Re: Alcohol Outlet Regulations (Ordinance 2nd Reading)
At a special meeting held today, the San Luis Obispo Downtown Association Board of
Directors voted to recommend that the Council revise the language in the Deemed
Approved Ordinance to include the Downtown Association as a peer review panel when
it is determined a violation by a Deemed Approved Activity has occurred.
This inclusion was primarily the basis of the Board's support when the ordinance came
before Council on May 15, 2012.
The Safe Night Life Committee and the Board believed that this inclusion provided a
show of trust, collaboration and would signal a green light for the Committee to move
forward with its recruiting efforts, programs and fundraising.
After learning that the Downtown Association would be eliminated from the ordinance
and denied a codified opportunity to work one -on -one with its members prior to an
appearance before a hearing officer, the Board and Committee chose not to be
discouraged but to instead, take this opportunity to provide Council with additional
insight as to why the original language should be returned to the ordinance tonight.
1) The Safe Night Life Committee is fully committed to reducing problems
associated with alcohol in the Downtown. To this end, they have officially formed, met
twice monthly and recruited nearly a third of those who hold alcohol licenses in
Downtown SLO. In order to continue recruitment efforts, the Committee must have the
tools it needs to demonstrate to other business owners the value of joining the Committee
and paying the annual dues. Being a partner with the City in the review process lends
credibility and significance to the Committee's efforts to ultimately attract licensees —not
always an easy job.
2) Further, the formation of the Safe Night Life Committee showcases a unique
situation in regard to a community's response to a problem issue. The outcome of
stakeholder meetings and other efforts to identify and address problems associated with
alcohol outlets, primarily in the Downtown, was that this very type of effort — programs,
education, self - policing by the licensees themselves — should be implemented along with
regulation to achieve results. This group has done everything it has been asked to do and
feels it should be involved at every level not only in preventing problems but also in
working to resolve them.
Therefore, the Downtown Association Board of Directors urges the Council to revise the
ordinance to include the Downtown Association as a peer review panel and continue the
goodwill and progress made by the Safe Night Life Committee to date.
