C -4. CLAIM AGAINST THE CITY - LINDA VERNEE LEWIS
On motion of Councilman Dunin, seconded by Councilman Settle, claim
against the city in the amount of $20,000 for damages to claimant's
reputation and emotional distress to alleged improper conduct by police
investigating officer be denied. Motion carried, all ayes.
C -5. PARKING SURVEY
Councilman Dunin indicated that he had met with the B.I.A. Board and
they have now indicated that they would be willing to share a portion
of the costs for parking survey.
After brief discussion it was moved by Councilman Dunin, seconded by
Councilman Settle, the following resolution be introduced: Resolution
No. 4623 (1981 Series), a budget resolution appropriating $5,500 for
Community Parking Project Public Information Brochure.

outlining terms of office and general guidelines for the Joint Recrea-
tional Use of.School District Property Committee.

C -7. $25,000 QUARTERLY WATER FUNDING
A. On motion of Councilman Dunin, seconded by Councilman Settle, the

agreement between the City and Cuesta Valley Properties for "Lincoln
Street Waterline ".

resolution was introduced: Resolution No. 4626 (1981 Series), a resolution

On motion of Councilman Dunin, seconded by Councilman Settle, that the

C -12. LAFCO ACTIONS
Council considered report by City Attorney on actions of the Local Agency
Formation Commission ( LAFCO) regarding annexation of certain public
streets.

After brief discussion it was moved by Councilman Settle, seconded by
Councilman Dunin, the following resolution was introduced: Resolution
No. 4634-(1981 Series), a resolution of the Council of the City of San
Luis Obispo authorizing and directing the Mayor to make application with
the San Luis Obispo County Local Agency Formation Commission (LAFCO)
to delete a LAFCO amendment to city's proposed annexation of portions
of certain public streets and to delete Post Office facility on Madonna
Road.

C -13. EROSION CONTROL PROGRAM
After brief discussion it was moved by Councilman Settle, seconded by
Councilman Dunin, that the following resolution be introduced: Resolution
No. 4629 (1981 Series), a resolution of the Council of the City of San
Luis Obispo approving an agreement between the City. and San Luis Obispo
Flood Control and Water Conservation District, Zone 9, establishing a
Cooperative Program for Erosion Control Projects within the city.

1 C -14. APPOINTMENT TO REHABILITATION LOAN COMMITTEE
On motion of Councilman Dunin, seconded by Councilman Settle, to appoint
Francine Pryer, member, and Lee Ybaben, as alternate, to fill recent
vacancy on the Rehabilitation Loan Committee. Motion carried, all ayes.
C -15. APPOINTMENT TO MASS TRANSPORTATION COMMITTEE
On motion of Councilman.Dunin, seconded by Councilman Settle, to appoint
Ruby Seigal to serve as HRC's representative to the Mass Transporation
Committee to replace Walt Lambert; term to expire 8/1/84. Motion
carried, all ayes.
C -16. BUS PASSES - DISABLED VETERANS
Request from Joe L. Cooper, retired disabled veteran, asking Council to
reconsider the senior citizen bus pass discounts to include disabled
veterans.
Councilman Dunin asked that the record reflect that he felt that disabled
veterans deserve the same recognition as senior citizens and would like
that passed on to the Mass Transportation Committee for information.
On motion of Councilman Dunin, seconded by Councilman Settle, to refer
this item to the Mass Transportation Committee for report. Motion
carried, all ayes.
' C -17. WATERLINE IMPROVEMENT PROJECT
Council considered plans and specifications for "WATERLINE IMPROVEMENT
PROJECT - OSOS STREET, PEACH TO MONTEREY ", City Plan No. E -52, bid
estimate $45,074 without contingencies.

On motion of Councilman Dunin, seconded by Councilman Settle, to approve
plans and specifications and authorize staff to call for bids. Motion
carried, all ayes.
C -18. UNITIZED HOT PATCHER BIDS
City Clerk's report of bids received for the purchase of one Unitized
Hot Patcher, bids opened September 18, 1981, bid estimate $15,500.
On motion of Councilman Dunin, seconded by Councilman Settle, the
following resolution was introduced: Resolution No. 4630 (1981 Series),
a resolution awarding the low bid to P -B Sales Company in the amount
of $17,331.

1. ABANDONMENT OF LELAND TERRACE AND BUENA VISTA STREET
Council held a public hearing to consider the final abandonment of Leland
Terrace and Buena Vista Street, north of Haskin Street on the southwest
side of Terrace Hill.
Dave Romero, Public Services Director, stated that the Engineering Division
had additional input and would request that the Council continue this
public hearing to a future date. He stated that there was no immediate
need for abandonment at this time due to lack of access and utilities
which would be provided when improvements for Tract 758 were constructed.
Mayor Billig declared the public hearing open. No one spoke for or
against the proposed abandonment. Mayor Billig declared the public
hearing closed.
On motion of Councilman Griffin, seconded by Councilman Settle, to con-
tinue the hearing to a future date for additional report by the Engineer-
ing Department. Motion carried, all ayes.
2. DOWNTOWN LOAN PROGRAM GUIDELINES
Council held a public hearing to consider recommendations from the Rehabil-
itation Loan Committee to change the Downtown Loan Program Guidelines.
Henry Engen, Community Development Director, stated that on September 18,
the Rehabilitation Loan Committee discussed the status of the City's
Block Grant Program. Representatives from the Housing Authority . presented
a status report and based on the limited success of the downtown program,
the committee studied various options of changing the program to make
it more effective, that is, attract more participants.
The Loan Committee would recommend that the Council adopt the program
guidelines for the Downtown Rehabilitation Loan Program.
Councilman Dunin questioned why there was such a lack of applications.
Henry Engen responded that he felt that the high interest rate, mixed
ownership, and the involvement with the federal government had much to
do with lack of participation.
Councilman Dunin felt that this may be possibly due to the many attach-
ments and the restrictions required by the application.

Mayor Billig declared the public hearing open.
Steve Nelson, representing the Housing Authority, stated that he would
agree with Mr. Engen and that he did not feel that Councilman Dunin
was correct in his statement that the applications were that difficult
or had that many strings attached to them.
Councilman Dunin stated he would like to have staff report back on the
reasons for the low participation by applicant.
Mayor Billig declared the public hearing closed.
Councilwoman Dovey stated that she could go along with the resolution but
would request that the third paragraph be amended to read, "Whereas, the
amendment of the guidelines is required to provide for loans to projects
within a central portion of the community consistent with the housing
objectives spelled out in the city's 1980 Block Plan application."
On motion of Councilman Settle, seconded by Councilman Griffin, the
following resolution was introduced: Resolution No. 4631 (1981 Series),
a resolution of the Council of the City of San Luis Obispo amending the
program guidelines for the Downtown Rehabilitation Loan Program as amended
by Mrs. Dovey.

Further, staff and the Committee were directed to bring back an analysis
1 and report within two weeks on the reasons for the low number of applica-
tions received.
3. FINAL MAP FOR MINOR SUBDIVISION 80 -163
Council held a public hearing to consider the final map for Minor Sub-
division No. 80 -163 combining eight lots into three lots and to reflect
abandoned Marsh Street, located at 1500, 1508 and 1540 Marsh Street;
Mayor - Schanberger, subdividers.
Dave Romero, Public Services Director, stated that staff had received
the final map and conditions of the approved tentative map had been
met. He would recommend that Council adopt the resolution approving
the final map and authorize the City Clerk to record the Marsh Street
abandonment as outlined by Resolution No. 4264 with the Mayor to execute
grant deeds as noted.
Mayor Billig declared the public hearing open. No one spoke for or against
the final map. Mayor Billig declared the public hearing closed.
On motion of Councilman Settle, seconded by Councilman Dunin, the following
resolution was introduced: Resolution No. 4632 (1981 Series), a resolution
of the Council of the City of San Luis Obispo granting approval of the
final map for Minor Subdivision SLO -80 -163, located at 1500, 1508 and
1540 Marsh Street. Further, to record Marsh abandonment and authorize
the Mayor to execute the grant deeds.

4. TENTATIVE MAP FOR TRACT 940
Council held a public hearing to consider the Planning Commission rec-
ommendation to approve the tentative map for Tract 940 to create a ten -
lot residential subdivision located at 1531 Andrews Street, R -1 -S
and A /C -40 zones; Anthony Wolfe, subdivider (continued from 8/18/81).
Henry Engen, Community Development Director, stated that on August 18
the City Council had held a public hearing to consider the proposed ten-
tative map. Following considerable testimony and discussion by the
Council, the matter had been continued to permit the subdivider and
staff to respond to some of the concerns expressed by the Council as
follows:
1. Drainage Analysis
The applicant's consultants had submitted to the City Engineer a
drainage analysis, which in effect fulfilled proposed condition
#6 of the tentative map. The conclusion was that the drainage
improvements proposed as part of the subdivision would significantly
reduce, if not totally eliminate, the current drainage impacts
around the perimeter of the tract.
2. Traffic Analysis
Wayne Peterson had received a memorandum from Dan Lloyd stating that
at full development the subdivision would add 108 trips per day to
the neighborhood which, measured at San Luis Drive and California
Blvd., results in an increase from 1450 to about 1560. This was
well within the acceptable traffic levels for single - family low -
density neighborhoods as defined in the SLO Regional Transporta=
tion Plan EIR standards.
3. Fire Protection
Wayne Peterson received a report from the Fire Department which stated
that the weeds had been abated where possible and that the Fire ,
Department remained convinced that the subdivision would enhance
fire protection capabilities in the area owing to increased water
fire flow through establishment of hydrants and improvement of
lines, together with improved access to the open space area via
flag lot #3. They did not feel that the greenbelt treatment to
lot 10 would be warranted in view of the type of fuel evident behind
that lot and the steepness of the .property. He stated that staff
would support restoring the condition proposed to the Planning
Commission which prohibited placement of structures on the open space
easement area for both fire protection reasons and for retention of
aesthetic values.
4. Building Envelope /360 Ft. Elevation
No structures would be allowed above the 360 ft. elevation which
was the water service limit and all sites would be declared sen-
sitive and.require.Architectural Review Commission approval before
development. Staff would recommend adoption of the resolution with
modification to restore the original-recommended condition #15a:
"a. No structures will be placed or erected on said premises."
Councilman Dunin stated that he was concerned with not having fire
emergency access to the back of the property and that the inlets we're::
below the flood drainage.
Mayor Billig suggested a provision be included to allow for emergency
access.
Councilman Settle stated that he was concerned that an open space ease-
ment be included both the city and county property.

Dave Romero responded that he felt that the drainage improvements would
actually improve the neighboring area rather than worsen it.
Councilman Dunin and Mayor Billig were also concerned that as many
trees as possible be saved along the creek channel where improvements
were proposed.
Mayor Billig declared the public hearing open.
A. H. Brazil, 1794 Corralitos and on the corner of Andrews Street, stated
that he was in support of this development and felt that the issue of
traffic was nonsense. He also felt that the addition of ten houses and
the improvements that would be required would help cut down the drainage
problem that presently exists, not increase them.
Rich Tietje stated that he was a neighbor and had lived in this area
for 20 years, and he did not feel that the drainage was a problem. In
fact, his only concern was parking. He would urge the Council to leave
the alley behind his property as is. He understood that most of the
property behind was going to be left in open -space which he felt un-
fortunate as he would like to be able to purchase a portion, maybe one
or two acres. He did not feel that the city needed to give the neigh-
borhood a free park.
Dan Lloyd, representing both MDW Associates and the property owner, stated
that in response to Council's concerns at the last meeting, they had
provided additional analysis as requested. With regard to fire concerns,
he stated that the city presently has a weed abatement law which should
be sufficient to see that the weeds are kept cleared regardless of
who owns the property. With regard to the removal of some of the trees
to improve the creek channel, he felt that this was necessary in order
to ensure the slowing down of the velocity of the water run off. He
had talked with the Mullers 1839 Conejo, and would plant trees to their
liking to replace those trees that will be removed.
Councilman Dunin was still concerned as to access to the hillside
property for fire vehicles.
Randal Cruikshanks, 1792 Conejo, stated he was very angry that many of
the - neighbors' and Council's questions that were brought up at the
last meeting were still unanswered. He would like the answers responded
to in writing. Three questions still not mitigated were (1) drainage,
(2) traffic, (3) fire protection. He stated there was no traffic contol
in the area which poses a very dangerous situation. He would hope that
maybe a cooperative agreement could be worked out between the city,
developers, and the neighbors which included the possibility of having
an assessment.
Michael Devitt, 1690 San Luis Drive, stated that he disagreed with Mr.
Cruikshanks and that neighbors were properly notified with flyers that
had been distributed throughout the neighborhood. He had also been a
neighbor for some time, and he had no problem with the proposed develop-
ment. He felt the neighborhood would be better off with the drainage
and fire problems presently in existence. He would urge the Council's
approval of this development.
Marian Sinsheimer stated that she did not feel there had been sufficient
cooperation from staff and the developers with the neighbors in any
attempt to alleviate their fears and concerns that this development raises.
A. V. Muller asked if he could submit a letter on behalf of Lee Balatti.
He then read the letter into the record:
"My Dear Mayor and members of the City Council: Reference is
made to proposed 10 lot hillside Subdivision 940. We live
at 1869 Corralitos Avenue and purchased our house in 1963.

Lot 10 of the proposed subdivision is immediately and direc-
tly in back of our home with the elevation on the rise up
the hillside. Last July we were two of the original signers
of the petition which opposed this proposal.
Our concerns are still the same and are briefly as follows:
1) During our 18 years at our address, we have had two occa-
sions when heavy rains have caused flooding in our home with
considerable damage to our bedroom which is adjacent to lot
10 of the proposed subdivision. Although our property is
considerably lower than the homes on either side of us, flood
waters come from the area of lot 10.
The two canyons on the slopes in back of the proposed sub -.
division form a natural basin and during heavy seasonal
rains; water cascades off the hillsides. These hills rise
over a 30 percent grade for approximately 1000 ft. Putting
10 roof taps, with carports, garages, driveways and concrete
walks will only escalate flood conditions in an area which
seems to receive more rain than other parts of the city.
Drainage arrangements should be started well above the 300 ft.
level of these hillsides.
2) Fire protection, there has been two fires on these slopes
in the past 16 years. Our concern is the ability of large
fire fighting apparatus to maneuver and effectively curtail
a fire of large properties.
3)...Earth Erosion and Unstable Hillsides: During the past
16 years, we have noticed.large amounts of dirt constantly
coming down the hillsides during average rains above the
proposed subdivision and also during heavy storms, large
areas have become dislodged. Respectively submitted, Mr.
and Mrs. Lee Balatti."
He then read into
the records his own
letter which was dated October 6.
"Dear Mayor
Billig and Council
Members:
I own the home
property at
1839 Conejo Avenue,
San Luis
Obispo, California.
This ownership dates back to 1956.
This
present letter
reflects my
concerns and views
relative
to the protection
of my home.
Easterly of us is a small cree$. In heavy winter rains
water comes cascading down it, mainly from two steep canyons
above and situated on the property of the proposed subdiv-
ider, Dr. Wolf. In his preliminary map he discloses his
plans, work details and memoranda for a new subdivision.
In them he indicates, among other things:
1) A row of trees as all being just beyond the easterly
line of my property. This is not true. It would be helpful
if the subdivider or the City Engineer, after survey, would
put iron stakes upon the ground to clarify the precise loc-
ation of this line. A like step should be taken with refer-
ence to the southern boundary line of my property.
2) His intention to substitute the.smail, natural creek bed
through which, since time immemorial, overflow water from
the mentioned canyons has been permitted to run. He wants
to bulldoze a new ditch outlet approximately 12 feet wide,
a mere 2z feet deep, and a distance of only two feet from
the easterly boundary line of my home. The natural creek
bed runs parallel with my property and approximately 15 ft.
from my property line.
It may well be that such a water diversion would make Dr.
Wolf's subdivision more valuable, but at my expense. I cannot
subscribe to such an arbitrary, capricious and wholly uncon-
scionable action.

The grounds for my position are quite simple:
1) The trees along my easterly boundary provide a root system
which now protects against erosion.
From what has been said, it would appear that it would be
in the best interests of all concerned that an adequate all
weather pipeline be buried by the subdivider along the center
line of the existing creek, or that it be permitted to con-
tinue to handle overflow waters from the above mentioned
canyons as it has been doing for many years last past.
A water problem also presents itself along the back of my
property. The subdivider intends "to run a concrete ditch
along the back of my property to carry off part of the water
flowing down the two canyons mentioned above. Inside of
my fence and within about 30 inches of the property line, I
have one large avocado tree, a large lemon tree, a large pine
tree and a tall Hollywood Juniper. By bulldozing along the
fence line, the subdivider could very well destroy the roots
of these trees, which could also destroy the trees themselves.
The lemon and avocado trees both have a shallow root system.
I.am fearful that at times of heavy sudden rainfall the
run off of water from both canyons would quickly converge
at the easterly corner of my property. Without a catch
basin to slow down and accumulate the water where it would
make a 45 degree angle turn, it could easily run over the
drainage ditch, push over the back fence of my property,
and flood my backyard and house. The drainage system for
the subdivision should be so planned that such sudden rain-
fall is properly handled, not only by the existing creek
but by providing an adequate catch basin for the protection
of all properties below the subdivision.
The concrete drainage ditch running along the rear of my
property should have the northerly part thereof protected
by a steel- reinforced concrete wall five feet high with an
adequate foundation base of at least three feet. This ditch
should be located at least 20 feet beyond my property line.
May I be privileged to suggest that notes appropriate to my
above requests and suggestions be added to any final map that
' may be approved and ordered filed in response to the presently
filed application for the formation of a new subdivision em-
bracing lands adjacent to my home?
Additionally, your files will indicate that I am one of the
neighbors opposed to the subdivision, as disclosed by a letter
dated August 11, 1981, and which has been filed with you.
Respectfully submitted, A. V. Muller."
He would urge the Council to address these concerns prior to giving tenta-
tive map approval.
2) Bulldozing as requested would only present environmental
problems, but could very well mangle and tear out the pro-
tective root system of my trees, with their ultimate destruc-
tion as well.
3) The existing creek is evidence of the presence of a soil
capable of erosion. The existence of a clump of trees, which
was planted or permitted to grow there, indicates a desire
by the proposed subdivider, or of antecedent property owners,
to combat this erosion problem by slowing down the natural
speed of water flow through the creek.
4) Should the proposed new ditch be permitted, who will
supervise its construction and maintenance? Who will protect
my property against health and accident hazards and who will
protect my property from erosion damages and /or undercutting
and flooding? The City?
From what has been said, it would appear that it would be

Anne Cruikshanks stated that she felt that this would have a severe
impact on the neighborhood.'s Prevention Program, with the additional
traffic, and she was also concerned about the drainage.
Ruth Bostrom, 1933 San Luis Drive, stated that she was supportive of
the development. She felt it was unfair of the neighbors to expect
the development to take care of problems that were already in existence
when these people bought their homes. The fire protection and drainage
problems have always been there. She felt this was a good development
and that it was going to help mitigate some of these problems, and
she urged the Council's support.
Fred Hamlin, 1767 Conejo, felt that the problem of drainage should
be left to the engineers and that Council should accept their word
that the drainage problems would be decreased. He also felt that the
traffic and fire objections were not real.
Steve Nelson, 1868 Corralitos, stated that he was supportive of the
project for several reasons. He stated that this proposal was much
better than those before it, had lower density, and, as he himself
was a neighbor, he looked forward to it coming into the area. He
felt it was going to help problems such as fire and drainage. The
developer was paying for enlargement of a water line which had been
inadequate for years. Further, he felt a property owner should be
able to do, within restraints, what he wanted with his own property;
and he would urge Council's support. As another side issue, he would
like the Council to address the problems of sidewalks in the area, as
there are none there now, and he felt that it was presently unsafe.
He would hope that possible stop signs, speed bumps, etc., could be
installed to help slow the traffic down.
Dan Lloyd, MDW, in response to Councilman Settle's question regarding
the sewer pump, stated he would like to see condition #3:amended to allow
a sewer pump on Lot 10 if desired.
Keith Crowe, Central Coast Engineering and the Drainage Analyst, resonded
to the drainage issue. He felt that this would create only a marginal
increase.in water run -off, which was not a marked difference as far as
city requirements at all, and was within one percent allowed under county
requirements.
Doug Flaherty, Fire Marshall, stated that the Fire Department was extrem-
ely satisfied as to the fire protection measures. He did not feel this
area was conducive to the endangerment of any of the neighborhood homes
as this was not a high fuel, a difficult brush area like that in
Southern California areas.
Mayor Billig declared the public hearing closed.
9:05 p.m. Mayor Billig declared a. recess. 9:30 p.m. City Council recon-
vened, all Councilmembers present.
Dave Romero, Public Services Director, responded to Mr. Muller's concerns
regarding the trees, drainage channels, traffic, etc.
Councilman Dunin.stated that he felt that the majority of the neighbors
were not against this project. He did feel that the creek was a part
of the problem, but the water run -off he felt was minimal; he felt
the Fire Department was remiss in the past regarding weed abatement
but would expect that this does not continue in the future. He felt
that with the added greenbelt it would be sufficient although he did
still have some concerns regarding Mr. Muller's comments. Wherever
possible, Councilman Dunin would like to see that the trees remain and
that the drainage channel would be moved further away from the property
line. He felt that the traffic problem would be mitigated with proper
signing and speed limits enforced. He would still like to see another
joint meeting between the neighbors, the developer, and staff in a
last effort to convince the neighborhood that their fears were no
longer warranted.

Councilman Griffin stated that he supported the project and concept.

felt the 25 conditions now required by the developer were sizeable.
He felt that the traffic was not a problem but felt that a comprehen-
sive traffic analysis might be appropriate later on. He felt the
drainage problem still needed to be addressed.
Councilman Settle felt that many of these problems had been here for
some time and this development could not be expected to mitigate all
of them. He would like to see a fire break behind the homes. He
felt the drainage should not be diverted. Homes should be subject to
ARC review. Structures should not be constructed in the open -space
area and the easements should be both within and outside the city
limits. He would like to see lots 9 and 10 combined, but he could
approve the project with those modifications.
Councilwoman Dovey, stated that she felt that this area already had
many problems of long- standing but that this project would help to
mitigate many of them to a large extent. Further, the developer would
be paying for these.Inprovements,-not the neighbors. She would like
to see Section 113 of the resolution remain the same, with possibly
the addition of adding a provision that any house built on lot 10
be required to build at the southern end of the lot, with plumbing
located in such a manner as to avoid necessity of sewer pump on site.
She would like to see condition 1115 changed to add the open space,
to include the county area, and to also put back in condition 1115a
with the exception that the approval be made by the Community Devel-
opment Director as opposed to the ARC. She would expand condition
4116 that measures be taken to keep the trees wherever possible and
would also not like to see drainage diverted on lots 4, 5, 6, 7, and 8.
Councilman Griffin stated that he supported the project and concept.

making the following changes: Condition 116,.add the following at the
end of the paragraph to read, "and, at the discretion of the City Council,
may be required to participate in other off -site drainage improvements."
Condition 418, add a sentence at the end to read, "A buffer of fire resis-
tive planting shall be provided between the open space easement hillside
area and lots 3, 4, 5, 6, 9, 10 and the rear lot lines of developed pro-
perties along Corralitos Avenue (Lots 9 through 20 of Tract 43) to
the approval of the Fire Department and Community Development-Department."
Change Condition 1115 to read, "...(95.9 acres both in and outside of the
city) subject to the approval..." Add Condition 1115a. back into read
as follows, "No buildings will be placed or erected on said premises and
no structures, except as permitted hereafter, without the approval of
the City Council." The first sentence of Condition 1116 changed to read
as follows, "The drainage structure along Lot 9, and the grading to the

the undeveloped property-both in and outside of the city should be in
the open space. Add back in condition 4115a. She felt the building
envelopes should be closely defined and have minimal grading. She
felt that the downstream flooding was still a real concern. She would
like to see the maintenance program on clean out of drainage channels
start earlier in the year. With regard to the creek overflowing, she
felt that a possible assessment district might be the answer and add
it to the CIP. She suggested that staff relook at the pipe near Alisal
and possibly make that larger,spliting the cost between the city and
the neighborhood. She would like to see all the sewers be gravity
flow, not pumps.
The Council then took Section 413, Conditions 111 through 25, one by one,
making the following changes: Condition 116,.add the following at the
end of the paragraph to read, "and, at the discretion of the City Council,

Condition 1120 changed to read as follows, "Subdivider shall install
such on and off -site control /safety signs and on -site street lights
as required by the City Engineer." Condition 1125 to be amended as
follows, "Sidewalks along Andrews Street extended, and Conejo Avenue
cul -de -sac frontage of the tract, are hereby waived." Condition 1126
added to read as follows, "Buildings within the tract shall be located
within the building envelopes shown on Attachment 2."

a resolution of the Council of the City of San Luis Obispo granting
approval of the tentative map for Tract 940 located 1451 Andrews Street

5. GENERAL PLAN AMENDMENT (GP 0974) - LOS VERDES
Council held a public hearing to consider the recommendation by the Plan-
ning Commission to amend the Land Use Element map, conservation/agricul -
ture to interim agriculture, and text to establish certain prerequisites
for eventual residential use, for land between Los Verdes and San Luis
Obispo Creek; City of San Luis Obispo, applicant.
Henry Engen stated that on September 10 the Planning Commission voted
3 -0 to recommend approval of the amendment.. He stated that while the
Commission and the Council had initiated this application with even-
tual low- density residential use in mind,.after the property owner
objected at the public hearing, the Commission decided not to specify
the density. Commission did not want to include in the policies a
prerequisite that fire protection for any residential project be approved
by the Fire Marshall.
Mayor Billig declared the public hearing open.
Dan Lloyd, MDW and representing the property owner, urged the Council's
support of the project and stated that the subdivider had no problem
with the suggested change.
Clyde Hostetter, 48 Los Palos Drive, stated that his concern was that
this property should be left as a residential area and would urge Council
to support that.

After brief discussion it was moved by.Councilman Dunin, seconded by
Councilwoman Dovey, the following resolution was introduced: Resolution
No. 4635 (1981 Series), a resolution of the Council of the City of
San Luis Obispo amending the Land Use Element of the general plan to
change the designation of a portion of the land between Los Verdes and
San Luis Creek from conservation /agriculture to interim conservation/
open- space, as recommended by the Planning Commission with the area
to be precisely defined based on final Engineering report to be
prepared regarding flood line limit; city to maintain a sizable ease-
ment to the creek; and prerequisites to include: 1) flood control,
2) fire protection, and 3) equitable financial contribution to cost of
Los Osos Valley Road overpass - connection.

6. GENERAL PLAN AMENDMENT (GP 0937) - HUMAN SERVICES CENTER
Council held a public hearing to consider a recommendation by the Planning
Commission to amend the Land Use Element policies to allow utility com-
pany offices within the area plan for a consolidated social services
center at 3190 -3230 South Higuera Street; Walter Brothers Construction,
applicant.
Henry Engen, Community Development Director, stated that the Planning
Commission of September 10 voted 3 -0 to recommend approval of the amend-
ment. He noted that if the Council approved the amendment that they
also initiate a change to the Zoning Regulations' Text to permit utility
offices within the PF zone.
Mayor Billig declared the public hearing open.
Sandy Merriam, MDW, reviewed the history of the project going back to
1978 and, subsequent -lease that the county signed to eventually lease
21,OOO.sq. feet of the Walter Bros. Building. He felt there was general
sentiment by the county and the city that the primary complex county -
buildings be left downtown with the Human Services offices being allowed
to move into this building. He stated that with the recent recession,
the county.had had severe financial cutbacks. The County Administrative
Officer was now indicating the county may be unable to lease what they
had originally agreed to. Hence, they were requesting this change to
allow utility companies to also lease a portion of the building sites.
Don Walters, applicant, added that the county had given themselves an
out in the lease stating that they could renege if financial cutbacks
were imposed.
Councilman Dunin states that he did not wish to put the city in the
position of bailing out the developer who may have made a mistake which
was what he felt was the situation.
Mayor Billig declared the public hearing closed.
On motion of Councilwoman Dovev, seconded by Councilman Griffin, to deny
the amendment to allow utility companies in the Social Services Center.
Councilman Dunin suggested that possibly other businesses be allowed
here on a temporary basis, but he would not support utility companies
as he feels that they are rightfully in the downtown area where they
are most convenient for the citizens.
Councilman Settle felt that this situation posed extreme economic
and extenuating circumstances, and he would favor allowing the utility
companies to come in.
Councilman Griffin felt that the burden should be on the proponent.
He would not support changing the zoning regulations to allow for this.

Councilwoman Dovey said that she felt this was totally an inapprop-
riate proposed use. She felt the Human Services complex should have
related groups in the same buildings, afraid of setting a precident to
allow in other areas this same sort of thing. She felt that-the utility
companies could back out as easily as the county did and then where
would the developer be. She suggested that maybe this area should be
designated something entirely different.
Mayor Billig stated that..this problem goes back a long way. She was
on the Planning Commission when they first made this concession in an
effort to cooperate with the county. She felt the city had been con-
sistent with what they have wanted in this area. She did not feel
the utility companies were quasi - public. She did not feel this was
a city problem. To change the zoning regulations every time a prop-
erty owner made a bad investment, would make our laws meaningless.
She also suggested that maybe the cost for the square footage was too
high. She felt strongly that this should be a human services center.
She was not supportive of the Social Security building being where it
was on Los Osos Valley Road and would encourage the county to take as
much space as possible in this building for human services uses.
Henry Engen stated that he had written the county informing them that
many of their temporary -use permits could be pulled hoping that this
would encourage them to go into Mr. Walters' complex. He stated that
the Board of Supervisors should be _hearing this request within two
weeks.. It was suggested a letter be sent to the Board of Supervisors
with a clear message explaining the city's position.
Mayor Billig stated that when several of these businesses had their
temporary -use permits renewed, they were given a clear direction at that
time that they would only be renewed for a limited amount of time, so
they should have been looking for other permanent areas.
Councilman Griffin suggested that the city put the county on notice
of its intention not to renew the temporary -use permits in the future
and direct staff to write the letter stating Council's concerns.
On motion by Councilwoman Dovey, seconded by Councilman Griffin, to
deny requested amendment to allow utility companies in the Human
Services Center. Motion carried, all ayes.
On motion of Mayor Billig, seconded by Councilman Settle, to reaffirm
previous Council position that temporary -use permits of Human Services
properties currently in the city having be allowed to be expired as
originally designated. Motion carried, all ayes.
7. GENERAL PLAN AMENDMENT (GP 0938) - HIGUERA COMMERCE PARK
Council held a public hearing to consider the recommendation by the .
Planning Commission to amend the Land Use Element to change the desig-
nation of about 30 acres east of South Higuera Street and north of
Tank Farm Road from interim agriculture to service commercial /light
industrial; Robert Hibshman, applicant.

Shauna Sullivan, Miller and George, and representing Mr. Richard Warner,
stated that Mr. [darner was appealing the San Luis Obispo City Planning
Commission approval of and transmittal to the City Council of this gen-
eral plan amendment 0951. Mr. Warner was appealing the introduction
and initiation of this general plan amendment at this time as the dec-
ision and the action Warner vs. City of San Luis Obispo in court case
No. 54959 was still pending. On behalf of Mr. Warner, she submitted
that the City should not act on this general plan amendment until.a
decision had been rendered in the Superior Court action or that the .

Upon question,George Thacher, City Attorney, stated this was basically
an interpretation question to be decided by the courts, but he did not
feel that the court's decision would reflect any decisions made..by the
Council on the remaining general plan amendment.
Mayor Billig declared the public hearing closed.
On motion of Councilman Griffin, seconded by Councilman Settle, the fol-
lowing resolution was introduced: Resolution No. 4643 (1981 Series),
a resolution of the Council of the City of San Luis Obispo amending the
Land Use Element of the general plan to adjust the boundary between
residential and office designations.

15. ORDINANCE NO. 905 - REZONING PORTIONS OF D014NTOWN CENTRAL BUSINESS AREA
Council considered the final passage of Ordinance No. 905, an ordinance
amending the official zone map of the City to rezone property . in the
Central Business Area from C -R to C -C.
Mayor Billig declared the public hearing open. No one spoke for or
against the proposed final passage. Mayor Billig declared the public

16. CORPORATION YARD ARCHITECTURE CONSULTANT
Council considered a report by Public Services Director recommending staff
negotiate with Ross, Levin & MacIntyre for contract to provide archit-
ectural services on the Corporation Yard.
Dave Romero, Public Services Director, stated that the City had sent
letters to all the local architectural firms and the American Institute
of Architecs soliciting proposals for professional services for the
Corporation Yard design. Five firms had submitted proposals and of
those, two firms were not further considered due to lack of experience
in either metal building or corporation yard design. On September 22,
Bill Hanley, Henry Engen, and himself.sat as a committee to interview
MDW, Richmond, Ross and Montgomery, and Ross, Levine and MacIntyre.
Each firm gave a 45- minute presentation, and the conclusions of the
committee were that Ross Levine MacIntyre presented the best combination
of experience and capability. The committee has recommended that the
Council authorize staff to negotiate with Ross, Levine & MacIntyre for
the contract to provide architectural services.
There was brief discussion on the method

Council considered the six -month review of the Energy Element adopted
on April 7, 1981.
After brief discussion it was moved by Councilwoman Dovey, seconded by
Mayor Billig, to approve the suggested additions and changes in the
language of Energy Element. Motion carried, all ayes.
COMMUNICATIONS
C -1. REVIEW OF SLO COG POLICIES
After brief discussion Mayor Billig was authorized to work with Council-
woman Dovey, to write a letter to SLO COG reflecting the Council's policies
on five items outlined in COG's letter dated 9/10/81. Motion carried, all
ayes.
1:15 a.m. Council convened to Closed Session. 2:10 a.m. City Council
reconvened, all Councilmembers present.
