SPECIAL CALLED MEETING OF THE CITY COUNCIL
CITY OF SAN LUIS OBISPO, CALIFORNIA

1. R. D. Miller, Administrative Officer, reported to the Council the results
of the City and County conference on continuing the animal control program
with Woods Animal Shelter Society as follows:
The various administrators (Pismo Beach not represented) agreed to the recast
figures based on a combination of population changes and the 15% increase .
to Woods. The County.presented the outline of a model contract calling for
more service and a 15% increase.
The Council discussed at length the recommended continuation of the animal
control contract with Woods. Some members of the City Council discussed
the level of service to be provided the City of San Luis Obispo under the
increased cost of this contract. The Council also discussed alternatives
to the existing and proposed contract for animal control. They discussed
what future consideration this Council should give to providing adequate
animal control service to the residents of San Luis Obispo.
On motion of Councilman Blake, seconded by Councilman Brown, that the
City Council accept the continuation of the contract with Woods Animal
Shelter Society for the period ending June 30, 1972 at a monthly rate of
$1640.00. Motion carried with Councilmen Graham and Gurnee voting no.
2. The Clty Council received the League of California Cities Legislative
Bulletin dated August 19, 1971 and took the following action:
A. A.B. 2622 - Zoning Hearing and Records
On motion of Mayor Schwartz, seconded by Counci.lman Brown, the City
Council opposed this bill on the basis that the requirement of providing
a transcript of each hearing and swearing in of all witnesses would
inhibit rather than encourage citizen participation in public hearings
on zoning. Motion carried.
B. A.B. 2294 - Mobile Homes
On motion of Councilman Gurnee, seconded by Councilman Brown, that the
City Council oppose enactment of this bill on the basis that the State
was again taking away from the people concerned in a city or county the
right of orderly development and planning of their communities. Motion
carried.
C. A.B. 844 - Collective Bargaining - Public Employees
On motion of Councilman Brown, seconded by Councilman Gurnee, that the
City Council oppose this bill on the basis that the State Legislature
has not given the Meyer -Milas -Brown Act any time to see if it worked
before throwing it out and replacing it with a new procedure. Motion
carried.

D. A. B. 1098 - Policemen 8 Firemen - Mandatory Retirement Benefits
On motion of Councilman Blake, seconded by Councilman Brown, that the
City Council oppose this bill as it places extreme financial hardship
on cities without any provision for increasing revenue to pay for this
additional retirement, also while reducing the age of retirement, it is
not mandatory and the individual could stay on, building up costs to
the city. Motion carried.
E. S.B. 325 - Sales Tax on Gasoline
On motion of Councilman Gurnee, seconded by Councilman Graham, the City
Council supported this bill as it places a sales tax on gasoline of
which a portion is returned to cities and counties and would bring much
needed revenue to the cities and counties of the state. Motion carried
with Councilman Blake voting no.
F. S. B. 515.- Regional Planning
On motion of Mayor Schwartz, seconded by Councilman Gurnee, the City of
San Luis Obispo supported the provisions of S.B. 515, dealing with the
establishment of Regional Environmental Planning Council within each
region as designated by the C.I.R. Motion carried with Councilman
Blake voting no.
G. A.B. 1471 - Shoreline Control Legislation
On motion of Councilman Gurnee, seconded by Councilman Graham, that
the City Council support the provisions of A.B. 1471 on Shoreline control.
Motion lost on the following roll call vote:
AYES: Myron Graham, T. Keith Gurnee
NOES: Emmons Blake, John C. Brown, Kenneth E. Schwartz
ABSENT: None
H. A.B. 1735 - Special Assessment - Exemption of Railroad Right -of -Way
On motion of Councilman Brown, seconded by Councilman Graham, that the
City Coun,ci;l oppose this bill as it would exempt all railroad rights -
of -way properties from the provisions of the 1911 Improvement Act
regardless of benefits. Motion carried with Councilman Blake voting no.
3. On motion of Councilman Blake, seconded by Councilman Brown, the City
Council accepted the resignation of City Attorney, Harold Johnson, effective
September 30, 1971.
Mayor Schwartz, on behalf of the City Council, publicly announced the appoint-
ment of Arthur J. Shaw, Jr. as City Attorney effective October 1, 1971 at a
salary of $1650 per month.
4. On motion of Councilman Blake, seconded by Councilman Gurnee, the meeting
was adjourned.
