The Safe Night Life Committee of the Downtown Association had previously reviewed and discussed the regulations, particularly looking closely at the deemed approved ordinance, and advanced the recommendation supporting the regulations in general to the Board. Some specific concerns addressed regarding the deemed approved ordinance included vague or non specific language, qualifications of the hearing officer and interpretations of the language should circumstances in Downtown change, i.e. residential or hotel uses being built near existing entertainment locations. However, after an in depth discussion today including the Safe Night Life Committee chair, coordinator and members, as well as city staff from the community development department, the Board felt a one year review after implementation would provide an opportunity to address any concerns that might be warranted and that moving forward at this time with the ordinance `as is' demonstrates a sincere willingness to continue the efforts to reduce problems associated with alcohol outlets in Downtown. Moreover, the Downtown Association acknowledges and appreciates being included as a review partner in the process as described in the ordinance.
