HomeMy WebLinkAbout06-19-2012 B1 CashAGENDA CORRESPONDENCE Date �I 12 Item# (T 12 June 2012 To: Mayor Jan Marx and City Councilmembers From: Deborah Cash, Executive Director SLO Downtown Association Re: Alcohol Outlet Regulations/Deemed Approved Ordinance RECEIVED JUN 14 2012 SLO CITY CLERK The SLO Downtown Association (DA) Board of Directors at its regular meeting on June 12, 2012 reviewed the revised language in the Deemed Approved Ordinance as developed by City Staff following the direction of the Council at its June 5 meeting. In a unanimous vote of support, the Board recommended that Council adopt the revised ordinance that the Council will consider on June 19. The Board believes the revised language clearly defines that the Downtown Association will NOT engage in enforcement activities but will provide only the opportunity to meet with a Downtown business against which a complaint has been filed and review the facts underlying the complaint and develop input to be conveyed to the Administrative Hearing Officer. Participation in the peer review process is entirely voluntary by the establishment against which a complaint has been filed. Moreover, the revised language indicates that the Administrative Hearing Officer is not bound by any recommendation offered by the DA, nor shall the DA's process delay the public hearing. As well, the Board believes inclusion of a DA peer review step will be effective in attracting those Downtown business owners who hold alcohol beverage permits to the ranks of its Safe Night Committee where they can become part of the solution to late night issues in the Downtown. It is the hope and desire of the DA that Downtown become a safe, enjoyable, attractive commercial district for all persons at any hour of the day or night. To that end, the DA has demonstrated a willingness to work with its members, the community and the City to ensure policies and programs are in place that will achieve this desired goal. On June 19, we ask that Council continue the collaboration and mutual effort and vote in favor of the revised ordinance.
