HomeMy WebLinkAbout0103NORDINANCE N0. / ®13 (NEW SERIES) AN ORDINANCE REGULATING THE HANDLING, COLLECTION AND CONVEY- ING OF GARBAGE, AND PROHIBITING THE ACCUMULATION OF REFUSE BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION I. From and after the passage of this.Ordi- nance all garbage, as hereinafter defined, shall be placed by the person, firm or corporation occupying the premises upon which such garbage is created, in water -tight metal re- ceptacles, which receptacles shall be kept continuously closed by close - fitting metal covers. The contents of such receptacles shall be delivered at least once a week to some ;, person holding a license issued by the City of San Luis Obispo ap- s to haul garbage. SECTION II. The water -tight metal garbage receptacle herein required shill be made of galvanized iron, or of mater- ial equally satisfactory to the Health Department. SECTION III. The person collecting such garbage under the terms of the preceding section shall deposit the contents of all such receptacles from such receptacles directly into the wagon provided therefor, and shall deliver the contents of such wagon outside of said City on the same day. SECTION IV. The term "garbage" as herein used is hereby defined to be all kitchen - refuse of residences, restaurants, hotels and places where food is prepared for human consumption, all waste and offal from fish, meat and vegetable markets, and all organic substances of whatever kind or nature unfit for food that are subject to immediate decay. SECTION V. All vehicles used for the transportation of 1A Id t garbage, ashes or refuse of any description shall be lined with zinc, sheet iron or other metallic substance, and shall be water- tight, so that no leakage can escape from such vehicles. 'Such vehicles shall also be provided with water -tight canvas covers, which covers shall at all times, when said vehicles are passing along or standing upon any street or alley of this City be kept on such vehicles in such a manner that the covers shall extend well down the sides and ends of the vehicles, and be securely fastened at the corners, sides and ends of the vehicles; except that the cover may be partially removed while loading, but only during the time necessary to empty each garbage can into the vehicle. SECTION VI. All members of the Police Department and em- ployees of the Health Department are hereby specifically re- quired to enforce the provisions of this Ordinance, and shall have the right to enter any and all premises for the purpose of ascertaining the sanitary condition thereof, and. any person denying or obstructing such entry shall be subject to the penal- ty herein provided. SECTION VII. Any person, firm or corporation violating any of the provisions of this Ordinance shall be guilty of a misdemeanor, and. upon conviction thereof, shall be punished by a fine of not more than one.hundred($100.00) dollars, or by im- prisonment (A__i� - -- for not more than sixty days, or by both such fine and imprisonment. SECTION VIII.. This Ordinance is hereby declared to be urgent and. necessary for the immediate preservation of the public peace, health and safety, and shall take effect and be in force from and after its final passage.
