ORDINANCE NO. 1021 (1984 Series)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE
OFFICIAL ZONE MAP TO REZONE PROPERTY AT 1045 SOUTHWOOD
DRIVE FROM R -2 -S TO R -3 -PD, AND APPROVING THE PLANNED
DEVELOPMENT PRELIMINARY PLAN PD 1168 (SOUTHWOOD APARTMENTS)
WHEREAS, the Planning Commission and City Council have held hearings to
consider appropriate zoning for the subject property in accordance with Section
65800 et. seq. of the Government Code; and
WHEREAS, the City Council finds that the proposed zoning is consistent
with the general plan; and
WHEREAS, the proposed zoning promotes the public health, safety, and
general welfare; and
WHEREAS, the project has been evaluated in accordance with the California
Environmental Quality Act and the City's Environmental Impact Procedures and
the City Council concurs with the Community Development Director's action to
grant a negative declaration subject to incorporation of the following measures
into the project:
A. A minimum of 2.25 parking spaces per dwelling unit shall be provided
on site to city standards.
B. Developer shall paveout a 20 -foot wide driveway plus 6 -foot wide
sidewalk to Laurel Lane within the existing 30 -foot wide access
easement.
C. Trees shall be preserved as shown in the approved precise development
plan. Trees approved for removal shall be replaced with at least one
36 -inch box specimen of comparable height and growth rate potential
as comparison for removal.

D. All residential units shall be provided with exterior walls with STC
ratings to provide a maximum noise level of 45 db Ldn on the interior
of the units. Special noise attenuation design and construction
features along the perimeter of the project shall be incorporated
into the project to maintain interior noise levels at or below 45 db
E. Development shall pay park -in -lieu fees deferred from the parcel map
SLO 79 -223, or as required by applicable standards in effect at the
time of building permit issuance.
WHEREAS, the City Council finds that the proposed project will provide
more affordable housing than would be possible with conventional development.
WHEREAS, the City Council finds that features of the proposed design
achieve the intent of conventional standards (privacy, usable open space,
adequate parking, compatibility with neighborhood character, and so on) as well
or as better than the standards themselves; and
WHEREAS, the proposed project incorporates features which result in
consumption of less materials, energy or water than conventional development.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo, as follows:
SECTION 1. That the area shown on the maps attached hereto marked Exhibit
"A" and included herein by reference be reclassified from R -2 -S (Medium - density
Residential - Special Considerations) to R -3 -PD (Medium - high - density
Residential).
SECTION 2. That Planned Development Preliminary Plan (PD 1168) is hereby
approved subject to the following conditions:
1. Applicant shall file a precise development plan for city approval within
six months. Preliminary development plan approval shall expire if precise
development plan is not filed and approved.
2. A minimum of 378 vehicle parking spaces shall be provided on site.

3. Applicant shall paveout 20 -foot wide driveway plus 6 -foot wide sidewalk,
and install 4 -foot wide planter strip to Laurel Lane, to the approval of
the Community Development Director.
4. Applicant shall make available a fixed number of apartments as low -cost
housing. The minimum number of said units shall be equivalent to seven
and one -half (7.5) equivalent units as defined by Section 9202.5.B.1. of
the Zoning Ordinance. Said units shall qualify for the Department of
Housing and Urban Development, Section 8 Rental Assistance, as
administered by the San Luis Obispo Housing Authority.
5. Applicant shall install address director boards at the project entrances
subject to the approval of the Architectural Review Commission and
Community Development Department staff.
6. Mail boxes shall be clustered at the pedestrian entrance to the approval
of the Architectural Review Commission and Camunity Development
Department staff.
7. Applicant shall pay to the city prior to ocupancy, thirty percent (30%) of
the total cost toward the future installation of a traffic signal light at
the intersection of Laurel Lane and Southwood Drive or Augusta Street.
Costs shall be determined by the City Engineer.
8. Walls and fences shall be landscaped on both sides.
SECTION 3. This ordinance, together with the ayes and noes, shall be
published once in full, at least three (3) days prior to its final passage, in
the Telegram- Tribune, a newspaper published and circulated in said city, and
the same shall go into effect at the expiration of thirty (30) days after its
said final passage or upon filing of the easement.
