 798 Santa Rosa Street, appeared before the City Council objecting to the proposed parking restrictions as he stated this would effect him personally as the best shopping hours in his store are from 4:00 to 6:00 P.M. each day. He presented a petition signed by 58 persons urging the City Council not to place these no parking restrictions on Santa Rosa Street as proposed. Mr. Woodward stated that rather than prohibit parking, that the Council should prohibit all lefthand turns from Santa Rosa between Monterey and Peach Streets during peak hours. Be stated that from watching the situation for years at his store, that the biggest bottleneck to traffic were the lef *_hand movements. Mr. Stanley Nelson, property owner, stated that he did not feel there was much of a problem on Santa Rosa Street as the street was actually too narrow to safely carry two lines of traffic both ways, but that it was his opinion that if parking was eliminated in front of the recreation building, that the traffic flows would improve on the whole block. Mayor Whelchel declared the public hearing closed. Mayor Whelchel asked if the problem on Santa Rosa Street between Palm and Peach was one of all day parking and if it was would not a parking limit of one hour solve the problem. Mr. Miller, Administrative Officer, and the City Engineer, D. F. Romero, answered that the primary problem was all day parking in this area, Councilman Gallagher asked when Santa Rosa Street would be completely widened as he feels that this is the first problem to be solved so that four lanes of traffic could use the street safely. Further, he felt that this was one of the most important streets in town to need widening and hoped that the City Council would push this pro4 ject along as he felt other streets that have been widened were not as congested as Santa Rosa Street, ' Mr. Romero, City Engineer, stated that he was prepared to work on the widening of Santa Rosa Street as soon as the City Council instructed him to do so and funds were budgeted. . on motion of'Mayor Whelchel, seconded by Councilman Miller, that this matter be re- referred to the Traffic Committee for further study. Mayor Whelchel declared a recess at 8:55 P.M. The meeting reconvened at 9:05 P.M. - all Councilmen present. Y. Mr. Tolladay, representing Atwood -Grove builder of Iftstang Village, appeared . before the City Council asking them to decide on the type of material to be used for backing in the shower walls in their development. He also stated that it would not be prudent to expect the existing 12 inch line to serve a population of more than 5,000 in the Laguna area. Councilman Miller feels that while his total proposal is quite expensive, he feels it is one the City should plan for and therefore that the City Council should try to ' pick away at it for, say 1,000 to 1,500 feet per year. 13. Mayor Whelchel brought to the Council's attention and discussion, the possibility of the City acquiring a possible future sewer site south of the City of San Luis Obispo for development sometime in the future. Mayor Whelchel felt that based on the present City estimates of population and growth that the City will need a new sewer plant within the next 15 to 20 years. R. D. Miller, Administrative Officer, reported to the City Council that at the time the Council was discussing the last enlargements and improvements to the sewer farm that various other alternatives were studied such as outfall to the ocean, location of another sewer plant south of the City, etc, and upon recommendation of the sewer engineers it was decided that the best solution was the enlargement of the existing plant. D. F. Romero, City Engineer, reviewed Mr. Jenks' conclusions regarding construction of a second sewage treatment plant, pointing out that W. Jenks' study was generally unfavorable to this answer. 14. The City Clerk requested that the City Council amend Section 4110.16 of the Municipal Code that exempts puppies from licensing-regulations and amend it to state that all dogs must be licensed at four months of age. The City Clerk stated that the reason for the request was to make the City ordinance comply with the State Laws on the same subject. On motion of Mayor Whelchel, seconded by Councilman Miller, the request was referred to the City Attorney for preparation of the necessary amendments. Motion carried. 15. The City Clerk reported on the following bids received for a six month contract to make repairs to concrete curbs, gutters and sidewalks in the City. 1. Howie and Shelton $50058.75 P. Romero, City Engineer, stated he felt that this was a good bid and that the bid of Howie and Shelton should be accepted. On motion of Councilman Miller, seconded by Councilman Gallagher, that the low bid of Howie and Shelton be accepted. Motion carried. 16. On motion of Councilman Gallagher, seconded by Councilman Suring, the following contract payments were approved: C.S. F Romero, City Engineer, reported that he had met with Mr. Higuera and had come to agreement regarding a solution to the driveway problem. The repairs will be made by City forces. 27. Councilman Donald Q. Miller brought up the matter-of the denial by the City Council at the December 20th meeting of the salary step increase for Mr. Robert Mayse employee at the Whale Rock Reservoir. Councilman Miller stated he felt this was unfair in denying this increase as the salary steps within a range are for promotional purposes and to encourage the employee to continue to do good work and to improve himself in his job and if the City Council had any objection to the salary range `then this should be adjusted at budget time but the employee should not be penalized within the range. It was moved by Councilman Miller, seconded by Councilman Blake, that the City Council grant the salary increase as recommended for Robert Mayse. Motion defeated on the following roll call vote: AYES: Emmons Blake, Donald Q. Miller NOES: Frank Gallagher, Arthur F. Sprin„ Clell W.
