AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING
ORDINANCE NO. 765 (1978 SERIES) AND APPROVING THE
PLANNED DEVELOPMENT PRELIMINARY PLAN PREZONING PROPERTY
KNOWN AS THE EwrHILL ANNExATION (PD 1204)
WHEREAS, property located at the northwest portion of the city consisting
of approximately 25 acres known as the Foothill Annexation was annexed and
prezoned pursuant to Ordinance No. 765 (1978 Series); and
WHEREAS, the property owner wishes to amend the preliminary development
plan pursuant to city regulations M.C. Chapter 17.62; and
WHEREAS, the Planning Commission and City Council have held hearings to
consider the requested amendment; and
WHEREAS, the Planning Commission and City Council have held hearings to
consider appropriate zoning for the subject property in accordance with Section
65800 et. seq. of the Government Code; and
WHEREAS, the City Council finds that the proposed zoning and preliminary
plan as amended is consistent with the general plan; and
WHEREAS, the proposed zoning and preliminary plan prcmte the public
health, safety, and general welfare; and
WHEREAS, the project changes have been evaluated in accordance with the
California Environmental Quality Act and the city's Environmental Impact
Procedures;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo, as follows:
SECTION 1. Findings. That this council, after consideration of the
Planning Commission's recommendations, staff recommendations and reports
thereon, makes the following findings:

1. The City Council concurs with the Ccffmnity Development Director's action
to grant a negative declaration subject to incorporation of the following
measures into the project:
A. Extension of Cerro Romauldo in Phase 1 to link it with the proposed
Ridgeview Drive.
B. Dedication and acquisition of necessary rights -of -way to accomplish
full street improvements along the entire Foothill Boulevard frontage
of the project.
C. Contribution to the upgrading of existing sewer lift station on
Foothill Boulevard; proportional to the increased service demands
resulting from the project.
D. Special landscaping; site planning and building design measures will
be included for lots 1 through 17 and 41 to minimize visual impacts
of houses on hillside and adjacent to Foothill Boulevard. Final map
should note that architectural review will be required to development
of these lots.
E. Tract map shall define location and size of maximum building
envelopes for lots 1 through 17.
2. The council finds that the proposed planned development transfers
allowable development within the site from areas of greater environmental
sensitivity or hazard to areas of less sensitivity or hazard.
SECTION 2. Amendments. That Ordinance No. 765 (1978 Series) is hereby
amended as follows:
A. Conditions 1 through 30 are deleted.
B. Add Conditions:
1. Applicant shall file a precise development plan for city approval
within six (6) months. Preliminary development approval shall expire
if precise development plan is not filed and approved.
2. Precise plan shall comply with conditions of approval for Tract 1313,
City Council Resolution No. 5765,-(1985 Series).
3. A 20 -foot wide landscape buffer shall be installed along the Foothill
Boulevard frontage of lots 2, 30' 41' and 41. Said landscape buffer
shall include planting and an ornamental wall or fence, and shall be
designed by a qualified professional. Subdivider shall install the
landscape buffer, according to plans approved by the Ccmmnity
Development Director, and the landscape buffer shall be maintained by
the property owner and located in a 20 -foot wide landscape easement.

4. Property line fencing adjacent to unincorporated territory; along the
open space easement boundaries,- and along the rear lot lines of 18
through 23 and 26 through 31 shall be of uniform design; to the
approval of the Ccmmnity Development Director.
C. Modify condition 31 to read:
5. Lots 1 through 17 shall be considered sensitive sites and development
of these lots shall require architectural review and approval.
SECTION 4. The amended Planned Development Preliminary Plan (PD 1204) is
hereby approved subject to the findings and amended conditions above.
SECTION 5. This ordinance; together with the ayes and noes, shall be
published once in full, at least three (3) days prior to its final passage; in
the Telegram - Tribune, a newspaper published and circulated in said city; and
the same shall go into effect at the expiration of thirty (30) days after its
said final passage.
