HomeMy WebLinkAbout1075ORDINANCE NO. 1075 (1986 Series) ORDINANCE AMENDING ARTICLE 80 OF THE 1982 UNIFORM FIRE CODE GIVING THE CITY FIRE DEPARTMENT AUTHORITY T0-- IMPLEMENT::' SPECIFTC -_ BUSINESS PLANS FOR EMERGENCY RESPONSE TO A RELEASE OR THREATENED RELEASE OF HAZARDOUS MATERIALS. WHEREAS, the State of California has enacted legislation to require businesses to develop specific business plans and response- plans to a release or threatened release of hazardous materials; and WHEREAS, this legislation contains pre - emptive language re- stricting cities from enacting a local ordinance after September 1, 1986; and WHEREAS, lead time is needed to coordinate and develop local forms, procedures and data files; and WHEREAS, the Fire Department currently inspects all under- ground storage tanks containing hazardous materials; and WHEREAS, the City Council is desirous to continue inspection of all underground hazardous material storage tanks and to further inspect all business plans for emergency response to a release or threatened release of a hazardous materials in the interest of public health, safety and welfare by providing certain minimum standards established by Chapter 6.95 of Division 20 of the Health & Safety Code. BE IT ORDAINED: by the City Council of the City of San Luis Obispo as follows: Section 1: Purpose - The purpose of this Code section addition is to incorporate the recently enacted provisions of Chapter 6.95 of Division 20 of the Health & Safety Code into the Uniform Fire Code. The City is authorized to assume responsibility for the administration of the Business and Response Plan Program provided the City passes a local ordinance by September 1, 1986 and consults with the County. 0 1075 s Approved: ty Admini`str4give/Xfficer 1 T City AtAorney Finance _.�M Fire Chief GT7 -Disk 3 /47-/ F/% --411 Section 2: Section 15.08.337 of the San Luis Obispo Municipal Code is hereby added. follows: Section 80.113 is added to the Uniform Fire Code to read as "Specific Business Plans for Emergency Response to a Release or Threatened Release of Hazardous Materials." The requirements of Chapter 6.95 of Division 20 of the Health & Safety Code are hereby adopted as the City of San Luis Obispo standards for Specific Business Plans for Emergency Response to a release or threatened release of hazardous materials. Section 3: This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
