HomeMy WebLinkAbout08-18-2015 Item 10 Johnson Aviation Scope of Work Meeting Date: 8/18/2015 FROM: Derek Johnson, Community Development Director Prepared By: Kim Murry, Deputy Director, Long Range Planning SUBJECT: AMEND SCOPE OF WORK WITH JOHNSON AVIATION TO PROVIDE TECHNICAL ASSISTANCE TO CITY DURING COUNTY UPDATE TO AIRPORT LAND USE PLAN RECOMMENDATION Authorize the Community Development Director to sign a contract amendment to amend the scope of work of an existing contract with Johnson Aviation for an amount not to exceed $50,000 in fiscal year 2015-16 and $50,000 in fiscal year 2016-17 to provide technical assistance to the City during review of the County’s update to the San Luis Obispo County Regional Airport Land Use Plan. DISCUSSION Background Nick Johnson of Johnson Aviation has been assisting the City since 2010 in developing technical information related to the update of the San Luis Obispo County Airport Land Use Plan, and how safety and noise issues associated with airport operations affect land use in the City. This information was especially important during consideration of policy and development scenarios during the Land Use and Circulation Elements (LUCE) update. The Airport Land Use Commission (ALUC) is currently in the process of updating the Airport Land Use Plan for the San Luis Obispo County Regional Airport (ALUP) and, once updated, Government Code Section 65302.3(b)-(c) provides 180 days for the City to either update its General and Specific Plans to be consistent with the ALUP, or take action to overrule the update. The City is participating in the ALUP update process and continuing to provide technical information for consideration by the Airport Land Use Commission (ALUC) to ensure that the updated ALUP is based on data and state of the practice for land use planning around airports. In the past, these discussions have focused on questions about the safety zone dimensions that affect underlying land use restrictions, and whether or not the zones are properly based on the local conditions that affect aircraft operations. The ALUC’s current published draft plan shows certain safety zones shifting and expanding in ways that could further impact development capacity for the southern area of the City while providing no measurable safety benefit. This shift would impact the development potential of areas currently addressed in the Airport Area Specific Plan as well as portions of the City outside of that area (Caltrans site at Madonna and Higuera, and San Luis Ranch property, for example). In addition, the ALUC’s previous support 10 Packet Pg. 94 for expansion of safety zones to the west of Runway 7-25 (the smaller of the two runways) will result in limitations to development on the Avila Ranch virtually eliminating consideration of residential potential on this property (as called for in the Land Use and Housing Elements) unless an override is approved by a 2/3 City Council vote. The City’s previous overrule of the Airport Land Use Commission’s determination of inconsistency for the LUCE update affected lands in the City currently zoned and able to be developed without need for zoning or general plan changes. New or amended specific plans or areas subject to general plan or zoning changes are required to be referred to the ALUC for review and determination of findings of consistency or inconsistency. Implementation of the LUCE will require subsequent reviews by the Airport Land Use Commission and it is to the benefit of the City, the larger community and the ALUC to have plans that are closely aligned. Airport Land Use Plan Update – moving forward In order to be active participants in the ALUP update, it is imperative that the City be well- informed and able to have constructive discussions of differences based upon data-supported and technically accurate information. While the City and ALUC may have areas where policy differences exist, the discussions should start from an agreed upon set of technical facts and how they are applied in the local environment. An example of a positive outcome using this type of approach was evidenced when the County hired its own consultant (for which the City shared the cost) to generate noise contours associated with future operations for use by the ALUC in the draft ALUP. With the technical support of Johnson Aviation, the City was able to participate with County staff to request the contours be generated based on the Airport Master Plan/Layout Plan, as required by the State. And, while the ALUC did request a 40-year timeframe rather than the 20 years projection based on the Master Plan, even with the inclusion of noisier narrow body jets added to the fleet mix, the noise contours more closely align with the noise contours evaluated as part of the Airport Master Plan EIR. This outcome is a vast improvement over the current ALUP noise contours, which are based on a hypothetical assumption that does not meet State guidance as evidenced in the California Airport Land Use Planning Handbook. Aeronautical and airport land use planning is a highly specialized field of land use planning. The City needs highly-specialized assistance so that participation in the ALUP update has positive outcomes including meeting the California Airport Land Use Planning Handbook, addressing local conditions as appropriate, and having an Airport Land Use Plan that is supportable and meets the needs of both the aviation industry and the community. Adoption of the ALUP will require the City to either revise its land use designations and zoning to be compliant or to overrule again. As a result, active and informed participation in the ALUP update is vital. Contract Amendment Johnson Aviation is uniquely suited to provide this technical support as the principal has been involved in the LUCE update, has evaluated the local conditions, and is an expert in airport land use planning. Johnson Aviation was originally selected through a proposal process. The consultant provided a quality and responsive proposal based upon the understanding of the required work from the City. The consultant has demonstrated ongoing competence in the area of 10 Packet Pg. 95 aeronautical and airport planning and the necessary professional qualifications. The consultant began work with the City in 2010 and has provided ongoing guidance related to airport issues and is uniquely familiar with the City’s General Plan, the San Luis Obispo County Airport Land Use Plan (ALUP), Airport Master Plan, and State and Federal Guidelines governing the operations and planning of airports. There are a limited number of qualified consultants that provide these services that have the professional background and experience to work on complex regulation of land uses affected by airport operations. The attached scope of work to amend the existing contract with Johnson Aviation estimates the cost for on-going service during 2015-16 to be $50,000. The approved 2015-17 Financial Plan includes $50,000 for this assistance in each budget year 2015-16 and 2016-17. Staff recommends Council authorize the Community Development Director to sign a contract amendment for 2015- 16 for an amount not to exceed $50,000 and to authorize the Community Development Director to sign an additional contract amendment with Johnson Aviation for 2016-17 for an amount not to exceed $50,000 in the event such technical assistance is still required. CONCURRENCES The City Attorney concurs with this approach to address airport planning. ENVIRONMENTAL REVIEW Environmental review is not required for hiring a consultant. The County will be required to conduct environmental review of the updated Airport Land Use Plan and Johnson Aviation will provide assistance to the City in responding to that determination. FISCAL IMPACT The proposal entails $50,000 in costs for consultant services in both 2015-16 and 2016-17, if necessary. This funding was approved as part of the 2015-2017 Financial Plan for consultant services. ALTERNATIVES 1. The City Council could wait until the ALUC gets further along in updating the published draft Airport Land Use Plan to determine whether additional consultant services are needed. This approach is not recommended as early participation in the update process (i.e. noise contours) has been effective in ensuring information used to update the Airport Land Use Plan is data-supported. WITNESSETH: WHEREAS, on June 23, 2010 the City entered into an Agreement with Contractor for consultant assistance to the City in connection with the San Luis Obispo County Airport Land Use Commission’s update of t he San Luis Obispo Airport Land Use Plan; and WHEREAS, the City desires to amend the scope of services to better address the information and work needs for Johnson Aviation to advise the City regarding Federal and State regulations as well as best practices in airport land use planning as the Airport Land Use Commission proceeds with their work effort; and WHEREAS, on June 23, 2015, the City Council approved the 2015-2017 Financial Plan which included $50,000 for aviation consultant services in FY 2015-2016; and WHEREAS, the Community Development Director has requested Johnson Aviation amend the scope of work for an amount not to exceed $50,000 for FY 2015-16; NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained, the parties hereto agree as follows: The revised scope of work services and costs as described in Tasks 6.1 through 6.4 in the attached letter dated June 30, 2015. The purpose of this Amendment 6 to the Agreement is to support the City with professional services and advisement regarding Federal and State regulations and best practices in airport land use planning. These services would be provided in conjunction with the Airport Land Use Plan (ALUP) update in coordination with the San Luis Obispo Airport Land Use Commission (ALUC) as a result of the Land Use and Circulation Element (“LUCE”) Update of the City’s General Plan, related technical work and conformity determination process with the San Luis Obispo Airport Land Use Commission. The schedule for these services would be during the City’s Fiscal Year 2015-2016. We are immediately available to begin work on the project. Proposed Amendment 6 Scope of Work The following is a list of tasks necessary for the project based upon our discussions. These tasks are followed by a preliminary schedule and budget for each task.  Task 6.1 Federal and State Airport Land Use Regulations: Consultant will provide research, analysis, expert advice and recommendations to City Staff regarding general and specific airport land use regulations. Topic areas within this task are likely to include issues that arise with regard to aviation and airport planning, aircraft noise, aircraft overflight, aviation safety and airspace protection. Task 6.1 Meetings: Assumes 12 conference calls to coordinate with City Staff and attendance at 4 meetings. Deliverables: Produce and/or review and provide technical input to airport land use planning analysis and documentation, technical memos and presentation materials.  Task 6.2: Coordinate with City Staff, GIS, City Council: Consultant will meet with the City staff and the San Luis Obispo City Council to address airport land use planning, requirements as requested. City staff will provide guidance and authorization for any services performed under this task. Task 6.2 Meetings: Assumes 5 conference calls to coordinate with City staff. Deliverables: Review and technical input to airport land use planning analysis and documentation, technical memos and presentation materials.  Task 6.3: Coordinate with ALUC Subcommittee, County Airport Staff and Technical Consultants: Consultant will meet with the ALUP Subcommittee of the SBP ALUC to cover specific technical airport land use planning requirements. These meetings would cover the ALUP Update that is currently underway by the ALUC Subcommittee as directed by the ALUC. City staff will provide guidance and authorization for any services performed under this task. Specific tasks include review and comment on technical noise analysis assumptions and any future related technical work completed by consultants to the County of San Luis Obispo or the ALUC. Task 6.3 Meetings: Assumes 6 conference calls. Deliverables: Technical review and comment of analysis and related aviation noise and safety materials; technical analysis and computations to support factual conclusions and recommendations.  Task 6.4: Coordinate with ALUC: Consultant will meet with the ALUC to cover airport land use planning requirements. These meetings will cover the ALUP Update that is currently underway by the ALUC Subcommittee as directed by the ALUC. This task will include meeting preparation, development of presentation materials, public hearings and related consultation. City staff will provide guidance and authorization for any services performed under this task. Task 6.4 Meetings: Assumes 2 conference calls to coordinate with City staff and attendance at 2 ALUC Meetings. Deliverables: Prepare for and attend ALUC meetings/hearings on ALUP Update. Proposed Amendment 6 Schedule and Budget This Project is assumed to start in July 2015 and continue for 12 months. Figure 1 provides an overview of the Proposed Amendment 6 Project Schedule for each of the tasks outlined above. It is also based upon our discussions and the City’s planning schedule for the LUCE Update process. Figure 2 provides an outline of the Estimated Amendment 6 Project Budget.
