HomeMy WebLinkAbout02/25/2014minutes city of san luis osispo SPECIAL MEETING OF THE CITY COUNCIL Tuesday, February 25, 2014 Council Chamber, 990 Palm Street San Luis Obispo, California CALL TO ORDER A Special Meeting of the San Luis Obispo City Council was called to order on Tuesday, February 25, 2014 at 3:00 p.m. in the Council Hearing Room, located at 990 Palm Street, San Luis Obispo, California, by Mayor Marx. ROLL CALL Council Members Present: Council Members Dan Carpenter, Kathy Smith, Vice Mayor Carlyn Christianson, and Mayor Jan Marx Council Member Absent: None City Staff Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney, Michael Codron, Assistant City Manager, and Heather Goodwin, Deputy City Clerk, were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. CLOSED SESSION City Attorney Dietrick requested a Closed Session to discuss the item listed on the Closed Session agenda. A. CONFERENCE WITH LEGAL COUNSEL — Existing Litigation, Pursuant to Government Code § 54956.9 City of San Luis Obispo v. CBS Outdoor, Inc., San Luis Obispo Superior Court Case No. CV 130172 PUBLIC COMMENT ON CLOSED SESSION ITEM City Attorney Dietrick called for public comment. There was no one present desiring to speak on Closed Session and the Council recessed to the Closed Session. City Council Meeting Minutes — February 25, 2014 Page 2 CALL TO ORDER A Special Meeting of the San Luis Obispo City Council was called to order on Tuesday, February 25, 2014 at 4:00 p.m. in the City Council Chambers, located at 990 Palm Street, San Luis Obispo, California, by Mayor Marx. PLEDGE OF ALLEGIANCE Council Member Smith led the Pledge of Allegiance. REPORT FROM CLOSED SESSION City Attorney Dietrick advised that Council provided direction to staff and took no reportable action. PUBLIC HEARING PH1. Council Members Carpenter, Smith, Vice Mayor Christianson, and Mayor Marx announced Ex Parte communications with representatives of the subject project. Community Development Director Johnson and Associate Planner Leveille narrated a PowerPoint presentation entitled "Appeal of the Architectural Review Commission's Design Review Approval of a Classroom Building and Accessory Staff Office" and responded to Council inquires. Mayor Marx opened the Public Hearing. The following individuals voiced opposition to the proposed project; opined that the City provided inadequate public notice for the Administrative Use Hearing; voiced concern that the project will have negative impacts on traffic and parking; urged Council to deny this project or forward it to the Planning Commission for consideration: Michele Gordon, representing Mission Orchard Neighbor Association Jim Johnson, San Luis Obispo Terri Page, San Luis Obispo Marilyn Gordon, San Luis Obispo David Drake, San Luis Obispo 1 l r City Council Meeting Minutes — February 25, 2014 Page 3 Rachael Drake, San Luis Obispo tDavid Brodie, San Luis Obispo Elizabeth Thyne, San Luis Obispo Joseph Abrahams, San Luis Obispo Elisabeth Abrahams, San Luis Obispo Jamie Lopes, San Luis Obispo Sandra Lakeman, San Luis Obispo Diane Duenow, San Luis Obispo Dixie Cliff, San Luis Obispo Jim Duenow, San Luis Obispo The following individuals expressed support for the proposed project; spoke on the changing teaching environment and the need for more adaptable learning space; noted that project ha: been reduced in scale and height to address the concerns of the adjacent property owner: Tina Ballantyne, Principal of Old Mission School Jim Duffy, Architect, representing the Old Mission School Kurt Friedmann, San Luis Obispo Michael Morris, Attorney for Old Mission School Lori Ronay, San Luis Obispo Neal Berryman, San Luis Obispo Rachel Kovesdi, representing Old Mission School Andrea Devitt, San Luis Obispo There being no others desiring to speak on this item, the Public Hearing was closed. 1 City Council Meeting Minutes — February 25, 2014 Page 4 In response to public comments, Community Development Director Johnson explained the City's public notification standards for , administrative hearings and Architectural Review Commission (ARC) hearings; noted that the ARC directed staff to expanded public notification to a 500' radius for this project; explained the methodology and rationale of the Hearing Officer for determining a categorical exemption. RECESS Council recessed at 5:40 p.m. and reconvened at 5:44 p.m., with all Council Members present. In response to Council inquiry, Associate Planner Leveille explained that the subject project has proposed parking for school uses and the project does not propose to increase school enrollment; explained that the zoning code related to off -site parking is unclear as to whether notification must occur for both sites. Council discussion ensued relative to: 1) the City's standards for public notification and whether adequate notice was provided for this project; 2) potential traffic impacts and the efficacy of the proposed traffic management plan. Following discussion, MOTION BY COUNCIL .MEMBER CARPENTER, SECOND BY VICE MAYOR CHRISTI.ANSON, CARRIED 3 -2, (COUNCIL MEMBER ASHBAUGH AND COUNCIL MEMBER SMITH VOTING NO) to adopt Resolution No. 10500 (2014 Series) entitled "A Resolution of the City Council of the City of San Luis Obispo, California, denying an appeal and upholding the Architectural Review Commission's action to approve a classroom building and accessory staff office (774 & 776 Palm Street, Arc 131 -13)." Council Member Smith noted for the record that she is voting no because she is concerned that the City provided inadequate notification to the affected residents. ADJOURNMENT The City Council adjourned at 6:13 p.m., to a Special Meeting to be held on Tuesday, March 4, 2014 at 5:00 p.m. The Regular meeting will commence at 6:00 p.m. in the City Council Chambers located at' 990 Palm Street, San Luis Obispo, California.
