ORDINANCE NO. 1031 (1984 SERIES)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
REZONING PROPERTY AT 2306 JOHNSON AVENUE
FROM R -1 TO O -PD (PD 1193)
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Findings. The council makes the following findings:
1. The Planning Commission and City Council have held public hearings on the
rezoning in accordance with Section 65800 et. seq. of the Government Code,
and the Planning Commission has recommended approval.
2. In accordance with state and city environmental review guidelines, an
initial study (ER 16 -84) has been prepared and a negative declaration of
environmental impact was approved by the director September 27, 1984.
3. The rezoning and preliminary development plan are consistent with the
general plan.
4. The proposed zoning promotes the public health, safety, and general
welfare.
5. The planned development satisfies these criteria of Zoning Regulations
Section 17.62.040:
A. It transfers allowable development within a site from areas of
greater environmental sensitivity or hazard to areas of less
sensitivity or hazard.
B. Features of the particular design achieve the intent of conventional
standards... as well as or better than the standards themselves.
SECTION 2. The area shown on the attached Exhibit A is rezoned from R -1
(Low - density Residential) to O-PD (Office, Planned Development).
SECTION 3. Conditions. The preliminary development plan is approved
subject to the following conditions:
1. Applicant shall secure an access easement from the county, from the
on site parking area to the intersection of Bishop Street and Johnson
Avenue.
2. Applicant shall reconstruct portions of the General Hospital parking lot
and the drive aligned with Bishop Street, to the approval of the County
Engineer and the City Public Works Department.
3. Prior to issuance of construction permits, the applicant shall secure from
the county an irrevocable offer of dedication for full street right -of -way
(60 feet minimum width) to connect Flora Street with Johnson Avenue at the
Bishop Street intersection.

4. Applicant shall contribute to the cost of installing and /or modifying
traffic signals at the intersection of Johnson Avenue and Bishop Street to
the approval of City Council upon the recommendation of the City Engineer.
5. Fire access roadways shall be red - curbed and signed as required by the
Fire Department.
6. Final development plan shall indicate required motorcycle and bicycle
parking facilities dispersed throughout the project, to the approval of
the Community Development Department.
7. Final development plan shall show location, type, and size of all existing
trees to remain, to be removed, and to be relocated. Parking lot layout
may be revised, as approved by the Community Development Department, to
reasonably accommodate existing trees.
8. All site fencing shall be installed at the property lines of the site.
9. Trash enclosures shall be relocated, as approved by the Community
Development Department. Trash enclosures shall be provided within a
reasonable distance of all buildings.
10. Channel modifications and drainage easements shall be to the approval of
the Public Works Department. Landscaping and irrigation within the
drainage easements shall be maintained by the project owner. All- weather
access to storm drain inlets and outlets shall be provided.
11. Final development plans shall include precise design for storm -water
drainage, prepared by a qualified engineer, for a minimum 10 year storm.
Calculations and recommendations shall be submitted, including
consideration for the consequences of, and debris /siltation control for, a
100 year storm. Downstream, off -site improvements may be required by the
City Council upon the recommendation of the City Engineer.
12. Final development plan shall show all existing and proposed utilities,
including existing facilities to be relocated.
13. Fire hydrants shall be installed to approval of the Fire Department.
14. The exit driveway shall be deleted.
15. Uses shall be limited to physician's offices, offices for health
professionals, and outpatient medical services, and medical laboratories.
The following uses shall require approval of an administrative use permit:
A. Sales and rental of healthcare equipment and supplies (retail only
allowed).
B. Resident patient care.

16. Building design, landscaping, and signing shall be as approved by the
Architectural Review Commission.
17. The project and off -site parking and circulation improvements shall be
constructed in a single phase.
18. The final development plan shall include justification for proposed
drainage solutions and the proposed grading plan.
19. The final development plan shall not take effect until it has been
approved by the City Council.
SECTION 4. The Community Development Director's approval of the negative
declaration of environmental impact is affirmed.
SECTION 5. A summary of this ordinance, approved by the City Attorney,
together with the names of councilmembers voting for and against, shall be
published once, at least three days prior to its final passage, in the
Telegram- Tribune, a newspaper published and circulated in this city, and this
ordinance shall go into effect at the expiration of thirty days after its final
passage.
