Director COUNCIL MEETING : aG L1, 10, S ITEM NO. _ RN l June 22, 2015 Katie Lichtig, City Manage Items Related to approval of the 2015 -17 Financial Plan and 2015 -16 Budget Adoption Staff has identified an additional item that requires the Council's authorization for inclusion in the approved 2015 -17 Financial Plan and one matter that requires a separate action by the City Council in order to avoid the appearance of a conflict of interest by Council Member Dan Rivoire. These items are outline below. The proposed budget resolution did not include as an amendment to the Preliminary Financial Plan the shift of the Human Relations Commission Program from the Human Resources Department to the Community Development Department (CDD). There is no change to the budgeted costs reflected in the Preliminary Financial Plan and staff believes that this is a better placement for this program given CDD's involvement with similar grant and program monitoring activities. The City Attorney is advising that a separate action is warranted to adopt a small segment of the Transportation Planning Division's budget. A small portion of the Division's budget (up to $10,300) is for bike education and outreach. A contract for 2015 -17 with the San Luis Obispo County Bicycle Coalition (SLOCBC) to provide services that would be funded by a small portion of the proposed budget. This contract is currently making its way through the City Manager approval process. The City Manager Report explicitly includes a provision that the City's payment obligations under the contract are subject to Council approval of funding in the 2015 -17 Financial Plan. To avoid any appearance of a conflict of interest, Councilmember Rivoire is recusing himself from consideration of the portion of the budget that would fund the proposed contract if approved by Council. The conflict of interest rules require disclosure of the potential conflict and that the subject matter be segmented from the rest of the budget and considered prior to discussion of the broader budget issues and finally resolved by the Council without Councilmember Rivoire's participation. Attached to this memo is a Resolution to facilitate Council's separate consideration and final action on this small portion of the budget that is related to the proposed contract with SLOCBC. Attachment: Resolution allocating funds in each fiscal year of the 2015 -17 for transportation and planning engineering contract services and, of those funds, an amount not to exceed $10,300 shall be allocated annually for Bicycle Safety Education Services. RESOLUTION NO. (2015 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO, CALIFORNIA, ALLOCATING FUNDS IN EACH FISCAL YEAR OF THE 2015 -17 PRELIMINARY FINANCIAL PLAN FOR T'RANSPORTAT'ION PLANNING AND ENGINEERING CONTRACT SERVICES AND, OF THOSE FUNDS, AN AMOUNT NOT TO EXCEED $10,300 SHALL BE ALLOCATED ANNUALLY FOR BICYCLE SAFETY EDUCATION SERVICES WHEREAS, the City wants to promote and sponsor programs and events designed to teach adults and children safe riding methods and the benefits of bicycling as called for in the 2013 Bicycle Transportation Plan; and WHEREAS, the Preliminary 2015 -17 Financial Plan (Page C -16) identifies a multi - modal transportation City goal, which includes the task of continued bicycle education activities; and WHEREAS, the Preliminary 2015 -17 Financial Plan (pages E -80 through E -83) describes the Transportation Planning and Engineering operating program that includes educating the public on traffic safety, a portion of which is dedicated to contract service toward alternative transportation services, materials, and promotion; and WHEREAS, the Preliminary 2015 -17 Financial Plan (pages E -80) allocates Contract Services funding for Transportation Planning and Engineering of which an amount not to exceed $10,300 is intended for providing bicycle safety education services to the City; and WHEREAS, the San Luis Obispo County Bicycle Coalition ( SLOCBC) has successfully provided bicycle safety education services to the City in the past and has submitted a proposal for staff and City Manager consideration to continue providing such services through the 2015- 17 financial planning period; and WHEREAS, Councilmember Dan Rivoire is recusing himself from consideration of the budget allocation that would be anticipated to fund such a contract for services with the SLOCBC due to his position as SLOCBC's Executive Director; and WHEREAS, conflict of interest provisions permit the Council to act on the budget item without Councilmember Rivoire's participation provided that the item is finally acted upon prior to the full Council's consideration of the complete 2015 -17 Financial Plan and Budget adoption. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that the 2015 -17 Financial Plan shall allocate funds in each fiscal year for transportation and planning engineering contract services and, of those funds, an amount not to exceed $10,300 shall be allocated annually for Bicycle Safety Education Services.
