COUNCIL CHAMBERS, CITY HALL, 990 PALM STREET Pledge Roll Call 1 Councilmembers PRESENT: Melanie Billig; Alan Bond, Ron Dunin, Jerry Munger and Mayor Cooper ABSENT: None City Staff: Lee Walton, Administrative Officer; J.H. Fitzpatrick, City Clerk; Geoff Grote, Assistant City Attorney; Henry Engen, Community Development Director; Roger :Neuman, Police Chief F731 Police Chief Roger Neuman, on behalf of himself and the Fire Chief, presented a contract for the Council's consideration to provide systems designed and computer programming software for a COMPUTER AIDED DISPATCH SYSTEM at a cost of $96,650. He reviewed the studies made to date by the city staff in order to arrive at use of the inhouse computer service for the effected departments. The proposal that has been selected by staff would operate the third environment computer with a number 1 priority of enhancing public safety responses to fires, crimes in progress, and other life threatening emergencies. The application would be completely compatible with existing hardware and could provide conservative means of entry into the overall use of computer systems. This proposed contract is a logically and cost effective extension of the existing high -level of communications service that the emergency services offer the community and he requested council approval.to award the contract to POLICE DATA SYSTEMS.' Upon questioning by the City Council, Chief Neuman stated that he could see no need for additional personnel to operate the new COMPUTER AIDED DISPATCH SYSTEM. On motion of Councilman Bond, seconded by Councilman Dunin, the following resolution was introduced: Resolution No. 4327 (1980 Series), a resolution of the Council of the City of San Luis Obispo approving an agreement between the Citv and POLICE DATA SYSTEMS to provide System Design and Computer Program procurement and installation of the Public Safety Consolidated Communications- - COMPUTER AIDED DISPATCH SYSTEM. Passed and adopted on the following roll call vote: AYES: Councilmembers Bond, Dunin, Billig, Munger and Mayor Cooper NOES: None ABSENT: None At this time, the City Council held a public hearing to consider proposed amendments to the General Plan of the City of San Luig Obispo. F462 1. GP 0847 1 General Plan Open Space Element to be combined with an amended Land Use Element. Henry Engen, Community Development Director, presented the recommendations of the Planning Commission for changes and additions to the open space elements and the amended land use element of the General Plan. He reviewed for the City Council City Council Minutes November 25, 1980 - 7:00 p.m. Page 2 changes in the General Plan text being recommended to the City Council. He continued that for several years the Planning Commission has been attempting to resolve issues concerning open space designations and the city's urban reserve line. Some of the issues have been founded in genuine confusion - -what do the city's policies mean - -while others have been disagreements over what the city's policies should be. After a series of study sessions, prompted in part by private applications, in part by their own concerns, and in part by the council's directive to prepare a new open space element, the commission, in April 1980, initiated a package of amendments that would replace the city's 1973 Open Space Element with a new one, to be combined with the Land Use Element. After consideration of an environmental impact report and public testimony, commissioners reached agreement on certain parts of the package of changes and additions. These were reflected in tonight's public hearing. The commission also decided the draft EIR, together with comments received and staff responses, provided adequate information for the council to take action on the proposed changes. Mr. Engen then proceeded with a detailed review of the text changes in the General Plan involving definitions, goals and policies, growth management objectives, open space polices, interim open space designations, etc. Mayor Cooper declared the public hearing open. Vic Montgomery hoped the City Council would require new standards for development on hillsides within the city. He felt this was an area neglected in the present General Plan. Star Jenkins made several suggestions for changes in the text. Rose McKeen questioned why did the area have to do with numbers of people 1 employed. She felt making numbers.of employees was unreasonable. She supported commerce and industry to give local children employment. Vic Montgomery again stated that the way that the industrial . area is being developed was very poor and would be further degradated by the plans proposed. Don Smith felt that mistakes were made in the past in allowing too much land to develop without adequate water and other utilities. He felt development in the new plan should be cut back at least in half. Roy Haas objected to heavy contols on development in the south county area. Jan Clucas, President of the League of Women Voters, submitted a lengthy statement on behalf of the League of Women Voters dealing with the General Plan Open Space Elements /Amended Land Use Element /General Plan Map Amendments. Vic Montgomery asked for clarification in the text in Paragraph 3, Line 6, pages 1 -12, dealing with creeks and creek development. The council asked the staff for a list of streams by name and which are considered major and which are considered minor streams. Glen Matteson, Planner, reviewed for the City Council the amendments to the General Plan Land Use Map as recommended by the Planning Commission for the City Council. Ginny Allen stated that she supported the Planning Commission's recommendations to conform the General Plan Line with the zoning line. Don Smith felt that area "B" was very controversial in the community and should have had an EIR prepared for this area before changing the General Plan Map. At 9:05 p.m, Mayor Cooper declared a recess. At 9:25 p.m., the council meeting reconvened with all councilmembers present:. City Council Minutes November 25, 1980 - 7:00 p.m. Page 3 Glen Matteson then continued his presentation of the amendments recommended by the Planning Commission to the Land Use map. Charles Andrews, Planning Commission members, reviewed some of the thinking of the Planning Commission in arriving at their recommendations. Rose McKeen stated she supported the Planning Commission's action on area "H ". Glen Matteson stated this discussion ended the map changes recommended from the Planning Commission. Henry Engen, Community Development Director, then reviewed the Draft Environmental Impact Report for the Open Space Element of the General Plan and reviewed the comments from the public and staff responses and correspondences received by the city on the EIR. On motion of Councilwoman Billig, seconded by Councilman Bond, that the Citv Council accept the Environmental Impact Report of the Open Space Element of the General Plan as adequate and meeting the requirements of State law. Motion carried, all ayes. Vic Montgomery questioned the fact that the Planning Commission denied Item No. 8 at their last hearing and wondered why there was no report to the City Council from the Staff. Glen Matteson - stated that the Planning Commission had initiated the General Plan Amendment but at the public hearing they refused to make a change and denied their own initiative and therefore no recommendation was made to the City Council. Charles Andrews explained some of the Planning Commission's action on a number of General Plan Amendments that were rejected by the Planning Commission at their public hearings. The City Council then directed the staff to amend the text as amended and as approved by the Planning Commission at this hearing and bring it back to the City Council for future consideration. On motion of Councilman Munger, seconded by Councilman Bond, the Planning Commission was again asked to look into review of Planning Commission Item No. 25 initiated by them but ultimately rejected. Motion carried, all ayes. F461 2• GP 0815 City Council considered an appeal of a Planning Commission Denial: A request to change the General Plan Land Use Element Map, conservation /agriculture to tourist commercial and conservation /agriculture to interim agriculture, and to relocate the urban reserve line. Glen Matteson, Assistant Planner, reviewed for the City Council General Plan, GP 0815, which was the appeal to a Planning Commission denial. He stated that Richmond, Rossi & Montgomery, representing Alex Madonna, had proposed changes to the city's plan which would lead to tourist commercial development north of the Madonna Inn and expansion of the city into an area now shown as open space. After public hearing on October 1, 1980, the Planning Commission voted 3 to 2 (2 absent) to deny the proposal. The commission's action has been appealed to the City Council. He continued that this was not a technical denial since the majority of the commissioners present voted in favor of the motion to deny. When considering this area as part of the commission- initiated amendments and a private application, several motions which would have resulted in changes to the plan were made - -none to approve a change like that applied for - -and either failed for lack of a second City Council Minutes November 25, 1980 - 7:00 p.m. Page 4 or were not approved by the four votes required under California law for a Planning Commission to recommend general plan changes. The Planning Commission found the EIR for the commission- initiated amendments in this area adequate for this application. He continued that the EIR evaluates the amendment proposed by the Planning Commission, not the one proposed by the applicant which is similar in area but wich establishes.no prerequisites for urbanization. The applicant's proposal, also would lead to immediate rezoning of the area within the city from A /C -20 and R -1 to C -T, while that initiated by the commission would require the intermediate step of changing the plan and zoning in conjunction with a definite plan for development. He stated that the staff recommended that the application should be denied because it is a speculative map change unrelated to a statement of need or development objectives. Although, if the council wished to indicate some development potential for the area, the plan should be amended to: 1. Relocate the urban reserve line to the citv limits. 2. Change the designation of the area between the highway and the city limits froin:dbnservdE on /ag iculture`toiinte m =agriciultu=el(requii4ng. a development plan prior to its eventual change to an urban designation.) 3. Establish certain basic prerequisites for its urbanization: modification of the Marsh Street interchange; if the urban use is a potentially growth - inducing one, findings that it can be carried out consistent with the Housing Element and that it will not jeopardize attainment or maintenance of the California air quality standards. If this was done, the approach would be consistent with the recently adopted county Land Use Element. Vic Montgomery spoke on behalf of the property owner reviewing the conditions of his appeals from a denial by the Planning Commission and asked for interim agriculural uses as authorized under the zoning ordinance. He said the purpose of the appeal was to establish some definition of what portions of the property should be included in future planning concepts for the city and to establish some long term objectives for use of the property. As of today, the situation is as follows: 1. The majority of this property is designated as Conservation /Agriculture on the 1977 General Plan. 2. The zoning of this property is roughly 50% AC -20 and 50% R -1. 3. The city water = service=e levation,7 6ariesfft6m ,- 320.+ffeet�:to�24.0+ffeet. 4. A major portion of the property (the rodeo grounds and equipment storage yard) are outside the city limits. 5. A large portion.of the property presently outside the city limits is within the apparent water elevation service of the city. This could also receive sewer service via the lift stations serving the existing development. 6. Much of this property is outside the Urban Reserve Line. 7. The vast majority of the land inside the apparent water service limit but outside the city limit and outside the Urban Reserve Line has slopes of less than 20 %. He continued that it was apparent that much of the property has development ' potential which is not recognized in the General Plan, even in text discussion. The purpose of the request is to amend the General Plan to reflect this development potential although not with the intent of immediate development. The plan, at present, appears to place all the city potential for development of additional tourist commercial facilities and.recreation in one place, upper Monterey Street. and rely on expectations and rejuvenation of existing facilitie The physical setting and existing uses in the vicinity of this project are more City Council Minutes November 25, 1980 - 7:00_.p.m. Page 5 conducive to development of additional tourist commercial facilities and recreation facilities than the upper Monterey Street area; this is especially true of recreation activities involving significant space requirements, i.e., sports facilities. He therefore requested on behalf of the property owner the following modifications of the General Plan in order to facilitate some type of long -range planning for the property and to reflect the true potential for future use: 1. That the area outside the present city limits but within the present water service capability limit and with slopes less than 20% -30% be shown within the Urban Reserve Line. 2. That the area outside the City limit but within the Urban Reserve (as modified) be shown as Interim Agricultural. 3. That the area inside the existing citv limit be indicated as "Tourist" on the"General-.Plan.map:_: 4. That the basic prerequisites for implementation of the General Plan amendment requested be outlined in the General Plan text. The intent of this request is to enable long range planning for the property, by the owner, based upon some idea of the city's view of its potential future use. It is the property owner's opinion that the potential does exist for commercial use of this property within the Plan period, as opposed to the present Plan designation of Agriculture. Alex Madonna, property owner, explained his intended use of the property if the General Plan was amended to Interim Agriculture including the old Bianchi house which has been remodeled for rental, but has been unused due to the zoning regulations. He felt that without some General Plan amendment, he could not proceed with any type of planning to come before the Planning Commission, Council or city regulatory bodies as it has been stated that before it can be done you must have the General Plan amended. This is where they were at this time. Charles Jones agreed with the Madonna request to rezone his property to Interim Agriculture to make use of his land. Charles Andrews, Planning Commission member, explained the Planning Commission's action denying this request to Interim Agriculture was primarily the magnitude of the area being requested for amendment within the General Plan and also without submission of a master plan for development of the property. Mayor Cooper declared the public hearing closed. City Staff and Council discussed alternatives to the denial by the Planning Commission in order to allow some use of this land by the property owner and in order to give the property owner some direction as to the council's feelings on future uses in this area. Councilman Bond stated he would support the appeal. He felt the property owner should receive some official direction from the city on this property. Councilman Munger agreed that the General Plan should be amended so that the property owner would have some direction from the city. Councilman Dunin would support the appeal. He felt that placing it to Interim Agriculture would at least give the property owner some security for preparing master plans of the property. Councilwoman Billig felt she would rather see a master plan development of the land within the city but could not agree with the procedure being used by the council. She would have to support the Planning Commission's.action and deny the appeal. 1 1 City Council Minutes November 25, 1980 - 7:00 p.m. Page 6 Councilman Dunin again asked for an explanation of what actually was being appealed. Henry Engen stated that the appeal was: 1) to change the urban reserve line; 2) amend the General Plan to show the land as Interim Agriculture. Vic Montgomery stated that the Interim AGriculture was being requested inside and outside the city. Councilwoman Billig again stated she could not support the appeal without having a master plan filed on ultimate use of the property. On motion of Councilman Bond, seconded by Councilman Munger, that the city council uphold the appeal and that the land outside.the city be shown on the General Plan as Interim Agriculture and that land within the city be shown as CP or Tourist Commercial zone. Motion carried on the following roll call vote: AYES: Councilmembers Bond, Munger, Dunin and Mayor Cooper NOES: Councilwoman Billig ABSENT: None Due to the lateness of the:hour;.the following items on the agenda dealing with General Plan Amendments were continued to December 9, 1980 Council meeting. There being no further business to come before the City Council, Mayor Cooper adjourned the meeting to 4:00 p.m. Tuesday, December 2, 1980.
