Approval of•the minutes of the meeting of April 4, 1966 were held over.
On motion of Councilman Blake, seconded by councilman Sprin& claims against the
City for the month of April 1966 were approved and ordered paid subject to the
approval of the Administrative Officer.

X. Don Miller, Cal Poly Student, introduced the Poly Royal Queen, Sharon DuBois,
who presented Poly Royal Badges to the Mayor and City Councilmen and invited them
to participate in the 65th Poly Royal, a county fair on a college campus.
Mayor Whelchel on behalf of the Councilmen thanked the Poly Royal Queen for her
thoughtfulness and her presentation.
1. Mayor Whelchel presented a certificate as Water Pollution Control Operator
Grade III to Darrel Richards who completed the necessary studies for certification.
' Mayor Whelchel congratulated Mr. Richards on achieving this honor and thanked him
for the extra work necessary to accomplish it.
2. Mayor Whelchel presented certificates of completion to the following members of
the San Luis Obispo Fire Department who attended the Oil Fire Control School.
Battalion Chief Dixon, Battalion Chief Wainscott, Fire Marshal Woodward, Fire
Captain Babcock, Fire Captain Kaye, Fire Captain Silva, Fire Captain Yonker, Fire
Captain Blumhorst and Fire Captain Mello.
Mayor elchel on behalf of the City Council congratulated these members of the
Fire Department for their diligence in acquiring this additional certificate in fire
fighting practice.
3. At this time Mr. He Forrest Wood, 1220 Monte vista Place, appeared before the
City Council requesting that the Council eliminate the two hour parking restriction
on Monte vista Place in front of his apartment house as the tenants in his apartment
need this space for parking.
Mr. Wood stated that the apartments are rented to college students with four students
to an apartment and there is insufficient parking off the street for the number of
cars owned by the students.
We Wood stated that at the time of building the apartment he complied with all the
minimtmt standards of the City which was one.and one half off street parking spaces
' for each apartment. He feels that if the requirements are wrong the City should
not penalize property owners who have complied. He felt this was a hardship on him
and that the students would be moving out if they could not find parking close to
their residence.
Mr. Dave Woolworth, resident at 1220 Monte vista Place, objected to this restricted
parking as it was inconvenient for him to park his car anywhere else other than in
front of his apartment.
Miss ,Julie Aborn objected to this parking restriction as she has no place to park
and It is inconvenient for her to come back from school every two hours to move her
car. She asked that this restriction be taken off so that she can park all day in
front of her apartment.

6B. Burt Walter, Chief Building Inspector, presented 4 summary of the violation

Mr. Walter stated that he has notified Mr. Medzyk in writing -a-n_d:'ih'pe1`rs-6n'

correct this deficiency and to date no progress has been made to close access to

the swimming pool by the public.
Mr. Medzyk appeared before the City Council listing for the City Council his pro-
blems with his contractor and the fact that the apartment development had exceeded
the amount of money he had on hand and he then explained how he will complete the
required fencing as soon as he can raise the necessary funds which he proposes to
be completed within 60 to 90 days.
After some discussion by the City Council relative to temporary fencing until the
complete improvements have been made; it was moved by Councilman Miller, seconded by
Councilman Gallagher, that Mr. Medzyk place a temporary gate or fence in the open
area until the permanent improvements are completed and this temporary fence to be
placed within 10 days of this date. Notion carried.
7. On motion of Councilman Miller, seconded by Councilman Gallagher, the following
contract payments were approved:

66 -4 -1C. The Traffic Committee has studied the proposed agreement between the .
Division of Highways and the City, whereby the City would take over maintenance of
underpasses and overpasses on connection with the Freeway as far as the traveled
surface and sidewalk areas are concerned, and feels that the Council should agree
to take over these areas for maintenance, inasmuch as this was the stated intention
at the time of the construction of the 101 -Freeway.
On motion of Councilman Gallagher, seconded by Councilman String, the following
resolution was introduced. Resolution No. 15429 a resolution of the City Council
approving the Freeway Maintenance Agreement.

66 -4 -2T. The Traffic Committee has met with Dr. Harper on his second request that
the City consider installation of short term parking on Bishop alongside the Clinic.
We feel that this space is being taken up by employees and residents on an all day
basis and feel that the first three spaces on the north side of Bishop running in
a westerly direction from the Johnson intersection should be designated as 36 minute
time limit spaces.
664-3T. The Traffic Committee has looked at the traffic signal operation at the
' utersection of Monterey and Morro and feel that the first space back from the
intersection in front of the Village Squire should be designated as a red zone to
facilitate right hand turning movements, and the next space be a 36 minute metered
zone. We also feel that the first space in front of the Stag Billiard Parlor should
be a red zone and the second space a 36 minute metered zone.
On motion of Councilman Spring, seconded by Councilman Gallagher, the following
resolution was introduced. Resolution No. 1544, a resolution establishing parking
restrictions on Bishop and Monterey Streets.

9. At.this time the City Council held a public hearing on the matter of Resolution
No. 1534, a resolution requiring sidewalk improvements on portions of Broad ", Peach,
Chorro, Johnson and Mill Streets.
Mr. Romero, City Engineer, presented a map showing the improvements recommended for
each parcel under consideration.
Mayor Whelchel declared the public hearing open.
Father Steiger, representing the Roman Catholic Bishop,' appeared before? the City
Council questioning the advisability of placing sidewalks adjacent to the Mission
property on Broad Street as it was his understanding that this area of Broad Street
was to be realigned in connection with, the Mission Plaza development and that all
street parking would be placed in the'existing right of way on Broad Street which
would require the removal of this sidewalk if this plan proceeded.
Mr. Romero, City Engineer, stated that this sidewalk, was needed at this time regard-
less of future plans as many children going to the Catholic School use this street
and the sidewalks are required for their benefit.
Mayor Whelchel declared the public hearing closed.
Councilman Miller stated that on behalf of R. L. Graves that he be allowed to install
an integral sidewalk at 756 North Broad Street and also on the Peach Street side.
Councilman Miller stated that Mr. Graves felt that this would be a better improve-
ment for the area.
After discussion with the City Engineer relative to possible transition, it was
moved by Councilman Miller,.seconded by Councilman Gallagher,, that an integral '
sidewalk be placed on the Grave's property if 'it were possible to make a proper
transition. Motion carried. Councilman Blake voting no.
Councilman Miller, on behalf. of-Mr. R. Umbertis, who-requested that in' addition to
placing the new sidewalks on Johnson Avenue that the City also reconstruct the
sidewalk in front of the property on Buchon Street and that he be allowed to pay for
both installations on the three year basis. ".r '
On motion of Councilman Miller, seconded by Councilman Gallagher, that the request
be granted if legally possible to install sidewalks on both Johnson Avenue and
Buchon Streets. Motion carried.
On motion of Councilman Gallagher, seconded by Councilman Spring, that a six foot
sidewalk be allowed along the church property on Broad Street and that the balance
of the property be landscaped.
Father Steiger again appeared before the City Council and stated he 'had no objection
to placing the sidewalks he was only questioning the advisability if it were to be
removed in the near future. He stated that if a sidewalk was required they would
rather place the full 10 foot sidewalk to avoid maintenance of the area between
the sidewalk and the property line.
Councilman Gallagher withdrew his motion with the approval of the seconder,
Councilman Spring.
On motion of Councilman Miller, seconded by Councilman Gallagher, the following '
resolution was introduced. Resolution No. 1545, a resolution determining that
public convenience requires construction of sidewalks on portions of Broad, Peach,
Chorro, Johnson and Mill Streets.

34. At this time the,'City Council:'eonsidered'the= reports- of`'the,City's insurance
carrier and the contractor's insurance carriercrelatiwe to the claim of Mss. Emmons
for payment of damages for loss of business due to the contract being performed by
West Coast Construction Company. C ri. '
The City's insurance carrier, Farmers Insurance Group, stated that from their investi-
gation and their discussion with Mrs. Emmons that there was no apparent negligence
on=the part of the e- City -'or'' its -`'employees` aiid `therefore' there= was-no liability under
the ii s_urance' contract' be ' the" City: = ' : c _ o'.. c
The insurance company stated that they had advised Mrs. Emmons of their decision.
The report of the contracior''s'"iiisnraiice company, the U. S. Fidelity and Guarantee
Company, stated that they carry the insurance for the contractor and that their
investigations show that- the'woik_;performed was in accordance with' the`'bpecifications
and contract for the project-and was in accordance with the City's ordinances and
safety.regulations and that there appears to be no liability for .loss of business
by the contractor. __:•1_ _ ,_,.::,,r
Further,,they stated that at no time.during the duration of the contract was Mrs.
Emmon's-property blocked: -- Therefore they feel there is no liability on-behalf-of
the contractor or insurance_carriere "`
Mr.' "Emmons appeared before- the.City,Council opposing the decision'and recommendations

of the two insurance carre'rs`as"ehe feels she was definitely damaged financially by
the methods used and the time involved, by the City and contractor in completing this
project:' She continued that "she had 'discussed this matter with Mr. Houser, City
Attorney, and that Mr. HouseY'•iiad-rInformed her that the denial by the insurance
companies did not preclude her from cueing the contractor or insurance company in a
civil' action in a court of'competent- jurisdiction.

more'than she could ever" receive::
Mrs. Emmons thanked the City Council for their consideration and wished them to know
she wad-not happy about the - decision but that there was nothing she ''could do about it.

13. Communication from La Fiesta Association, W. L. Gilfeather Parade Chairman,
requesting assistance from the City Council for the Street Department to place
barricades along the line of march for the Fiesta Parade. They also requested that
early on the morning of Saturday, May 21, 1966 that no parking signs be placed the
full length of Higuera Street, the parade route. They also requested permission to
hang Fiesta Flags on Higuera and Monterey Streets and finally they requested Council
' approval for placing the parade - Judge's stand in the driveway of Parking Lot No. 6.
Mr. Gilfeather appeared before the City Council and explained in detail the route of
march and all the details of the parade to be held in conjunction with the parade.
on motion of Councilman Miller, seconded-by Councilman Gdllashher, all the requests of
the Fiesta Committee were granted. Motion carried.
13A. Communication from Ed J. Davin, President, Fiesta Association, asking that the
City Council encourage City employees and all the residents of the-City of San Luis
Obispo to wear appropriate costumes denoting the Spanish heritage during the Fiesta
1966.
The City Council stated they would be very happy to comply with this request.
14. Mayor Whelchel suggested that instead of the City Council riding in a decorated
convertible automobile in the Fiesta Parade, that the City Council attempt to get
some type of a horse drawn vehicle to ride in during the parade.
Be stated if it were possible to acquire such a vehicle, he felt it would add to the
festivities and the spirit of the day.
After discussion by the - -City Council, it was the concensus that the Mayor proceed
to attempt to acquire a horse drawn wagon for the Council to ride in.
' 15. Mr. Romero, City Engineer, reported that he had received correspondence from an
attorney for the bonding company indicating that the bonding company was attempting
to have the developer complete the improvements to Ann Arbor Tract No. 317 as soon
,as possible.
W. M. Houser, City Attorney, explained the further steps to be taken as follows:
That the bonding company first notifies the developer of the delinquency and directs
them to immediately correct the default. Thus, it is up to the bonding company to
make the necessary arrangements to pay the costs of completing the improvements if
the developer fails to do so.
This item to be placed on the Council Agenda for June 63, 1966.
16. At this time the City Council discussed the progress of the acquisition of the
property on Monterey Street west of Chorro across from the Mission.
Mr, Houser, City Attorney, recommended that the City not take any action on the
corner parcel as the owner of this property was going through probate at this time
and the inheritance tax appraisers would set a value for which the City might
possibly purchase the property if insufficient funds were available for maintenance
of the estate.
The City Attorney was asked in his opinion how long it might be before this estate
would be settled. Mr. Houser said it could take anywhere from six months to two
' gears. .
It was the concensus of the Council that the City should proceed with this acquisi-
tion at this time.
The City Clerk then presented two proposals for appraisal services to approve the
four properties involved, one appraisal from C. W. Vrooman and the other from Central
Coast Appraisal Service.
After consideration of the proposals presented, the proposal of Central Coast
Appraisal Service was accepted on motion of Councilman Miller, seconded by Councilman
Gallagher. Motion carried.
17. At this time City Engineer, D: F. Romero, presented for the Council's review
the plans and specifications for the 1965 -66 Street Resurfacing Program using select
street funds.
