ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN LUIS OBISPO AMENDING TITLE NINE, SECTION 9.04.010
OF THE SAN LUIS OBISPO MUNICIPAL CODE TO PROHIBIT
THE CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC
PLACES; PROVIDING FOR INCLUSION OF A PROHIBITION
AGAINST POSSESSION OF OPEN CONTAINERS OF ALCOHOLIC
BEVERAGES.
Section 1. Section Number 9.04.010 of Title Nine (9) of the San
Luis Obispo Municipal Code is amended to read as set out in Exhibit A,
attached hereto and incorporated herein by this reference.
Section 2. This ord-? nance.� together with the ayes and noes, shall
be published once in full at least three (3) days prior to its final
passage, in the Telegram- Tribune, a newspaper published and circulated in
said City, and the same shall go into effect thirty (30) days after its
passage.

TITLE 9, SECTION 9.04.010
POSSESSION OF OPEN CONTAINERS OR CONSUMPTION OF
ALCOHOLIC BEVERAGES IN PUBLIC PLACES
SECTION 9.04.010 Prohibition
It shall be unlawful for any person to have in his or her possession on his
or her person, while on any city street, sidewalk, alley, roadway, parking lot,
publicly maintained place or any place open to the public any bottle, can or other
container or receptacle, containing any alcoholic beverage which has been opened, or
a seal broken, or the contents of which have been partially removed, or to consume
alcoholic beverages while in the above restricted areas.
SECTION 9.04.020 Exceptions
(a) The prohibition set out in Section 9.04.010 shall not apply to a
business licensed to sell or dispense alcoholic beverages or to any person in
compliance with the provisions of Chapter 12.20 regarding the consumption of alcohol
in a city park.
(b) The City Council, by resolution, may provide for other temporary or
limited exceptions to the prohibition set out in Section 9.04.010 (prior Code No.
4601).
