HomeMy WebLinkAbout1061ORDINANCE NO. 1061 (1986 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING CHAPTER 17.78 OF THE MUNICIPAL CODE AND RECHAPTERING IT IN ITS ENTIRETY UNDER TITLE 15 - BUILDING AND CONSTRUCTION BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. CHAPTER 17.78 OF THE MUNICIPAL CODE IS AMENDED BY AMENDING SECTION 17.78.030 AND ADDING S;t,t SEC. This chapter sets forth rules and regulations to control all grading, including, but not limited to, excavations, earthwork construction, road construction, fills and embankments, and work within waterways; establishes the administrative procedure for issuance of permits; and provides for approval of plans and inspection of grading construction. This chapter recognizes the importance of the waterways of the city and the need to regulate all changes to these waterways that may lead to increases in erosion or changes in capacity. Section 17.78.040 Definitions 29. "Waterways" means a well defined natural or man-made channel, creek, river, lake or swale which conveys surface water, storm run -off, or other natural drainage either year round or intermittently. May also be called a drainage course or drainage way. Section 17.78.050 Permits -- Required -- Exceptions H. Work within Waterways: notwithstanding any of the exceptions provided for in this section, a grading permit shall be required for all work of any consequence within any waterway in the City. The determination of what projects are not of consequence, and therefore do not require a permit, shall be made by the Community Development Director. Projects which are generally considered non - consequential are those involving routine stream bed vegetation control. Projects normally requiring a permit shall include, but are not limited to, earthwork, construction of dtaina &e_ devices or erosion control devices, removal of vegetation, and the modification of the banks and bottom of the waterway which may in the natural course of events lead to changes in flow characteristics. Section 17.78.190 Permit and Plan Checking Fees C. Alternative Fee. An alternate fee shall be charged for plan checking, administration and inspection of projects, requiring permits under this chapter, for which the regular fee structure established is inappropriate. The fee shall be as established by resolution of the City Council. The fees for plan checking, administration and inspection shall be collected in the same manner as the fee which is collected for regular grading permits. 0 1061 7 Ordinance No. 1061 (1986 Series) Page Two. SECTION 2. Chapter 17.78 of the Municipal Code, including the amendments effectuated by Section 1, is hereby rechaptered as Chapter SECTION 3. This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
